Modern international law in the last few decades has experienced very rapid development, this is characterized by the emerge of the State in a modern sense, as well as a legal system that regulates relations between countries and international legal entities with each other. Relations between countries are no longer limited by absolute sovereignty, for example in the case of war crimes, the international community could sue countries or even individuals to be responsible for these actions based on universal principles. Recently, State practices is shifting from the hard law legal system to soft law which can be an alternative solution in breaking the deadlock when international political compromises are difficult to realize. Various international law development shows that there is a need for the international community to form a legal system that is acceptable to all parties, especially the State as a subject of international law par excellence. Therefore, the Belli ac Pacis Journal presents the multifarious developments in contemporary international law as a study of current State practices. The Belli ac Pacis Journal encompasses Public International Law, International Law of the Sea, International Humanitarian Law, International Environmental Law, International Criminal Law, International Organizational Law, International Dispute Settlement Law, Diplomatic Law, Air and Space Law, International Trade Organization Law, ASEAN Law, and International Economic Law.

Abstract

This article describes and examines the problem of how to fulfill hors de combat rights in armed conflict with the case study of Muammar Khadafi’s human rights violations as hors de combat. Methodology and research used are normative research methods that have the same definition as doctrinal research, namely research based on legal materials whose focus is on reading and studying primary and secondary legal materials. Based on the results of the study, the authors concluded that the rights of Muammar Gaddafi as Hors de Combat were not fulfilled in accordance with International Humanitarian Law. This is because it violates the provisions contained in the Geneva Conventions of 1949 concerning the treatment of sick and injured combatants, and Additional Protocol I 1977 because in this case Muammar Khadafi is a person who has legitimate hors de combat status.

Abstract

Ada sekitar 13.000 pengungsi dan pencari suaka di Indonesia meskipun Indonesia belum menjadi peserta Konvensi 1951 yang terkait dengan Keadaan Pengungsi (Konvensi Pengungsi) atau Protokol 1967. Meskipun bukan negara peratifikasi Konvensi Pengungsi 1951, tetapi Indonesia meratifikasi The United Nations Convention on The Right of Childs 1989 yang membuat Indonesia memiliki kewajiban untuk memenuhi hak-hak pencari suaka dan pengungsi anak. Salah satu hak yang wajib di penuhi adalah hak pendidikan anak. Tujuan penelitian ini adalah untuk menganalisis pemenuhan hak pendidikan anak bagi pencari suaka anak di Indonesia sembari menunggu status pengungsi. Penulisan hukum ini termasuk penelitian hukum normatif-empiris bersifat deskriptif. Jenis pendekatan yang digunakan adalah pendekatan perundang-undangan dan pendekatan kualitatif. Bahan hukum penelitian ini mencakup bahan hukum primer dan sekunder dengan menggunakan teknik pengamatan atau observasi dan wawancara atau interview. Teknik analisis menggunakan metode analisis data kualitatif dengan model interaktif. Hasil penelitian menunjukkan bahwa pemenuhan hak pendidikan bagi pencari suaka anak sudah dipenuhi oleh rumah detensi imigrasi yang menampung para pencari suaka anak tersebut.Keywords:

Abstract

This paper describes and examines the handling of international refugees within the framework of implementing Sustainable Development Goals (TPB) in Indonesia. The research in this paper is a normative research using a conceptual approach to the principles of international law and human rights law, as well as the statute approach to the Republic of Indonesia Presidential Regulation No. 125 of 2016 concerning Refugee Handling from Abroad and Presidential Regulation No. 59 of 2017 concerning Implementation Achievement of Sustainable Development Goals (TPB). Indonesia as a transit country does not ratify the 1951 Convention on the Status of Refugees and the 1967 Protocol on Refugee Status. The results of the study show that even though it has not been done optimally, humanitarian response to Indonesian foreign policy towards international refugees is a form of Indonesia’s attachment to the moral of human rights and the principles of international law. Thus, this humanitarian response is a justification for the handling of international refugees within the framework of implementing Sustainable Development Goals (TPB) in Indonesia.Keywords:

Abstract

 This study discusses the actions of the Indonesian Government updating maps in the North NatunaSea Area to make Indonesia a Global Maritime Axis. This study is based on legal research using the legal approach and case approach. Collection of legal materials through library studies and analyzed by deductive methods. The results of the discussion showed that updating maps in the North Natuna Sea could make Indonesia a Global Maritime Axis in terms of Defense, Security, Law Enforcement and Safety at Sea and Maritime Diplomacy based on Indonesian Maritime Policy in accordance with United Nations on The Law of The Sea 1982 ( UNCLOS 1982).

Abstract

This research aims at two things. First, describes and analyzes the legal standing of Private Military and Security Company (PMSC) in International Humanitarian Law. Second, analyzes the responsibility mechanism for Private Military and Security Company (PMSC) personnel. This research is normative legal research viewed from applied prescriptive. The legal material used by this research include primary and secondary legal material. The legal material was collected by library research and analyzed by deductive methods. The results show that PMSC cannot be equated with mercenaries as regulated in Article 47 Additional Protocol I Geneva Convention 1977. According to Montreux Document, the legal standing of PMSC will depend on the signed contract. Montreux Document provisions explain that PMSCs status can be civilians, members accompanying armed forces, and illegal combatants. The coercive services responsibility conducted by PMSC personnel will also depend on the agreement made by the parties. PMSC personnel will be individually responsible when the conduct is not representing the contracting subject.
