Al-Manhaj: Journal of Indonesian Islamic Family Law (ISSN 2714-5522; E-ISSN 2715-0097) published twice a year, always places Islamic Family Law, and Islamic Civil Law in the central focus of academic inquiry and invites any comprehensive observation of Islam Family Law as a normative Islam and a system of society and Muslims as those who practice the religion with their many facets. The subject covers textual and fieldwork studies with various perspectives of Islamic Family Law, Islam and gender discourse, and legal drafting of Islamic Civil law. In the beginning the journal only served as a scholarly forum for the lecturers, professors, and students at the State Institute of Islamic Studies. However, due to the later development, the journal has successfully invited scholars and researchers outside the Institute to contribute.

Abstract

Artikel ini mengkaji tentang efektivitas mediasi dalam penyelesaian perkara perceraian  di Pengadilan Agama  menurut Peraturan Mahkamah Agung No.1 Tahun 2016 , sebagai upaya yang real yang dilakukan oleh Pengadilan dalam mempertahankan keutuhan rumah tangga. Proses mediasi yang dilakukan oleh Pengadilan Agama merupakan sebuah upaya dalam penyelesaian sengketa melalui proses perundingan atau mufakat para pihak dengan dibantu oleh mediator yang tidak memiliki kewenangaan dalam memutus atau memaksakan sebuah penyelesaian. Kajian ini merupakan kajian kualitatif, dalam kajian ini ditemukan bahwa dalam realitas yang ada di masyarkat pemberlakuan mediasi masih kurang efektif dalam menyelesaikan perkara, terbukti dari sedikitnya perkara yang berhasil diselesaikan dengan mediasi. Penyebab paling utama dalam hal ini adalah kurangnya kesadaran, egoisme dan tidak adanya kemauan untuk berdamai. Dualisme fungsi mediator yang juga berperan sebagai Hakim memberikan pengaruh bagi mediasi yang dilakukannya. Diperlukan adanya mediator non Hakim ataupun mediator bersertifikat yang lebih berpengalaman untuk lebih meningkatkan keberhasilan proses mediasi. (This article examines the effectiveness of mediation in the resolution of divorce cases in the Religious Courts according to the Supreme Court Regulation No. 1 of 2016, as a real effort by the Court in maintaining the integrity of the household. The mediation process carried out by the Religious Courts is an attempt to settle disputes through a negotiation process or agreement of the parties with the assistance of mediators who do not have the authority to decide or force a settlement. This study is a qualitative study, in this study it was found that in reality in the community the application of mediation is still less effective in resolving cases, as evidenced by the small number of cases successfully resolved by mediation. The main reasons for this are lack of awareness, selfishness and lack of willingness to make peace. The dualism of the mediator's function which also serves as the Judge influences the mediation he does. Non Judge mediators or certified experienced mediators are needed to further enhance the success of the mediation process.)

Abstract

Penelitian dilakukan ini untuk mengetahui alternatif penyelesaian sengketa melalui proses mediasi dalam penyelesaian sengketa yang terjadi dalam masyarakat hukum adat? Fokus kajian artikel ini adalah : Pertama, bagaimana tradisi penyelesaian sengketa masyarakat hukum adat? Hal tersebut terjadi karena masyarakat tidak mau ribet bercerai melalui pengadilan dan juga supaya tidak memakan biaya yang besar, maka dari itu masyarakat mengambil jalan pintas dengan bercerai di luar pengadilan. Tradisi penyelesaian sengketa masyarakat hukum adat didasarkan pada nilai filosofi kebersamaan (komunal), pengorbanan, nilai supranatural dan keadilan. Dalam masyarakat hukum adat kepentingan bersama merupakan filosofi hidup yang meresap pada jiwa seorang anggota masyarakat adat. (This research is conducted to find out alternative dispute resolution through the mediation process in settling disputes that occur in customary law communities? The focus of this article's study is: First, what is the tradition of dispute resolution for indigenous peoples? This happens because people do not want the hassle of divorcing through the courts and also so that it does not cost a lot of money, therefore people take shortcuts by divorcing outside the court. The tradition of dispute resolution for indigenous peoples is based on the philosophical values of togetherness (communal), sacrifice, supernatural values and justice. In customary law communities, mutual interest is a philosophy of life that permeates the soul of a member of the indigenous community.)

