Abstract

ABSTRAKReformasi yang sudah berlangsung 16 tahun masih belum bisa memberikan sebuah rasa keadilan dalam hukum bagi masyarakat. Rekam jejak penegakan hukum masih saja diwarnai dengan kekuasaan. Ketidakpercayaan masyrakat akan penegakan hukum menjadikan sebuah precedent buruk bagi penyelenggaraan Negara Hukum di Indonesia. Beberapa isu pokok dalam penegakan hukum menjadikan pukulan keras yang terus diarahkan kepada penegak hukum itu sendiri. menurunnya kewibaan lembaga yudikatif dengan adanya ketimpangan putusan yang mengabaikan rasa keadilan itu sendiri bagi masyrakat. Moralitas penegakann hukum haruslah bisa menjadi landasan kuat dalam penegakan hukum di Indonesia. tidaklah mudah dalam peencapaian keadilan dan tujuan hukum itu sendiri, ketika masyrakat yang sudah meningkat kesadaraanya tidak ditunjang dengan pengingkatan kualitas bagi para penegak hukumnya sendiri.Kata Kunci : Reformasi Hukum, Penegak Hukum dan Penegakan Hukum dan Keadilan

Abstract

AbstractOne of the agreements reached by the Agreement Establishing the World Trade Organization (WTO) is the Agreement on Aspects of Intellectual Property Rights Related Trade (TRIPS ). Through TRIPS developed countries calls for setting the protection and enforcement of protection of intellectual property rights. The purpose of this research was to determine the nature of the public interest in the protection of Copyright and whether the public interest is a major cornerstone in the protection of Copyright. The research method used is the method of normative, descriptive and to determine public interest in the protection of rights Cipta.This study stated that the provisions of the Berne Convention, TRIPS, and the Copyright Act of each state normatively recognize and protect the public interest Copyright protection, but today there are efforts to suppress public interest in the protection of intellectual property rights by means of the developed countries require strict protection standard, a standard known as "TRIPS plus" through agreements of investment, trade, and treati- treati, WIPO, which in turn put pressure on developing countries.Keywords: Public Interest, TRIPs, Copyright Protection
