Abstract

Undang-Undang No. 6 Tahun 2014 tentang Desa mengatur 2 (dua) materi pokok yaitu Desa-Birokrasi (DB) dan Desa-Adat (DA). Namun UUD NRI 1945, UU 6/2014, PP No. 43 Tahun 2014 jo PP 11 Tahun 2019 bahkan Perdprov No. 4 Tahun 2019 tidak mengatur hubungan antara DB dengan DA, padahal pada satu wilayah desa bisa ada terdapat keduanya. Implikasinya adalah menimbulkan kerancuan dalam pemahaman pengaturan hubungan kelembagaan dua jenis desa berbeda tersebut. Perdaprov No. 4 Tahun 2019 hanya mengatur DA namun juga tidak mengatur hubungan kelembagaan dengan DB. Pola hubungan kelembagaan kedua desa itu penting diketahui, agar dapat diperoleh pelajaran perbaikan pengaturannya bagi Undang-Undang Desa dan materi pembelajaran bagi mahasiswa. Penelitian hukum ini bersifat socio-legal case study dengan lokus 2 desa pakraman utama dan 1 lembaga penelitian Universitas Warmadewa, menggunakan metode studi kasus dengan teknik pengumpulan data document-review dan FGD, dan konsep MPFAA (Meaning-Positioning-Functioning-Authorizing-Actuating) untuk menganalisa hubungan kelembagaan DB-DA sebagai landasan analisa hubungan DB dan DA di Bali. Hasil penelitian menunjukan bahwa kerancuan pengaturan hubungan kedua kelembagaan DB dengan DA adalah Pasal 1-95 (DB) dan Pasal 96-111 (DA) UU 6/2014 yang tidak mengatur pola hubungan antar mereka, padahal faktanya kedua jenis desa tersebut bukan kelembagaan yang saling terpisah samasekali. Temuan menunjukkan bahwa hubungan kelembagaan desa di Bali, masyarakatnya memandang hubungan antara kedua kelembagaan desa tersebut adalah ibarat hubungan antara “suami-isteri” atau “satu mata uang dengan 2 sisi”. Ratio-legis pembentukan Perda Provinsi Bali 4/2019 tidak berlandas pada UU 6/1014 namun UU 23/2014 oleh karena masyarakat di Bali memandang DB dan DA adalah bukan suatu kelembagaan yang terpisah sebagaimana diatur DB-DA oleh UU 6/2014. Perdaprov 4/2019 menunjukkan tidak relevannya DA diatur melalui UU 4/2016, karena DA tidak perlu diatur namun cukup direkognisi.

Abstract

This study aims to examine the weaknesses of obtaining property rights on state land and the legal consequences of the issuance of property rights on state land through a legally flawed Complete Systematic Land Registration (PTSL). The method used is a normative legal writing method, using a statutory approach, a conceptual approach, and a historical approach. As an analytical tool for the legal issues studied, this study uses the theory of legal certainty, the theory of legal protection and the theory of legal justice. Based on the results of the analysis, it can be found that there is an inconsistency of norms between the Minister of ATR/BPN Number 6 of 2018 and Government Regulation Number 24 of 1997, namely Article 33, Article 22 paragraph (2), Article 24 paragraph (2) of the Minister of ATR/BPN Regulation No. 6 of 2018. The existence of the inconsistency of these norms creates legal weaknesses and uncertainty in the community regarding the suspension of BPHTB and PPh debts, a statement of ownership of rights in good faith, the principle of publicity for the announcement of physical data and juridical data, the application of the principle of contradictory delimitation in determining the boundaries of land parcels through Complete Systematic Land Registration (PTSL). The result or output in the form of a certificate of ownership that is issued has a legal defect. The legal consequences of the issuance of a certificate of ownership of state land through a Complete Systematic Land Registration (PTSL) which is legally flawed, namely cancellation due to a defect in administrative law and cancellation by implementing a court decision that has permanent legal force.

Hukum ada pada setiap masyarakat dimanapun mereka berada, oleh karena itu keberadaan atau eksistensi hukum sifatnya universal. Hukum tidak dapat dipisahkan dengan masyarakat tetapi justru mempunyai hubungan yang timbal balik. Norma hukum dibuat menurut beberapa cara yaitu norma umum melalui kebiasaan atau undan-undang, norma khusus melalui tindakan-tindakan pengadilan dan administrasi atau transaksi hukum.

