This paper explains that the development of BUMN (state owned enterprises) as a corporation that carries out social and business missions is facing constitutional juridical problems and facing the challenges of globalization. Factually, at this time legal development cannot be separated from the influence of globalization. Globalization in the economic field has affected various fields of the business sector in the world. This globalization is followed by the globalization of law, which causes substantially various laws and agreements to spread across national borders, which causes the merging of legal principles (especially in the economic sector) from one country to another . For Indonesia, the logical consequence of this development is the demand to harmonize the principles of economic law in Indonesia, with the principles of economic law in the international world. Without harmonization, Indonesia can be ostracized in international business activities, because there is no certainty for legal protection for business and investment activities that are commonly carried out globally. The Constitutional Court in case number 48 / PUU-XI / 2013 and case No. 62 / PUU-X1 / 2013 dated May 22, 2013 decided that management BUMN must use the principle of Business Jugment Rule. In the ruling, it was also stated that state owned finances were state finances. As a result, this ruling brings legal certainty about the position of finance of BUMN.

The enactment of Regional Regulation of Medan City Number 13 of 2011 and Regional Regulation Number 2 of 2016 have not accommodated the importance of Cultural values in the process of formation on spatial and region planning so that the RTRW development carried out by the Medan City government is only based on regulation alone without looking further into the social context and culture. According to Von Savigny's Theory, the formation of law must be based on people's souls (Volkgeist) as the raw material for the formation of law. Therefore, in the formation of regional regulations must pay attention to the cultural values of the indigenous people of an area. The inclusion of Malay cultural values in regional regulations in Medan City is a form of the realization of the state implementing Article 18B paragraph (2) of the 1945 Constitution. Integration of the cultural values of the Malay people in Medan City into regional regulations is carried out through the implementation of the legislative functions of the Medan City Government and DPRD to accommodate and protect the soul of the nation from the original tribe of Medan City whose existence has been marginalized. Revitalizing the cultural value of the Deli Malay in Medan City into spatial and region regulation is a form of protection of the Medan city government towards the cultural, historical and social values of the Malay people in the Medan City.

This article analyzes the problem of absenteeism in the municipal elections in Mozambique, specifically analyzing Matola municipality in Maputo province. The central argument of this article is that the electoral absenteeism is a form of political questioning in order to demonstrate the dissatisfaction and protest of the electoral process per se. Most representative western democracies and Mozambique in particular, have experienced in recent times a higher percentage of abstention in electoral process. This phenomenon is due to the transformation of the way of understanding political participation through voting, which denotes the lack of political culture of elections. Therefore, it is concluded that in order to minimize the absenteeism in Matola municipality it is necessary to create a favorable institutional environment, where the citizens will feel the effect of their vote that guarantees them the exercise of citizenship.
