Abstract

The purpose of this study is to find out how students can become commercial sex workers and what is behind these deviations. This research is a qualitative research with a descriptive approach. The subjects of this study consisted of three students who are currently commercial sex workers in online prostitution. This research shows that one of the factors driving students to become commercial sex workers in online prostitution is formed because of economic, social and environmental factors. In addition to being a commercial sex worker, students can usually also be hired as a date. Customers usually after getting an agreement can meet in person at an agreed place beforehand. All of these transaction processes can be done quickly and privately. There is agreement between the two before engaging in the practice of prostitution.

Abstract

Prostitution is an anti-social sexual deviation because it violates the norms of decency, norms of decency, customary norms and religious norms. This prostitution occurs in society in the form carried out by a group or individual in an organized manner consisting of pimps, the purpose of getting wages or rewards from those who have used their services. there are two parties namely PSK (Commercial Sex Workers) and masher men as customers. In the Criminal Code (KUHP) only regulates pimps, not yet regulating PSK and its customers. This has an impact on the development of prostitution in people's lives. Prostitution is regulated in Article 296 and Article 506. There are various factors behind the occurrence of this prostitution, such as economic factors caused by economic pressures and life burdens, there are also social factors such as the social environment, and family factors due to divorce or family problems. This study aims to find out what factors underlie the phenomenon of a CSW and analyze based on the perspective of criminological law. This research is located at Semarang Poncol Station on Jalan Imam Bonjol Semarang. This research uses an empirical and qualitative juridical approach. The results of the research and discussion show that the author obtained, among others, can be explained through the formulation that we discussed, namely: The characteristics that exist in the perpetrators of street prostitution, the impact on prostitution, technicalities in transactions between customers and prostitutes, and theories justify the existence of deviations in prostitution.

Abstract

The existence of violating public order, as well as violation activities in accordance with article 480 of the Criminal Code are the characteristics of Kokrosono traders. The provisions of the article refer to criminal relief measures in terms of helping perpetrators of theft crimes obtain benefits from the results of their actions. The uniqueness of merchandise on Jalan Madukoro is that some traded goods are stolen goods. Capital of confidence in the thief makes the stock of stolen goods from the perpetrators of theft is always there. In this case, thieves and stolen merchants can automatically be subject to criminal penalties because there is an intentional element in them, different from the buyer who must be investigated first. This behavior can only be overcome with two channels, namely legal channels and non-legal channels. The legal route leads to regulations related to the detention activities in criminal law and to the extra-legal channels only as countermeasures before the event occurs. Significant differences regarding countermeasures between after and before are in their aftermath.

Abstract

These research aim to describe and analyze what are the factors behind a person's choosing to become Commercial Sex Workers (CSWs). In addition, this observation also aims to find out how people's perceptions or views about the existence of these CSWs around the community and their impact as well as what efforts have been made to eradicate this CSW in its shelter. This study used descriptive qualitative method. The object of research is the CSWs and the surrounding community. The sample used was purposive sampling, which is sampling based on specific objectives and considerations. Data collection techniques using interview techniques to informants conducted by non-participant observation which only observes and makes observations and documentation. Whereas to analyze the data used an interactive analysis model from Miles and Huberman namely data collection, data reduction, data presentation and conclusion drawing. The results of the study that the authors found in the field that the dominant factor that causes a person to work as a prostitute are economic factors. Economic factors in this case are difficult to meet their daily needs because there are no jobs that generate enough money to meet their daily needs. In addition to economic factors, there are also other factors such as the difficulty of finding work, low levels of education, income factors become more adequate sex workers to meet the needs and family factors.

Abstract

This research analyzes about lottery gambling as one of social deviations. Togel gambling is seen as one of the forms of social pathology, where social pathology itself is defined as any form of behavior that is deemed inappropriate, violates general norms, customs, formal law or cannot be integrated into general patterns of behavior. Gambling is one of several forms of community disease that in essence is contrary to the Religion, Ethics, and Moral Pancasila, fiber is harmful to the livelihoods and lives of the people, nation and state. Therefore the Government of Indonesia is making efforts to curb gambling, to limit it to the smallest possible environment. With various forms of gambling that are rife in people's daily lives, both overt and covert, some people tend to feel stupid and seem to view gambling as something natural, not breaking the law, so there is no need to question , even some of them argue that gambling is just a small violation. Whereas on the other hand, there is an impression from law enforcement officials who are not so serious in handling this gambling problem.