Abstract

Balinese agriculture as a culture that becomes Balinese cultural tourism identity should still receive protection in line with the rapid development of tourism. However, in reality, the rapid and uncontrolled development of tourism is accused of having a big impact on the conversion of agricultural land in Bali. The disharmony that occurs can be used as a sign that the existing regulations have not been able to complete and integrate tourism and agricultural development. In this case, tourism development is not accompanied by legislation to protect agricultural land. This study aims to examine the legal arrangements related to tourism development with integrated agriculture in Bali and to examine the efforts that the government can take to integrate tourism development with agriculture in Bali. Empirical legal research is the type of this study. In addition, the approach used in this study is legislation approach, legal concept analysis approach and facts approach. The results of this study revealed that 1) the existing regulations relating to tourism development and agricultural development in Bali have provided an opportunity for integration between tourism development and agriculture in Bali, however, the regulations have not been optimal in preventing and reducing the negative impacts of rapid and uncontrolled tourism development. 2) In the perspective of ius constituendum, Bali tourism development must continue to provide protection for living cultural values, one of which is agriculture because basically Bali tourism development is based on Balinese culture which is imbued with the values of Tri Hita Karana and Sad Kerthi.

Abstract

Customary land (tanah ulayat) of a tribe means an inheritance land and the natural resources on and inside it, passed down from generation to generation, and the rights of customary land belong to customary law community. Customary land/customary land rights (hak ulayat) are a joint land, believed to be a gift from supernatural forces or inheritance from ancestors to a group of people, the customary law community, that serves as the main supporting element for the community’s life and livelihood all the time. Based on the background of research, the researchers formulated research questions as follow: How is the regulation on the use of tribal land in Palakahembi Village, Pandawai Subdistrict, East Sumba District, East Nusa Tenggara Province; How is the effectiveness of the regulation on the use of tribal land in Palakahembi Village, Pandawai Subdistrict, East Sumba Regency, East Nusa Tenggara Province. This research aims to provide legal comprehension to society concerning the regulation on the use of tribal land and to study and understand legal issues concerning the regulation on the use of tribal land. This is empirical legal research, which reveals facts (the fact approach). Applying this approach, the researchers observed and collected facts in the field methodically, and these facts are used as supporting materials for the research. This research took place in Palakahembi Village, East Sumba District, East Nusa Tenggara Province. The result of this research shows that there is no clear commensurate border of tribal land (a source of horizontal conflict between tribes), no Regional Regulation of East Sumba District that specifically regulates and use tribal land based on its characteristic, and the region’s local wisdom. The researchers suggested that it is necessary to draw up a Regional Regulation that serves as a stepping stone in the use of tribal land based on the tribe’s local wisdom.

Abstract

Policies in the implementation of health services at BPJS Health there are still obstacles experienced by patients and the hospital. Legal protection in health services aims to ensure legal certainty obtained by patients, so that patients avoid losses when receiving health services that should be optimally provided by health workers. The purpose of this study is to examine the implementation of the internal policies established by the Wangaya Hospital, Denpasar City in the implementation of BPJS Health services and to examine the legal protection for patients in BPJS Health services at Wangaya Hospital Denpasar City. This study uses empirical legal research methods, using the approach to legislation, analysis of legal concepts and facts. The research location is at Wangaya Hospital, Denpasar City. The results of this study showed that the implementation of internal policies at Wangaya Hospital, Denpasar City in providing BPJS Health services, namely with the authority of hospitals to be able to formulate and implement hospital regulations (hospital by laws) which contain general hospital services policies that support corporate governance and good governance, clinical governance. In the implementation of BPJS Health at Wangaya Hospital, Denpasar City, there are obstacles, such as: obstacles in claiming, technical, procurement of medicines that are not available or not yet available at distributors. Meanwhile, legal protection in BPJS Health services where patients are BPJS Health participants to be able to fulfill their rights as participants or patients. Patient rights have been regulated in the Medical Practice Law, Health Law, and Hospital Law. Legal protection is provided by the BPJS Health and the Hospital, namely by establishing a PIC (Personal in Change) which functions to accommodate handling patient complaints or related to BPJS Health services.

