Abstract

Child adoption in Indonesia is governed by two main legal systems, namely positive law and Islamic law, which have different legal principles and consequences. In positive law, child adoption must go through the courts as stipulated in Article 1 Paragraph 9 of the Child Protection Law No. 23 of 2002, to provide legal protection and certainty of rights for both adopted children and adoptive parents. Meanwhile, Islamic law does not recognise a nasab relationship between the adopted child and the adoptive parents. Adopted children do not have inheritance rights from adoptive parents and remain connected to their biological lineage. The practice of adoption without a court order has various adverse legal implications. In the perspective of positive law, the absence of legal ratification can eliminate the rights and obligations between the adopted child and the adoptive parents, as stated in Article 45 Paragraph (1) and Article 46 Paragraphs (1 and 2) of Law Number 1 Year 1974. This also has the potential to trigger legal disputes that cannot be resolved formally. This research uses a qualitative method based on literature review with a focus on analysing the regulation and concept of adoption according to both legal perspectives. The results show that adopting a child without going through a court process not only violates positive legal rules but also has the potential to ignore the principles of Islamic law related to child welfare and justice. Therefore, it is important for the community to understand the applicable legal rules so that adoption can be carried out correctly and in accordance with applicable legal provisions.

Abstract

This study aimed to evaluate the effectiveness of school-based health education intervention in improving students' knowledge about diabetes. The research subjects were 5th and 6th grade students at SD Negeri No. 106172 Pancur Batu Tuntungan 2, with a total sample size of 47 people. The study used a quantitative descriptive design with a pre-test and post-test approach. Data were collected using a questionnaire covering the definition, symptoms, causes, and prevention of diabetes, and analyzed by descriptive statistics. The results showed a significant increase in the average score of students' knowledge from 63.93 in the pre-test to 85.62 in the post-test. This finding suggests that a school-based health education program can significantly improve students' health literacy. This intervention makes an important contribution in building students' awareness of chronic diseases, particularly diabetes. Although this study has limitations, such as the limited sample size and short duration of the study, the results provide a strong basis for the development of sustainable health education programs at the primary school level. It is recommended that future studies include a wider sample and utilize technology to support more interactive delivery.

The purpose of this study is to examine sharia maqashid and women's reproductive rights in the childfree phenomenon. The decision to be childfree raises a negative stigma from society. Childfree as a view regarding the decision that a married coupe wil choose not to have children in their home life. This concerns women's reproductive rights. The type and method of research that the author uses is a library research model with a qualitative approach. The results showed that having offspring is not an obigation but a right that can be chosen or abandoned with ful consideration and a sense of responsibility. And women's reproductive rights to the childfree paradigm are basicaly the right to freedom in determining what is the choice in life. In terms of Isamic law, the absence of a sharih nash or expressy prohibiting the practice of 'az that substantialy has similarities with Childfree shows that the act of Childfree is not prohibited by Shari'a. While in the maqashid view, the action of Childfree can manifest in various aspects, the proposal of al-khamsah depends on the ilat (factors) that drive a person to make a decision as a folower of Childfree
