Abstract

Children born out of wedlock frequently face discrimination in the recognition of their inheritance rights. Despite the Constitutional Court Decision No. 46/PUU-VIII/2010, the implementation of the law and prevailing social stigma continue to obstruct their access to equal inheritance rights. The Certificate of Inheritance can serve to strengthen the legal standing of children born out of wedlock. However, further inclusive legal reforms within the Civil Code, along with efforts to raise public awareness, are essential to ensure that children born out of wedlock can obtain their rights fairly.

Abstract

The minimum age limit for marriage for both men and women is 19 (nineteen) years. However, under certain conditions, a person who has not met this age limit may apply for dispensation to marry. This study aims to analyze the process of filing an application for dispensation of marriage at the Jombang District Court and the reasons that form the basis for the Judge's decision. Based on PERMA Number 5 of 2019, marriage dispensation is granted by considering the best interests of the child. This study explains the procedure for applying for marriage dispensation at the Jombang District Court, which is carried out in several administrative stages until the trial, with the Judge's determination based on urgent reasons and sufficient evidence.

Abstract

Marriage without official registration in Indonesia causes legal conflicts, particularly regarding property ownership and joint assets. The unclear legal status of couples in unregistered marriages complicates the resolution of property disputes in court. This study examines the legal implications of unregistered marriages and the impact of digitalization on resolving property disputes. The results indicate that digitalization can expedite marriage registration and dispute resolution processes, although challenges in regulation and accessibility remain. Legal reform regulating unregistered marriages and the integration of technology are necessary to enhance justice in Indonesia's family law system.

Abstract

The purpose of this study is to analyze and explain the practice of polygamy in Indonesia. Analyze polygamy, according to the views of non-Muslim women, especially in the Batak tribe. Examine how polygamy began. The research methodology used in this study is qualitative. Based on the results of the study and discussion of the practice of polygamy in Medan City from the perspective of non-Muslim Batak women, it can be concluded that polygamy is still a complex and controversial phenomenon in society. Polygamy can have significant emotional, financial, and social impacts on the women involved.

Abstract

Child adoption is a crucial aspect of Indonesia’s family law, offering a solution for couples unable to have children while ensuring protection and welfare for adopted children. Although regulated by various laws, adoption practices still face challenges—particularly in cases of annulment due to conflicts between adoptive parents and adopted children. However, no specific regulation governs the annulment process, creating legal uncertainty. This study uses a normative juridical method to analyze the legal aspects of adoption annulment in Indonesia, referencing cases such as Decision No. 31/Pdt.G/2022/PN.Njk. The findings show that judges base decisions on the best interests of the child. In this case, the annulment occurred when the child chose to return to biological parents, ending the civil relationship with the adoptive parents and restoring parental rights. The case highlights the urgent need for clearer regulations on adoption annulment.

Abstract

Child marriage in Indonesia is a serious issue, causing negative impacts such as maternal and infant mortality, school dropout, and limited economic opportunities. Child marriage may be forbidden if it causes harm, in line with Maqashid Syariah. This study analyzes changes in fatwas on marriage age, causes of child marriage, and fatwa effectiveness. Using a qualitative method through literature review, it finds that the change is reflected in Law No. 16 of 2019. However, implementation faces obstacles like patriarchal culture, low education, and economic pressure, requiring collaboration culture, poor educational attainment, and economic constraints.

Abstract

Requests for polygamy permits on the grounds of biological needs have caused debate in religious court practice. This research examines the ratio decidendi of the judge in Decision Number 1671/Pdt.G/2022/PA.Sda which rejected the application. The method used is normative legal research with a statutory approach and a case approach. The results indicated that the judge interpreted the reasons for polygamy strictly and did not include biological needs as a valid reason according to the law. This research suggests the need for technical guidelines from the Supreme Court so that legal interpretation is more consistent and does not harm women's rights.

Abstract

People with disabilities or the term often heard as people with disabilities is as in accordance with the main points in the contents of the Convention on The Rights of Persons with Disabilities (CPRD) which has been ratified in Law Number 19 of 2019 where the term for those who have limitations, whether physical, mental, sensory or intellectual, with a long period of time in carrying out their daily lives, find obstacles in participating and efficient fulfillment of rights in equality. Therefore, the role of awareness of the surrounding community, such as parents, relatives or neighbors around the environment, is very much needed as figures who support, protect, and help people with disabilities in carrying out their daily lives. In addition, the role of the government is also equally important in providing protection for people with disabilities as a whole

Abstract

Marriage is an important thing in Islam which is regulated by strict legal principles. However, in practice, there are several traditions that involve repeated marriage contracts such as those carried out when there is a problem in the family that occurs continuously, such as there is something strange in the hearts of each partner then repeating the contract or renewing the marriage with the same partner without divorce. The formulation of the problem that occurs in this study is, how is the practice of the tradition of repeated marriage contracts? And what is the view of Islamic law on the tradition of repeated marriage contracts? This research method uses a field research method with this research being descriptive qualitative with primary data sources (obtained directly from the field) and secondary data (books, journals, etc.) and data collection methods, namely by observation, interviews and documentation. while data analysis is carried out qualitatively with an inductive thinking method. The results of this study conclude that the tradition of repeated marriage contracts is a common practice in society. This practice is carried out as an effort to renew the bonds of marriage with the aim of maintaining harmony and the integrity of the household. The process of repeated marriage contracts involves several elements such as the groom, bride, dowry, guardian nashab, witnesses, and the pronunciation of ijab and qabul. Although it does not require an official record from the KUA, the process still follows the rules that have been determined. The views of Islamic law regarding this matter are divided into two, some allow it as long as it is to maintain family harmony because maintaining family harmony is an obligation. Some prohibit it because it is considered that the second contract is considered to cancel the first contract.

Abstract

Sexual violence against women is one of the issues that should be a concern in Indonesia. It is characterized by a high number of cases of sexual violence against women. One form of injustice that often occurs is the practice of forced marriage between rape victims and perpetrators who are often justified in the name of “restorative justice”. In fact, this practice is contrary to the principles of human rights (HR), positive law, as well as the basic values of restorative justice itself. This study uses normative juridical methods to examine the practice of forced marriage between perpetrators and victims of sexual violence cases based on the perspective of human rights and gender as well as the principles of restorative justice. The results showed that the forced marriage of victims with perpetrators is an advanced form of gender-based violence that injures women's rights and reduces the meaning of Justice. The state needs to ensure that the application of restorative justice is not mistaken for the legitimacy of a “peaceful” settlement that actually harms victims. Therefore, strengthening the understanding of law enforcement officers, strict supervision, as well as legal protection in favor of the victim is an urgency that cannot be ignored.
