Abstract

Medical workers are a noble profession, especially amid the Covid-19. One of the aspects that have received the most impact from this pandemic is in the health sector. The problems in the health sector have become increasingly dangerous in the era of the Covid-19 Pandemic in Indonesia. The current condition is a concern for all people regarding efforts to control and overcome the Covid-19 Pandemic in Indonesia. This includes doctors and other health professionals. The number of deaths of medical personnel, especially doctors and nurses, is increasing. This research focuses on Indonesia's legal policies regulating protection and the fulfillment of safety work rights for health workers who are dealing with the pandemic. The legal method used in this research is normative legal research. The results show that legal protection and fulfillment of the right to safety for medical personnel have been regulated in legislation. However, these provisions do not specifically regulate the potential dangers of the spread of the Covid-19 virus.

Abstract

Indonesia is working hard to create a country that is friendly for people with disabilities. One of the concrete efforts that have been made is to form an independent agency that specifically handles the disability sector. The agency is in the form of a commission on behalf of the National Commission for Disabilities. Its formation is based on Presidential Regulation Number 68 of 2020 concerning the National Commission for Disabilities. In this regard, this study will examine further the institutional design of the commission from the point of view of state institutional law. The type of research used in this research is normative legal research with a statutory approach. The results of this study indicate that there are still serious legal problems related to the institutional design of the National Commission for Disabilities as an independent agency. This can be seen in Article 9 of Presidential Regulation Number 68 of 2020 concerning the National Commission for Disabilities which embeds the secretariat of the commission within the Ministry of Social Affairs, so that directly or indirectly the implementation and supervision functions of the National Commission for Disabilities are not optimal. The implication that arises from this condition is the rise of cases of violations of the rights of persons with disabilities. Therefore, it is necessary to restructure the institutional design of the National Commission for Disabilities as an independent agency so that it can carry out its duties, principals and functions optimally, so that Indonesia's efforts to create a disability-friendly country can actually be realized.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan dan penegakan hukum pidana terhadap tindak pidana di bidang perumahan dan kawasan permukiman. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian normatif yakni penelitian hukum yang dilakukan dengan cara mengkaji peraturan perundang-undangan yang diterapkan terhadap suatu permasalahan hukum tertentu. Hasil penelitian ini menyatakan bahwa dalam penegakan hukum pidana terhadap tindak pidana di bidang perumahan dan kawasan permukiman, khususnya penegakan hukum yudikatif, masih jarang terjadi kasus tindak pidana di bidang perumahan dan kawasan permukiman yang sampai tahap persidangan. Hal ini disebabkan karena tindak pidana yang diatur dalam Undang-Undang Nomor 1 Tahun 2011 tentang Perumahan dan Kawasan Permukiman tersebut pada dasarnya bukan merupakan kejahatan murni, melainkan hanya hukum administratif yang diperkuat dengan sarana penal, atau aturan administratif yang diberikan sanksi pidana. Adanya penalisasi tersebut agar Undang-Undang Nomor 1 Tahun 2011 Tentang Perumahan dan Kawasan Permukiman tersebut mempunyai marwah dan mempunyai efek jera terhadap pelaku tindak pidananya.

Abstract

This study aims to determine the fulfillment of the elements of Article 19 letters a and b of Law No. 5 Year 1999 related to market control carried out by PT Pelindo III. Control of the market in the world of trading is not prohibited, it becomes prohibited if the business actor's behavior is in the sale of goods or services with the aim of killing competitors. In the Decision No. 15/KPPU-L/2018, the Commission Council only stipulated Article 17 paragraph (1) and (2) letter b of Law No. 5 Year 1999 regarding the monopoly carried out by PT Pelindo III. The Commission Council considers that the 100% mandatory stack policy stipulated by PT Pelindo III is not yet feasible to be established at a port that is multipurpose like a container port, especially with the additional logistics costs that are passed on to consumers, this results in losses for various parties. This research is a normative study using a conceptual, a statutory, and a case approach. The research show that it can be concluded that the consideration of the Commission Council in the decision on the actions committed by PT Pelindo III in the case is not in accordance with the rule of reason approach, the action refers to Article 19 letters a and b of Law No. 5 of 1999 which has been proven by considering an economic point of view, seeing the existence of witness evidence, expert testimony, and the Regulation of the Minister of Transportation which was violated by PT Pelindo III.

Abstract

The policy for increasing sensitivity, awareness, and problem solving for women, youth, and children has been in the works for a long time. This virtue in affirming the rights of women, youth, and children has made it a global issue.  This grand idea has earned a stage in the community and institutions in the world. Unfortunately, in the negotiation process, they are weak and weakened. Often they do not get involves in the process of policies making and legislation especially in cybersecurity, the law of security, accessibility to cybersecurity, and the law. Therefore, based on the imbalance mentioned, the issue formulated, do the policymaker of cybersecurity law question the experience and identity of women in legal texts? How can this be possible? This article tries to analyze cybersecurity and legal struggles from Alison M. Jaggar's political philosophy and then analyzes dialectically with Feminist Legal Analysis to save women, adolescents, and children from exploitation in cyberspace. The method used in this research is a literature study. Based on the descriptive results of the data, I find that it is difficult until today for women to achieve justice in legal processes related to cyber violence.