Abstract

Sebagian masyarakat Pamekasan melakukan perkawinan antara anak dari saudara laki-laki sekandung yang disebut dengan “Tongghâl Bhâllih”. Penelitian awal di desa Bandaran kecamatan Tlanakan kabupaten Pamekasan terdapat praktik pelarangan perkawinan Tongghâl Bhâllih, namun perkawinan ini masih dilaksanakan oleh sebagian masyarakat. Adapun masalah-masalah yang dikaji dalam penelitian ini dirumuskan sebagai berikut : Pertama, Bagaimana Praktik Perkawinan Tongghâl Bhâllih di desa Bandaran kecamatan Tlanakan kabupaten Pamekasan. Kedua, Bagaimana Pandangan Masyarakat tentang Perkawinan Tongghâl Bhâllih di desa Bandaran kecamatan Tlanakan kabupaten Pamekasan. Penelitian ini menggunakan metode penelitian kualitatif dengan jenis penelitian fenomenologi. Hasil penelitian ini adalah Pertama, Praktik Perkawinan Tongghâl Bhâllih di desa Bandaran kecamatan Tlanakan kabupaten Pamekasan prosesinya harus dilaksanakan setelah jam 11:00 siang di rumah mempelai wanita sekaligus paman dari mempelai laki-laki. Kedua, Pandangan Masyarakat tentang Perkawinan Tongghâl Bhâllih di desa Bandaran kecamatan Tlanakan kabupaten Pamekasan ada yang menganggap tidak boleh, namun ada yang menilai boleh dilakukan selama sesuai ajaran Islam dan tanpa keraguan. (Some Pamekasan people carry out marriages between children of sibling brothers who are called "Tongghâl Bhâllih". Initial research in Bandaran village, Tlanakan sub-district, Pamekasan district, there is a practice of prohibiting Tongghâl Bhâllih marriage, but this marriage is still carried out by some people. The problems studied in this research are formulated as follows: First, how to practice Tongghâl Bhâllih marriage in Bandaran village, Tlanakan sub-district, Pamekasan district. Second, how the community views Tongghâl Bhâllih marriage in Bandaran village, Tlanakan sub-district, Pamekasan district. This research uses qualitative research methods with the type of phenomenological research. The results of this study are First, the Tongghâl Bhâllih Marriage Practice in Bandaran Village, Tlanakan District, Pamekasan Regency, the process must be carried out after 11:00 in the afternoon at the house of the bride as well as the uncle of the groom. Second, The Community's View of Tongghâl Bhâllih Marriage in Bandaran Village, Tlanakan District, Pamekasan Regency, some think it is not allowed, but there are those who think it is permissible as long as it is according to Islamic teachings and without doubt.)

Abstract

Fokus penelitian kajian ini, pertama, Bagaimana kewarisan anak dari pernikahan dengan ahlul kitab di Kelurahan Kedung Cowek Kecamatan Bulak Kota Surabaya? Kedua, apa hambatan hak mewaris anak yang lahir dari perkawinan beda agama? Ketiga, bagaimana pandangan hukum Islam terhadap kewarisan anak dari pernikahan dengan ahlul kitab Kelurahan Kedung Cowek kecamatan Bulak Kota Surabaya? Penelitian ini menggunakan pendekatan kualitatif dengan jenis deskriptif. Hasil penelitian ini, pertama, kewarisan anak dari pernikahan dengan ahlul kitab di kelurahan Kedung Cowek kecamatan Bulak Kota Surabaya terlaksana namun sebagian tidak terlaksana. Kedua, Hambatan hak mewaris anak yang lahir dari perkawinan beda agama adalah belum adanya payung hukum yang mengaturnya. Ketiga, pandangan hukum Islam terhadap kewarisan anak dari pernikahan dengan ahlul kitab kelurahan Kedung Cowek kecamatan Bulak Kota Surabaya adalah haram. (The research focus of this study is, first, how is the inheritance of children from marriage with a man of the book in Kedung Cowek Village, Bulak District, Surabaya City? Second, what are the obstacles to the inheritance rights of children born from interfaith marriages? Third, what is the view of Islamic law on the inheritance of a child from marriage with the man of the book Kedung Cowek Village, Bulak District, Surabaya City? This research uses a qualitative approach with a descriptive type. The results of this study, first, the inheritance of a child from marriage with a man of the book in Kedung Cowek village, Bulak sub-district, Surabaya City was implemented but partially not implemented. Second, the obstacle to the inheritance rights of children born from interfaith marriages is the absence of a legal umbrella regulating it. Third, the view of Islamic law on the inheritance of a child from marriage with the man of the book of Kedung Cowek sub-district, Bulak sub-district, Surabaya City is haram.)

Abstract

Di desa Taro’an kondisi nafkah istri dan anak anaknya mendapat perhatian bahkan dari pihak mertua. Faktor itulah yang membuat rumah tangga utuh dan harmonis meskipun suami mendekam di penjara. Berdasarkan konteks diatas, maka permasalahan pokok penelitian ini : Pertama. Bagaimana pemenuhan nafkah istri dan anak oleh suami terpidana di desa Taro’an Kecamatan Tlanakan Kabupaten Pamekasan. Kedua, Bagaimana pandangan Hukum Islam terhadap pemenuhan nafkah istri dan anak oleh suami terpidana di desa Taro’an Kecamatan Tlanakan Kabupaten Pamekasan. Penelitian ini menggunakan pendekatan kualitatif deskriptif. Penelitian ini menunjukkan bahwa; pertama. Pemenuhan nafkah istri dan anak oleh suami terpidana di desa Taro’an kecamatan Tlanakan secara lahiriyah masih bisa terpenuhi. Namun pemenuhan nafkah batin belum tersalurkan kecuali dalam hal interaksi face to face saat si istri melakukan kunjungan ke penjara. Kedua, pandangan hukum Islam terhadap pemenuhan nafkah istri dan anak oleh suami terpidana di desa Taro’an kecamatan Tlanakan kabupaten Pamekasan adalah wajib. (In Taro'an village, the conditions for the living of the wife and children received attention even from the parents-in-law. That factor is what makes the household intact and harmonious even though the husband is in prison. Based on the above context, the main problems of this research are: First. How do the husbands of the convicted husband fulfill their wives and children in Taro'an Village, Tlanakan District, Pamekasan Regency. Second, how is the view of Islamic law on the fulfillment of the husband's wife and children in Taro'an Village, Tlanakan District, Pamekasan Regency. This research uses a descriptive qualitative approach. This research shows that; first. The husband convicted in Taro'an village, Tlanakan subdistrict, physically fulfills the livelihoods of his wife and children. However, the fulfillment of the inner livelihood has not been channeled except in terms of face to face interactions when the wife visits the prison. Second, the view of Islamic law on the fulfillment of the livelihood of the wife and children by the husband of the convicted husband in Taro'an village, Tlanakan sub-district, Pamekasan district is obligatory.)
