Abstract

Abstract -The purpose of writing this scientific journal is as a requirement for graduation and obtaining a Bachelor of Law degree at the Faculty of Law of the University of Surabaya. Practical Objectives of writing this thesis to be able to know How legal protection of consumers who buy an apartment does not have a building permit. Developers who build apartments and market while not yet IMB and construction 20% accountable to provide compensation to consumers as a form of legal protection of consumers. Replacement of damages given to the consumer may be a refund as well as the profits that should be derived from such loss or transfer to an unsold unit of apartments in accordance with the consumer agreement. Developers obviously have violated the regulations for building an apartment while not having IMB and still in the process of handling, but based on the dispensation from the Head of Jakarta Provincial Government Agency. Developers who build and market an apartment must meet the requirements of which are IMB and 20% development in accordance with the provisions of article 43 of Law no. 20 of 2011 jo article 231 of Regional Regulation no. 7 of 2010. The ban on the construction of apartments for floors 20 to 25 for disrupting flights cannot be used as a basis by developers to cancel apartments that already marketed Keywords: Legal Protection, Consumer, Apartment Abstrak –Tujuan Penulisan jurnal ilmiah ini adalah sebagai suatu syarat untuk kelulusan dan mendapatkan gelar Sarjana Hukum di Fakultas Hukum Universitas Surabaya. Tujuan Praktis dari penulisan skripsi ini untuk dapat mengetahui Bagaimana perlindungan hukum terhadap konsumen yang membeli apartemen belum memiliki ijin mendirikan bangunan. Pengembang yang membangun apartemen dan memasarkan padahal belum ber IMB dan keterbangunan 20 % bertanggung gugat memberikan ganti kerugian kepada konsumen sebagai bentuk perlindungan hukum terhadap konsumen. Ganti kerugian yang diberikan kepada konsumen dapat berupa pengembalian uang serta keuntungan-keuntungan yang seharusnya didapatkan dari kerugian tersebut atau memindahkan ke unit apartemen yang belum terjual sesuai dengan kesepakatan konsumen. Pengembang jelas telah melanggar peraturan karena membangun apartemen padahal belum memiliki IMB dan masih dalam proses pengurusan, namun didasarkan atas dispensasi dari Kepala Dinas Pemerintah Provinsi DKI Jakarta. Pengembang yang membangun dan memasarkan apartemen harus memenuhi persyaratan di antaranya IMB dan keterbangunan 20 % sesuai dengan ketentuan pasal 43 UU No. 20 Tahun 2011 jo pasal 231 Perda No. 7 Tahun 2010. Larangan pembangunan apartemen untuk lantai 20 sampai dengan 25 karena mengganggu penerbangan tidak dapat digunakan sebagai dasar oleh pengembang untuk membatalkan apartemen yang terlanjur dipasarkan Kata Kunci: Perlindungan Hukum, Konsumen, Apartement

Abstract

In this day and age the developmentof social media information is very fast, very defferent, far from the era of the -80s. The changing times experienced affect the development experienced by the parties concerned, including Islamic law. For women who are active in various fields that they pursue, course it is said that almost every sector of human life has bagun to be occupied by tough women, not only light work, but they don’t just stay at home taking care of children, houses and so on. That period of iddah in Islamic applies to women who are divorced or where their husbands are left to dieq. The method in this research uses the library research method by reading, studying books that are closely related the problem that is the object of research, so that the use of the method in the discussion in something that determines the quality of the writing in question. The conclusion is that a career women (working) during the iddah period is still active, it is said note to violate the provisions, even though the women leaves the house to earn a living. As for the prohibition for women during the iddah period it is haram to marry another man, it is haram to leave the house unless there is a reason emergency and obliged to do ihdad. Regarding the professionalism of career women in their respective fields, it is a form of carrying out Islamic law and carrying out their nature as social beings. By considering moral ethics, iddah has protection in modern development, especially for women who are actively working in their respective fields.
