Abstract

This research was conducted to explain the practice of selling used goods through a waste bank. This study aims to clearly illustrate the practice of buying and selling used goods through garbage banks in Sajad District and a review of Islamic law on buying and selling used goods through garbage banks in Sajad District . Based on the results of the study concluded that the practice of buying and selling used goods through a garbage bank in Sajad Subdistrict already meets the terms and conditions of sale and purchase and is carried out on a like and like basis and no party feels disadvantaged. Review of sharia economic law on the sale and purchase of used goods through waste banks including legal buying and selling because in terms of purity of used goods sold in garbage banks are sacred goods and for used goods in accordance with the opinion of Hanafiyah scholars allow the sale and purchase of goods affected by unclean not to eaten. In terms of prices in the sale and purchase of used goods there has been an agreement between the two parties and no one is harmed.

Abstract

The purpose of this paper is to find a meeting point for the study of legal anthropology in national law that has been in effect in Indonesia. Indonesia's plural society makes it richer in terms of prevailing customs. Of course, each custom has its own ways and criteria for establishing and compiling norms that apply in society. This, as the National law, as the unifier of the prevailing laws in society, certainly seeks to make absolute provisions and implement justice. This study seeks to find common ground for these matters, so that the study used is a qualitative approach by suggesting the normative side of legal settlement that applies in society. The results of this study found that there is a meeting point in the study of legal anthropology if it is related to the concept of national law. This effort, of course, must be understood by law enforcers so that every dispute can be preceded by an anthropological aspect of law. This action is expected to have a side of justice that will emerge so that every problem will be able to be resolved.

Abstract

The Revolving Fund of D.I Yogyakarta Budget is the one distributed to the Yogyakarta government to the Cooperative or BMT to stimulate the development and strengthening of BMT capital (Baitul Maal Wattamwil) in the Yogyakarta area through the office of cooperatives and MSMEs. This is in accordance with Regulation of the Minister of Finance no. 218 / PMK.05 /2009 that revolving fund is funds allocated by the Ministry of State / institutions / task force of public service agencies for the strengthening of business capital for cooperatives, micro, small, medium enterprises, and other businesses under the guidance of the Ministry of State / institutions. BMT (Baitul Maal Wattamwil) or also known as Cooperatives Save Borrowing and Sharia Financing (KSPPS) is one of the businesses of Sharia financial institutions whose operational prinip based on sharia, namely the Quran and Al-Hadith. In sharia business it is important to carry out sharia values that contain 5 (five) values, namely Ownership Value, Justice Value, Balance Value, Freedom Value and Diversity Value, so that sharia financial institutions do not deviate from sharia values themselves. While the development of sharia business, which from year to year is increasing, the more BMT or KSPPS get financing programs from the government, one of which is the revolving fund program of D.I Yogyakarta Budget. Starting from 2008 who get a revolving fund program only 1 BMT out of a total of 18 cooperatives but in the revolving fund program in 2016 and 2017 there are 22 BMT out of a total of 31 and 39 cooperatives that get revolving funds apbd D.I Yogyakarta, this shows the performance and growth of BMT is good. With good performance and growth by BMT there are some BMT / KSPPS who still doubt the validity of the revolving fund program APBD D.I Yogyakarta, so it is necessary to look at the values in this revolving fund sharia. By looking at the description above, in this journal will be discussed how the Urgency of Sharia Business Values in the Revolving Fund Program APBD D.I Yogyakarta.

Abstract

Violence in Indonesia are growing very fastly, not only between individuals with individuals, but also between groups to the century. Example bombing Oikumene church in Samarinda. The problems caused system of peace in cauntry can’t be well realized. So, in society and state must be applyed principle and the value of peace. The value of peace is love, tolerance, control, and leave violence. While the principle is honesty and responsibility (al-Amanah), justice (al-‘Adalah), brotherhood (al-Ukhuwah), respecting pluralism (al-Ta’addudiyah), equality (al-Musawah), consciousness (al-Syura), prioritizing peace (al-Silm) and control (Amr bi al-Ma’ruf Nahy ‘an Munkar). If applyed the value and principles in the state, so that have realized of peace and ideal cauntry.