Abstract

Business practices with the Franchise sistem in Indonesia are growing and developing, so we often encounter them around us. This kind of business sistem was basically started and popularized by westerners who incidentally is a capitalist sistem, so that for the Indonesian people, who are predominantly Muslim, this franchise is certainly a business sistem that must be studied in depth according to sharia, because specifically the use of brands must be charged other than fees other. This research is a normative juridical research with library research method. Sources of legal materials in this study include primary legal materials, namely regulations on Franchise, secondary legal materials, namely references in the form of literature related to the Franchise business, then tertiary legal materials such as Indonesian language dictionaries. From the research, it is known that the Franchise sistem applied in Indonesia is a business format franchise sistem, where a Franchisee obtains the right to market and sell products or services in a specific area or location using the operational and marketing standards of the Franchisor. The law of fee royalty for the use of brands in the franchise business sistem follows the law of syirkah which is allowed as long as the business, product or service is not prohibited by Islamic law.

Abstract

Plastic waste management is currently a major problem in several countries, especially in Indonesia. Because plastic waste cannot be decomposed. In South Kalimantan which is a wetland area, plastic waste is a serious problem that must be handled by the local government, due to the nature of wetlands that have a high water content or are inundated by water, either permanently or seasonally. The Non-decomposition of plastic waste will destroy wetlands. The specific objectives to be achieved are: (1) The legal policies that local governments take manage plastic waste in South Kalimantan. (2) The ideal future policy of plastic waste management to preserve the sustainability of wetlands. The method used to compile this research is doctrinal legal research. Legal research here does not merely examine the law as a statutory rule but also examines how the law has a positive effect on people's lives. The result shows that in drafting future policy/law the viewpoint must be established that the policy direction of the ius constituendum is not only aimed at providing protection of the right to the environment for humans but also changing the environmental paradigm and outlook towards Ecocentrism and Deep Ecology rather than the views of Anthropocentrism and Shallow Ecology.

Abstract

Following the background, the problems in this study are, first, the mechanism for implementing procedural law in E-Court for criminal cases in Indonesia, secondly how E-Court accommodates the process of proof in criminal cases in Indonesia. The method used in this research is pure legal research, which refers to and bases on legal norms and principles, applicable laws and regulations, legal theories and doctrines, jurisprudence, and other literature that are relevant to the topic. The results of this study are, firstly, the mechanism for implementing E-Court procedural law is regulated in the Supreme Court Regulation 4/2020 on the Administration and Trial of Criminal Cases in Electronic Courts provides 2 (two) alternatives for conducting trials in criminal cases, namely Normal Courts and Electronic Courts. Such matters are not previously regulated in the Criminal Procedure Code or other procedural regulations. Second, concerning the process of proofing evidence in criminal cases in E-Court still follows the provisions of the normal criminal procedure law and has the same value or power of evidence as normal trials.

Abstract

This study aims to analyze the regulation and enforcement of criminal law against the crime of blasphemy (religious defamation). The method used in this research is the normative method which is carried out by examining the laws and regulations that are applied to particular legal problems. The results of this study state that Indonesia recognizes religions and divinity so that the first principles of Pancasila and the Preamble to the 1945 Constitution explicitly state the recognition of divinity by various religions and beliefs. Therefore, every person is obliged to adhere to a certain religion and belief in its truth. However, every religious adherent must maintain harmony between communities both in carrying out their worship and implementing laws that are believed to be true. One of the actions that often trigger clashes between communities is the act of blasphemy. Along with the development of Information and communication technology, acts of blasphemy are widely spread in various virtual media, both on social media and news media. To maintain harmony, the government strictly enforces the law against crimes of religious blasphemy on various laws and regulations such as the Penal Code and Act 19/2016 on Amendments to Act 11/2008. Therefore, all offenders of religious blasphemy in Indonesia will face legal consequences according to their actions.

Abstract

Peraturan Menteri Riset, Teknologi, Dan Pendidikan Tinggi Republik Indonesia Nomor 32 Tahun 2016 pasal 4 ayat (3) Tentang Akreditasi Program Studi & Institusi Perguruan Tinggi menjelaskan bahwa Akreditasi minimum sebagaimana dimaksud pada ayat (1) berlaku paling lama 2 (dua) tahun. Isi ketentuan merupakan bentuk faktor penghambat yang dimaksud. Kententuan ini dianggap sebuah bentuk diskriminasi dan permasalahan mendasar dalam tataran kebijakan bagi Institusi Perguruan Tinggi baru, karena suatu Institusi Perguruan Tinggi secara aturan baku dalam Standar Nasional Pendidikan Tinggi, belum bisa meluluskan mahasiswa dalam jangka waktu 2 (dua) tahun pada awal izin berdirinya di terbitkan. Implikasi dari kebijakan tersebut dirasakan bagi setiap perguruan tinggi baru berdiri.Menurut asas pemerintahan yang baik atau good governance. Peran pemerintah sebagai pelaksana peraturan perundang-undangan serta penyelenggara interaksi politik melalui regulasi yang dibuatnya menjadi tolok ukur terhadap pandangan masyarakat sebagai objek hukum terhadap sistem pemerintahan yang baik, setiap regulasi yang ditetapkan akan menjadi kebijakan dan akan menjadi produk hukum yang bersifat mengikat yang harus memiliki asas keadilan, kepastian dan kemanfaatan hukum.Metode yang digunakan dalam penelitian ini bersifat Normatif, yaitu dengan menyandingkan serta menganalisis Kebijakan berupa Peraturan Perundang - Undangan dengan teori dan asas hukum yang berlaku Kata kunci: Penilaian, Instrumen Akreditasi, Perguruan Tinggi Baru
