Abstract

Recent studies that discuss governance in Islamic perspective have been done by various Islamic researcher including Abu-Tapanjeh (2008), Hassan (2009), Haweez (2013), etc. Most this research used the theoretical approach given in conventional corporate governance and provide additional Tahwid concept. The studies in-depth explanation of relationships between governance and Sharia principles (Islamic Law) is very limited therefore this paper tries to discuss and establish the basic theory of corporate governance based on Islamic Law. The approach used in this paper is the concept of human accountability (Amanah) on the mandate given by Allah SWT as Khalifatullah Fill Ardh. This paper expected can explore new approach to explain corporate governance in Islamic perspective.

Abstract

Muslims are encouraged to plan their lives economically and financially in order to achieve the objectives of Shariah. The intention to conduct Islamic economical and financial planning must be aligned with the application of Maqasid Shariah, which emphasizes on the protection of essential needs of Muslims that include preservation of wealth. Furthermore, goal of wealth management is to achieve falah. Objective of wealth management is to get maslahah. Maslahah based wealth management can be derived from cycle of acquiring and utilizing wealth (Firdaus, 2014). Acquiring wealth can be carried out by fullfilling worship orientation, internal process orientation, talent orientation, learning orientation, customer orientation and wealth orientation. Utilizing wealth can be carried out by allocating asset to wealth orientation, customer orientation, learning orientation, talent orientation, internal process orientation, worship orientation. This study proposes the framework of Maslahah Performa as wealth management system in order to highlight its contribution to more comprehensive, rational and realistic answers to contemporary public policy issues in Islamic economic system and to thereby increase awareness of Maslahah Performa approach in structuring and developing public policy products. For this purpose, the authors examine the position of the Maslahah Performa concept in public policy. They also present the essential elements of Maslahah Performa and explain how this approach may contribute to better solutions for various public policy issues and challenges.

Abstract

Al-Siyasah al-Shar'iyyah (SS) in Islamic history had played significant role in guiding and regulating the relations, activities and policies of Muslim states towards meeting Maqasid al-Shari'ah. Over time, this science became conservative and overloaded with general Shari'ah rules, and thus deficient of establishing a robust system of public policy formulation and analysis comparable to the current well developed conventional public policy system. Most of the literatures on al-Siyasah al-Shar'iyyah, past and present, still discuss the subject within the general principles of the Shari'ah. The present paper adopts content and thematic analyses to develop SS theoretical framework. It has used the new framework to present policy cases in Islamic Turath scientifically. Once refined, the new SS framework can be used for contemporary public policy analysis from Islamic perspective. The paper has set new direction for presenting SS scientifically that suits contemporary public policy analysis.

Abstract

The development of corporate governance issues continue to grow up to be a concern for Islamic studies scholars. There are those that directly analyze corporate governance in Islamic perspective, so the term is found on Islamic corporate governance. Furthermore, the developing corporate governance in the field of clinical as initial of clinical governance. But in its development, no studies have analyzed the clinical governance from the perspective of Islam, so it would appear a Islamic clinical Governance. This study seeks to identify the governance of Muhammadiyah charitable efforts in Indonesia engaged in the field of health by using the library based study method that is a part of the qualitative research approach. The paper found the history of the charitable efforts of health Muhammadiyah, the guiding principles of Muhammadiyah charitable health effort and the Islamic concept of clinical governance. Muhammadiyah is chosen for several reasons. Firstly, the Muhammadiyah organization in Indonesia that has a network to village level. Secondly, the first Islamic organization Muhammadiyah engaged in the business of charity health. Thirdly, the Islamic organization Muhammadiyah charitable health efforts that havespread throughout every region in Indonesia. Fourthly, Muhammadiyah has governance guidelines charitable efforts such as PedomanAmal Usaha Kesehatan, Pedoman Hidup Islami Warga Muhammadiyah (PHIWM) and Matan Keyakinan dan Cita-cita HidupMuhammadiyah (MKCHM) etc.

Abstract

Bank syariah merupakan lembaga yang bergerak dibidang jasa keuangan. Dalam operasionalnya, lembaga ini memperoleh aset dari modal ekuitas, Dana Pihak Ketiga dan dana pinjaman lainnya. Sumber sebagian besar komposis modal tersebut besasal dari liabilitas yaitu Dana Pihak Ketiga dan pinjaman lainnya. Oleh sebab itu dibutuhkan sistem manajemen yang dapat mencakup pengeloaan aset dan liabilitas. Oleh sebab itu bank syariah menerapkan Asset and Liability Management. Sistem manajemen ini telah lama berkembang dan merupakan sistem manajemen adopsi dari bank konvensional. Untuk itulah penulis akan melihat penerapannya serta kesesuaian dengan sistem bank syariah. Hasil analisis penulis menunjukkan bahwa (1) Penerapan Manajemen Aset dan Liabilitas (Asset and Liability Management) pada perbankan syariah diterapkan dalam unit khusus yang dinamakan ALCO (Asset and Liability Management Committee). Komite ini bertugas merencanakan, mengogarnisasi dan mengawasi investasi bank syariah. Tujuan manajemen ini ialah memaksimalkan profit dari sumber asset yang tersedia dengan tetap memperhatikan kebutuhan likuiditas dan prinsip-prinsip kehati-hatian; (2) Teori Manajemen Aset dan Liabilitas (Asset and Liability Management) sesuai diterapkan pada sistem perbankan syariah bila dilihat dari pengakuan bank terhadap Dana Pihak Ketiga, akan tetapi dalam penerapannya jauh berbeda dari bank konvensional. Perbedaan mendasarnya ialah bank syariah tidak memiliki kewajibannya membayar biaya modal. Biaya modal hanya akan dibayarkan bila hasil usaha menguntungkan.

Abstract

Rapid growth of Islamic Bank for the last decades shows a massive positive impact not only for the muslim itself but also for the non-muslim because the unique dan different offered system. Unfortunately, the Islamic banking industry nowadays only touches on a few minor aspects of the contribution to increase prosperity of the "small" peoples. However, 56.5 millions unit of Micro and Smal-Medium Enterprises (2012) has contributed 60% of Indonesian GDP and about 97% of labor force are become a strong reason for Indonesia to have better and stronger economy. Thus, waqf bank issue raises as a capital source to figure out this problem. This paper tries to explore further possibility development of waqf bank as one of alternatif solution to achieve social welfare and poverty alleviation.
