Abstract

Law No. 1 of 1974 concerning Marriage in Article 2 paragraph (1): Marriage is legal if it is carried out according to the law of each religion and belief. Means the Marriage Law No. 1 of 1974 has not yet confirmed the regulation of interfaith marriages. The tendency to close, make it difficult, or obscure the implementation of community aspirations for interfaith marriage is considered by some to be contrary to the Marriage Law No. 1 of 1974. In Article 6 paragraph (1) of the Marriage Law no. 1 of 1974 states "Marriage is based on the agreement of the two prospective brides" The firmness which states that the basis of marriage is the agreement of the bride and groom, can be interpreted as a form of respect for Human Rights (HAM) based on human dignity. The author uses a normative juridical approach, because of his approach, this model of legal research is called normative legal research.

Abstract

In Article 33 paragraph 3 of the 1945 Constitution of the Republic of Indonesia it is stated that; "The water and natural resources contained therein shall be controlled by the State and used as much as possible for the prosperity of the people". This article clearly regulates the relationship between the State and, land, earth, water and natural resources contained therein are controlled by the State, with the aim of the welfare of its people. Thus, the task of the State of Indonesia is not merely to provide legal protection, legal certainty and besides that there is a more fundamental task, namely to utilize all land and natural resources contained therein for the greatest prosperity of the people. The birth of Law No. 5 of 1960 concerning Agrarian Principles (hereinafter referred to as UUPA) is an instrument to create prosperity and justice for all spilled Indonesians. This law was born to abolish all laws and regulations which for nearly 350 years had carried out massive exploitation of the land and natural resources contained therein.

Abstract

The supervisory function is the most important thing in the creation of good governance, because it will narrow the space for disgraceful acts, the frequency of disgraceful government actions often occurs in free government, while free government is identical to the implementation of regional autonomy, where the granting of authority and discretion is given to the regions to manage and utilize regional resources optimally for the welfare of the people. In an era of democracy and decentralization like this, it provides space and a bigger role for DPRDs to become partners of the government in the process of democratic governance.

Abstract

This study uses an empirical legal research method using a social interaction approach in order to determine the role of BUMDes Tridaya Mandiri in helping to increase economic growth in Bhuana Jaya Village, located in Tenggarong Seberang District, Kutai Kartanegara Regency, East Kalimantan Province. Sources of data used in this study use primary data sources and secondary data sources. The collection technique used in this research is observation, document study, literature study and interviews. Data analysis used qualitative analysis which presented descriptively. The description based on the results of this research is BUMDesa Tridaya Mandiri is a business entity that was established in 2017, The establishment of this business entity is due to seeing the potential for business and/or work opportunities in the village of Bhuana Jaya. BUMDes Tridaya Mandiri has work units covering, among others, an economic unit, a basic social service unit, an agricultural and livestock unit, a UMKM unit, a community empowerment unit, a socio-cultural and tourism unit, and an energy unit. The increasing economic growth of Bhuana Jaya Village is currently very pronounced where the increase in PAD generated from BUMDes Tridaya Mandiri.
