Abstract

This article seeks to elaborate on the relationship between law, power, and justice from the Koran perspective. This study makes the Quranic texts its primary source. The study results show that from the perspective of the Koran, a legal system, including an Islamic legal order, must have the spirit to create justice. The realization of social justice is the spirit that underlies the stipulation of law. State power, through the legislative body, which is the institution that is authorized to stipulate law, is obliged to make the principle of justice one of a country’s legal pillars. State power through its judiciary must make “considerations for the sake of realizing justice” in every decision on a legal case.

Abstract

This article attempts to dissect the thoughts of Muhammad Abed Al Jabiri and his ideas on the reconstruction of Islamic law. This titration analysis study has succeeded in revealing that the dominance of kalam and Sufism which is too strong has caused Islamic epistemology to not develop naturally. Departing from this, Muhamad Abed Al Jabiri offers an epistemological reconstruction to help develop religious knowledge that is considered different from science in the Western world. In general, Jabiri's criticism is directed at Arab-Islamic reasoning which is ultimately integrated into turats or culture. In Jabiri's view, culture should be the starting point for criticism of reason so that the Arab revival project does not experience a historical break. Because the problem of the downturn of the Arabs actually revolves around the way they understand and treat culture, which tends to move circularly and does not move towards renewal. In this case, the epistemology of Islamic studies offered by Jabiri includes three aspects, bayâni, irfâni and burhâni.

Abstract

This article attempts to dismantle Hasan Hanafi's thoughts on the renewal of Islamic thought. This titration analysis study succeeded in revealing that according to Hasan Hanafi there are four main ideas of renewal, revitalizing the classical treasures of Islam, responding to the challenges of Western civilization, seeking revolutionary elements in religion, and creating national integrity in Islam. In addition, according to Hanafi, the term in Islamic theology does not only refer to transcendence and the unseen but also describes the characteristics and empirical scientific methods such as faith, charity, and Imamat. In explaining Islamic theology, Hanafi uses dialectical, phenomenological, and hermeneutical methods.

Abstract

This essay attempts to elaborate on the phenomenon of the political movement of the caliphate system according to Ali Abd Al-Raziq. Using critical analysis, this essay concludes that Al-Raziq essentially rejects the caliphate system. According to Al-Raziq, Muslims need to form a state based on reason alone which is influenced by situations and conditions, not based on religion. Therefore, there is no single system in an Islamic state, let alone having a normative justification. Al-Raziq also views that government affairs are worldly matters, not religious matters. He seeks to separate religious affairs from political affairs.

Abstract

This article aims to explore the concept of deconstruction of Syari'ah Abdullahi Ahmed an-Na'im. In addition, this study also focuses on the contribution of the idea of Shari'ah deconstruction to the discussion of substantive Islam in Indonesia. Using critical analysis, this study finds that the deconstruction of sharia is an experiment of an-Na'im which is very basic considering that there is no methodology that can solve the paradox inherent in sharia which discriminates against women and non-Muslims. Therefore, important issues for the future of humanity need to be defined in Islam. The ideas offered by an-Na'im in stimulating the development of discussions about substantive Islam in Indonesia.
