Abstract

The legal policy of recognition of indigenous peoples as outlined by the 1945 Constitution requires the government to make customary law a source and inspiration in the development of national law. In the field of private law such as land and inheritance law, customary law has been elaborated a lot into national law. However, constitutional customary law is still not elaborated so that it often seems that it does not make a good contribution to the development of constitutional law in Indonesia. Based on research it is known that constitutional customary law is a formal source of constitutional law that hierarchically falls under the constitutional law act. In fact, some constitutional customary laws have been adopted in positive constitutional law, such as the provisions regarding the indigenous legal alliance, and the concept of the president as the holder of power over the army.

Abstract

Sendi's customary law is unique in the implementation of customary justice, namely using the Kutaramanawa Dharmasastra Book and using four local officials of Sendi's customary law, namely: Cakrabuana, Adat Attorney, Pamengku, and Kasepuhan. This uniqueness is also manifested in the decision of the Sendi customary court, which should have been used as consideration for judges in court to explore the living law of the Sendi indigenous people. This research is normative legal research using a statutory approach and a conceptual approach. Primary legal materials consist of the 1945 Constitution of the Republic of Indonesia, court decisions, and laws related to customary law, then secondary legal materials consist of journal articles, books, and websites related to customary law, Sendi's customary court, as well as the concept of constitutional culture and The constitutional state of Pancasila, then non-legal materials consist of books and non-legal journal articles which support this research, such as about indigenous peoples, culture, and Pancasila. The legal issue in this research is the absence of law at the level of a law that specifically regulates indigenous peoples. The results of this study indicate that an inventory of the decisions of Sendi's customary court is necessary to internalize and externalize the values of Sendi's customary law and are needed to strengthen aspects of the constitutional culture in the constitutional state of Pancasila.

Abstract

The protection of indigenous peoples' rights conflicts with national law. This can be seen from the specifications of the Minerba Law which leave an important point for protecting the rights of indigenous peoples compared to their participation, such as the environmental impacts of mining activities. The Minerba Law is considered to have taken the space of indigenous peoples. The method used in this writing is juridical-normative. The recommendation of this research is the Bill on Customary Law Communities should be passed immediately since obtaining actual data from the territories and indigenous peoples regarding the protection of traditional rights. In addition, the government must also make implementing regulations starting from the central level to the regional level.

Abstract

The conflict between the Indigenous Law Community (ILC) of Laman Kinipan with PT Sawit Mandiri Lestari (SML) regarding Kinipan customary forest clearing into oil palm plantations is still prolonged to this day. The recognition of customary law communities is also still a matter of debate due to the unclear and overlapping national legal systems. It leads to low legal protection for indigenous people, which is likely to injure indigenous peoples' constitutional rights as Indonesian citizens, one of which is the conflict that befell the ILC of Laman Kinipan. The government's action in the conflict case between the ILC of Laman Kinipan and PT SML was deemed not oriented in terms of good governance and violated the human rights of MHA Laman Kinipan.

Abstract

Madurese tend to use Carok in dispute resolution. According to the Madurese community, the Carok route is the fulfillment of a sense of justice. The disputes that were resolved in Carok took the form of adultery, insult, and revenge. The practice of Carok itself is carried out by fighting between Madurese men using sickle weapons. This paper describes the value of justice according to the Madurese community, steps to prevent Carok violence, and reconceptualization of the Carok culture itself. In addition, at the end of this paper will provide a comparison with other cultures, namely, sigajeng laleng lipa which has similarities to the Carok culture to provide a reinterpretation of the Carok culture with the aim of reducing retaliation or revenge.