Abstract

In principle, rural spatial planning local wisdom based on a sustainable spatial planning system is an embodiment of immaterial and material harmonization or balance of life between humans and God, between humans and humans and humans and the environment. Local wisdom on spatial planning in rural areas is interpreted as a system of values, culture, politics, law, economics and religiosity which functions to guide patterns of behaviour in understanding space as a place to live. This study aims to examine legal culture as a value system in the formation of the legal system elements and the principle of Tri Hita Karana as a harmonization of spatial planning in Bugbug traditional village. This study used an exploratory method and this type of research is a qualitative descriptive study of law. The results of this study showed that spatial planning of rural areas local wisdom based is very important as a recognition of the rights of rural communities. In fact, spatial planning arrangements for rural areas with local wisdom aim to protect and manage the environment in a sustainable manner for the benefit of every generation and become the basis for planning, utilizing and controlling sustainable spatial planning. The concept of regulating rural spatial planning local wisdom based in managing rural spatial planning local wisdom based through customary village autonomy in the Bugbug Traditional Village is to create spatial planning in favour of village communities through a rural spatial planning model based on traditional villages through implementing the Tri Hita Karana principle in the spiritual environment, social environment, and natural environment.

Abstract

Waste management is still an unresolved problem. This study aims to examine problems in waste management in the city of Denpasar. This research is empirical legal research with a statutory approach. Data was collected with primary and secondary data and then analyzed qualitatively. Several laws and regulations correlate with waste management in Indonesia, namely Law No. 18 of 2008 concerning Waste Protection and Management. Structure, substance, and culture are three legal systems combined to make up law enforcement in the waste management industry. Moreover, there are two perspectives on law enforcement in waste management: preventive law enforcement and repressive law enforcement. To increase public awareness of a good and healthy environment, law enforcement in waste management also embraces the principles of Good Environmental Governance of the federal and municipal governments. The study results show that the Denpasar City Government already has mentoring rules regarding waste management. However, waste management based on good environmental governance in Denpasar City has not been effective. This is because the community and the lack of public awareness of healthy living still commit many violations. Thus, the government still needs to improve and increase the regulation and supervision of waste management in Denpasar City.

Abstract

Customary land in Bali has a very close relationship with the daily life of indigenous people in Bali. Until now, inheritance disputes still occur a lot in Bali, especially seeing the economic value of customary land in Bali today, it also triggers people who have converted from Hinduism to have the same rights as those who are still Hindus in terms of inheritance regardless of the various obligations that must be carried out in Balinese Customary society. The objectives of research are to explore and identify the temple land / Druwe Mrajan land which is still sustainable today, and find court decisions that strengthen Balinese Customary Law. The method uses descriptive approach to describe precisely the properties of an individual, situation, symptom or certain group to determine the presence or absence of a relationship between a symptom and other symptoms in society. Through an Empirical approach, with the reality that occurs in the community according to the Awig-awig of the Padang Luwih Traditional village, states that people who have left Hinduism (Ninggal Kedaton) no longer get inheritance rights in the family, because they cannot carry out their obligations both in life in the Customary community, Family, and obligations to ancestors in Mrajan Agung. Inheritance in Balinese customary law does not solely contain the rights of the heirs to the inheritance property, but more than that, the most important is the obligation of the heirs to the testator. The obligation of the heirs is a consequence of the rights they receive.

Abstract

Prior to the 1990s, there was no agency that managed Batur tourism objects and resources. In 2017 a tourism area management body was formed, but at that time its authority was limited to the imposition of levies for tourists visiting the Geopark tourism area. It is not clear which agency has the authority to organize tourism areas, so a problem arises: The agency authorized to organize tourism areas and the factors that affect the arrangement of tourism areas. This research aims as evaluation materials in arrangement the Batur Unesco Global Geopark Tourism Area in Bangli Regency The research method used is empirical legal research. The analysis techniques that will be used are Legal-Content Analysis and Futuristic Analysis. This legal research aims to analyze the problem, namely the agency authorized to organize the Batur UNESCO Global Geopark tourism area in Bangli Regency. The authority of the management body is limited only in collecting fees, whereas for a significant increase, the authority of the agency is not only to collect tourist fees, but also to organize the area to increase its tourist attractiveness. The results of the discussion of the regulation of the authority for structuring tourism areas are the Bali KSDA and the Bangli Regional Government, as well as the not yet implemented regional arrangement based on natural preservation, community empowerment, and environmental economic progress. Meanwhile, the conclusions and suggestions are that the Management Agency has not yet been authorized to organize tourism areas. Factors that influence the structuring of the tourism area are the substance of the Bangli regional regulation, concerning households, local law enforcers, and the legal culture of the local community. Suggestions that the tourism area management body should be changed to Perumda. Law enforcement must have synergy between the Bangli Regional Government and the Bali BKSDA.
