Abstract

This study aims to analyze and compare the financial performance of Islamic banks (BUS) and conventional banks (BUK) in Indonesia during the 2018–2023 period, focusing on profitability, operational efficiency, credit risk management, capital adequacy, and liquidity. This research employs a quantitative comparative method using secondary data analysis sourced from OJK's Sharia Banking Statistics (SPS) and Indonesia Banking Statistics (SPI) across multiple editions, as well as related academic literature. The sample consists of 10 Islamic Commercial Banks and 10 Conventional Commercial Banks with the highest total assets, selected through purposive sampling. Data were analyzed using descriptive statistics and comparative analysis based on key financial ratios. The results indicate that conventional banks outperform Islamic banks across all dimensions studied during the overall 2018–2023 period: ROA averaged 2.20% vs. 1.69%, BOPO 79.82% vs. 83.64%, NPL/NPF 2.73% vs. 2.92%, and CAR 24.84% vs. 21.67%. However, a significant finding is the marked improvement in Islamic bank performance following the merger forming Bank Syariah Indonesia (BSI) in 2021. In the 2022–2023 sub-period, Islamic banks recorded lower NPF (2.27%–2.42%) than the NPL of conventional banks (2.49%–2.78%), and achieved their best-ever BOPO of 77.28% in 2022, surpassing conventional banks

Abstract

The study of Islamic law has undergone significant developments in line with the social, cultural, political, and technological dynamics of the modern era. Islamic law is no longer sufficiently understood normatively and textually, but rather needs to be studied contextually through inter- and multidisciplinary approaches. This article aims to analyze the concept, characteristics, and urgency of interdisciplinary and multidisciplinary approaches in the study of Islamic law, as well as their relevance in addressing modern social challenges. The method used is qualitative research with a library approach, through analysis of classical and contemporary literature relevant to Islamic law and the social sciences-humanities. Data collection techniques are carried out through documentation studies, namely by inventorying, reading, and reviewing written sources directly related to the research object. Data analysis is carried out using qualitative-descriptive analysis techniques through a systematic and gradual content analysis approach. The data analysis process is carried out through several steps: (1) data reduction; (2) categorization; (3) interpretation; and (4) drawing conclusions. The main novelty of this research lies in the reorientation of Islamic legal studies from a normative-textual approach to a contextual and dynamic inter- and multidisciplinary approach.

Abstract

This study aims to analyze the policies and implementation of family consumer protection in consumptive financing at PT. Sinarmas Multifinance Cirebon Branch and to evaluate them from the perspective of maqāṣid al-sharī'ah. The research employs a juridical-empirical method with a qualitative approach. Data were collected through in-depth interviews, field observations, and documentary studies, and then analyzed using both juridical and maqāṣid‑based analysis. The findings indicate that the consumer protection policies have been designed in reference to national regulations, but their implementation has not been fully optimal in protecting the interests of debtor families. From the maqāṣid perspective, the financing practices have fulfilled ḥifẓ al-māl (protection of wealth), yet remain weak in ḥifẓ al-nasl (protection of family resilience), ḥifẓ al-ʻaql (protection of rationality), ḥifẓ al-nafs (protection of psychological well‑being and dignity), and ḥifẓ al-dīn (ethical and moral responsibility). This study underscores the necessity of integrating maqāṣid values into consumer protection policies so that consumptive financing is oriented not only toward economic interests but also toward justice and family welfare.

Abstract

This study explores the complexity of gender issues in Islamic law and their impact on human rights in the context of the Muslim world to uncover patterns of gender inequality that persist in law and social practice in various Muslim societies. This study is based on the literature study method with an approach to literature analysis carried out in an integrative and comprehensive manner. The results highlight the importance of a deeper understanding of gender issues in Islamic law and their implications for human rights in efforts to achieve a more inclusive society and respect for human rights for all individuals in the Muslim world. Despite an Islamic legal framework that provides the potential for gender equality and the protection of human rights, patriarchal interpretations and unequal practices still dominate in many cases. The impact of Islamic legal practice on human rights, especially women and minorities, often involves violations of fundamental rights such as freedom of religion and equality in the eyes of the law. However, there are also efforts to reform Islamic law that focus on more inclusive interpretations and support for human rights, raising hopes for positive future change.

Abstract

Interfaith marriages in Indonesia present complex legal challenges, particularly in divorce cases that impact the allocation of child custody (hadhanah). Divergent interpretations based on Marriage Law and the Islamic Legal Compilation (KHI) often create uncertainty for judges and dilemmas in determining custody, especially regarding ḥifẓ al-dīn alongside the application of standards prioritizing childs protection. The research investigates a legal validity on interfaith marriages according to both the Marriage Law and KHI, while also assessing the legal certainty surrounding child custody in cases of interfaith divorce from an Islamic law perspective. The study adopts a normative legal methodology, incorporating statute-based, case-based, and conceptual approaches. Data are gathered and analyzed through a literature review using primary, secondary, and tertiary sources. The results reveal that cross faith marriages were not acknowledged as recognized by either Islamic or national law, and that child custody arrangements in such divorces emphasize the best interests of the child, with religious safeguarding (ḥifẓ al-dīn) being a core element of a (maqāṣid al-shari‘ah).

Abstract

This phenomenon constitutes a serious concern within Muslim families, as marital harmony represents a fundamental pillar in Islamic family law. Accordingly, this study seeks to identify the underlying factors that position online gambling as a threat to household stability, to examine its impact on marital harmony among Muslim families in Kecamatan Topos, and to analyze the responses offered by Islamic family law in addressing this issue. This research adopts a qualitative descriptive approach within a field research design. Data were collected through in-depth interviews with 20 informants, comprising 10 household heads involved in online gambling, 5 wives, 3 religious leaders, and 2 Islamic counselors. Data collection techniques included interviews, observation, and documentation, which were subsequently analyzed using thematic analysis framed by fiqh al-usrah and maqashid syariah perspectives. The findings indicate that the primary contributing factors include economic pressure, ease of digital access, and psychological addiction, all of which lead to the neglect of familial responsibilities. The resulting impacts involve financial conflicts, strained marital relations, declining communication quality, and child neglect. From the standpoint of Islamic family law, such practices are categorized as mafsadah and may be construed as forms of nusyuz or dharar.