Abstract

Homosexuality is a behavior of social deviation that is considered to violate human nature and violate the norms that exist in Indonesia as a civilized country according to the First Precepts and Second Precepts. Ironically, there is no legal umbrella that can ensnare homosexuals, whereas if viewed from homosexual criminology this is included in crime because crime is not only considered as something that violates the rules contained in the legislation but something that is considered to violate the values values ​​and norms that exist in society that disturb security order and something that harms the community. From the point of view of criminology, as well as the legal arrangements governing LGBT if it is linked to the Criminal Code, and prevention and control efforts so that LGBT can be overcome. The method used in this study is a juridical approach, which is done by examining primary data by direct observation in the field. The factor behind a person being a part of homosexuals is environmental factors because the environment can lead someone in a negative or positive direction and if related to criminology according to my analysis can be related to Differential Association theory where crime can be learned through close communication. The legal regulation governing LGBT is still considered weak and if it is linked to the Criminal Code it cannot yet fully regulate LGBT because the elements in it have not been fulfilled and there is still a legal vacuum.

Abstract

Karaoke and the Bar in many cases serve as a place of illegal prostitution. This right is a deviation in society. The purpose of this study is to find out how karaoke guides do the work in Bandungan and the background of these actions. This research is a qualitative research with a descriptive approach. The subjects consisted of seven karaoke guides and one boarding house owner. In data collection techniques using observation, interviews, and documentation. Data analysis uses conclusion drawing. The results of this study, karaoke guides in Bandungan Kabuaten Semarang were formed due to economic base, low education and environmental factors. In addition to serving as a karaoke guide, this karaoke guide woman can be hired for dating and concurrently a profession as a Commercial Sex Workers or CSWs. Customers and song guide women do transactions outside the karaoke place. There is agreement between the two before engaging in covert prostitution practices.

Abstract

Humans are social creatures where one human needs another human being so that in their daily activities they always interact with one another. Naturally, each individual adapts to an environment that makes the individual comfortable and adapts to the environment in which he is and lives together so that there are order and order in living together, society as a container or social environment that influences the lives of the individuals in it. This research aims to analyze the phenomenon of crime among street children in the city of Semarang. This research method uses a qualitative approach, where the author sees and observes directly the various activities of street children in the city of Semarang. This research found that crime is caused by several factors such as economy, relationships, opportunities, and others. These factors that have occurred in Indonesia have shown a negative effect. A large number of people commit wrong actions with the sole purpose of wanting to make ends meet. Street children choose the environment on the streets sometimes not only because of economic hardship but also because they enjoy the environmental conditions on the streets. Street children do not always have a place to live, children who feel stressed by the condition of their family and home environment, sometimes feel more comfortable choosing the streets as their living environment.

Abstract

The use of civil instruments in corruption cases is fully subject to the provisions of civil law both formally, materially and even to immaterial losses. In accordance with Articles 32, 33 and 34 of Law Number 31 of 1999 concerning Eradication of Corruption, there is a formula regarding the submission of the results of the investigation into the State's loss to the State Attorney. The prosecutor must be able to really prove that the defendant actually committed an act of corruption. In accordance with the concept of proof in civil law, JPN must be able to convince the panel of judges by basing on a clear legal basis, the existence of an element of loss and explaining the occurrence of acts of corruption that are detrimental to the State's finances. However, it is often difficult to substantiate civil lawsuits to prove, given that the perpetrators of corruption in general are those who have very strong positions or experts. The research method used in this research is analytical descriptive. The research results obtained can be seen from the strength of the evidence in filing a civil claim must first trace assets owned by the perpetrators of corruption as the basis and reason for the lawsuit but the civil suit has not been effectively proven by relying only on special criminal courts because the imposition of fines and reimbursement is included without taking into account any immaterial losses that can be paid in the future.
