Abstract

The internet and social media expand public sphere has been much associated with public sphere and digital networks in many studies, where Habermas's public sphere theory and the theory of the Castells network society have been much debated about its relevance to the techno-social development. Both Habermas and Castells tend to see the public sphere of the Internet as a contestation space where corporate and state forces work in various ways to control and dominate it. This study emphasizes more on the creativity of citizens forming community networks through the use of the Internet and social media and conducting autonomous conversations in the public sphere. Netnographic studies of the dynamics of the discourse of public sphere in the social movement networked Indonesia Berkebun show that the Internet and social media become creative means for citizens to package global discourse locally to voice their demands. This study concludes that the concepts and theories of public sphere, network society are relevant as tools for analyzing public sphere and Internet networks and social media. The potential of the Internet network and social media as autonomous communication spaces depends on the design and purpose and the utilization of available features. Conversations that are restricted to the agenda of the 3E program help communities focus on discourse and shape the character of a rational Indonesian gardening space. This community from the beginning realized the potential of the Internet and social media to form networks and public spheres. But like gardening, public sphere requires commitment, such as caring for the garden from pest attacks, weeds, giving it fertilizer so the plants grow as expected.

Abstract

This paper discusses the link between motivation and performance, and established what makes motivation to have a central role in getting high performances from employees in organizations. It was revealed from the review that there are several motivational theories used by employers at different situations when they want their employees to highly perform. As motivation is to influence employees to perform, hence; performance is the evaluation with respect to acknowledged tasks, objectives, goal line and rational anticipations linked with a role, occupation in an organization. This paper has looked at some of these theories that have been proven and accepted by the general public. They comprise Maslow’s hierarchy of needs, McGregor’s theories x and y, McClelland’s theory of learned needs, Alderfer’s ERG theory, Herzberg’s two-factor theory, Vroom’s expectancy theory and different types of motivation, such as intrinsic and extrinsic. It is evident from the literature reviewed that all theories were established on some experimentations or observations, as a result they are just written ends about a tested situation. Though circumstances can be comparable, they will perhaps by no means be the same. Also, studies have showed that highly motivated employees that are productive and innovative can lead the organization to success through the achievement of its desired results.

Abstract

The number of regulations regarding the age limit of a person said to be an adult in Indonesia actually creates legal uncertainty, because of the variety of these restrictions. Between the laws with one another it turns out to be mutually contradictory. Such a situation is certainly confusing for law enforcers such as judges to determine which laws will be chosen as the basis for deciding a case. One of the most interesting problems is the contradiction between Law No. 1 of 1974 concerning Marriage and Law No. 35 of 2014 concerning Amendments to Law No. 23 of 2002 concerning Child Protection. According to Law No. 1 of 1974, 16 years of age for women are able to get married, while in Law No. 35 of 2004, the age of 16 is still said to be a child. The existence of these contradictions shows that legal inconsistency has resulted in legal uncertainty.
