Abstract

The Regional Election Commission has the responsibility to increase the participation of disabled voters in local legislative elections. Democratic elections at the local level are characterized by the enthusiasm of disability voters in the election. The purpose of this paper is to map out legislation on the protection and respect of disability voters, to explore some of the constraints facing electoral voters in the election, and to examine the policies and obstacles faced by the The Regional Election Commission in an effort to increase voter participation in disability. This study uses socio-legal research methods, ie research that is interdisciplinary to provide a meeting room between the science of law and the sciences outside the law. The results show that, there are international law and national laws. Barriers facing disability voters include: theoretically there is no uniformity about the disability study; the culture of the people who tend to stigmatize the bad, not counting the right to vote; lack of accurate data of disability voters. The policies made by the The Regional Election Commission in increasing the participation of disability voters are: to implement Article 1 number 25 and Article 149 of Law No. 8 of 2012 on General Election of Members of DPR, DPD and DPRD. While the obstacles, namely: the weakness of family and community awareness; lack of human resources capacity of voter registration officers and data on the List of Potential Voters of Electoral Residents (DP4) does not mention information about disability.

Abstract

This article focuses on the factors triggering the Mesuji conflict and the similar cases happening in Indonesia. In addition, this paper seeks to find the available settlement alternatives which can be used to solve the conflict. The study will take a long, hard look on state practices (South Africa and India) concerning on the settlement of the economic and social (socio-economic) rights. The conclusion drawn is that a conflict involving society’s rights and interests should be solved in a comprehensive way. It cannot be solved only by litigation or non-litigation procedures. The Government should establish a policy concerning the regulation on the land expropriation. Also the government should monitor the implementation of the regulation in order to prevent from the abuses carried out by third parties (companies). Thus, the government will protect the socio-economic rights of the society

Abstract

AbstractThis research aims to determine the jurisdiction concerning piracy on the high seas by international law. This research is a legal research with prescriptive characteristic use a statute approach and conceptual approach. The legal sources used are primary and secondary materials later are analyzed by a deductive method and legal interpretation. The results show that there has been international law rules which can be used as the basis for all states to apply their jurisdiction to the piracy. These rules are the convention on the high Seas 1958 (chS 1958), United Nations convention on the Law of the Sea 1982 (UNcLOS 1982), and the convention for the Suppression of Unlawful Acts Against the Safety of Maritime Navigation 1988 (SUA 1988). Instead of these international rules, some codes and guidances concerning combating piracy are also concluded by international organizations.Keywords : International Jurisdiction, Piracy, Law of The SeaAbstrakPenelitian ini bertujuan untuk mengetahui penerapan yurisdiksi terhadap perompakan di laut lepas menurut hukum internasional. Penelitian ini merupakan penelitian hukum yang bersifat preskriptif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder yang selanjutnya dianalisis secara deduktif dan menggunakan interpretasi hukum. Abstract

AbstractThis study discusses alternative resolutions on maritime boundary dispute between Indonesia and Malay- sia. It was based on a legal research, which used statutes and case approach. The research materials were collected by literature study and analyzed by applying the interpretation analysis technique.The result shows that the alternative resolutions of Indonesia-Malaysia border dispute can be carried out through several mechanisms. First, by referring to the UNCLOS 1982, through Bilateral Mutual Agreement on drawing an equidistant line using the equity principle and considering relevant circumstances. Second, by means of ASEAN; and third, by means of International Court of Justice mechanism regarding the equitable principle and relevant circumstances.Keywords: the outermost islands, border management, maritime dispute settlement, archipelagic state ABSTRAKPenelitian ini membahas alternatif penyelesaian sengketa batas maritim antara Indonesia dan Malaysia. Kajian ini berdasarkan penelitian hukum dengan menggunakan pendekatan undang-undang dan pendekatan kasus. Pengumpulan bahan hukum melalui studi kepustakaan dan dianalisis dengan teknik analisis interpretasi hukum. Hasil pembahasan menunjukkan alternatif penyelesaian sengketa batas wilayah Indonesia-Malaysia dapat dilakukan dengan beberapa cara. Pertama, mengacu pada UNCLOS 1982 melalui Bilateral Mutual Agree- ment dalam menarik garis sementara yang menggunakan prinsip sama jarak dan mempertimbangkan faktor yang relevan, kedua,  melalui mekanisme ASEAN, dan ketiga, melalui mekanisme Mahkamah Internasional dengan mengedepankan equitable principle dan relevant circumstances.Kata kunci : Pulau-pulau terluar, pengelolaan batas wilayah, penyelesaian sengketa maritim, negara kepulauan

Abstract

Penelitian hukum ini bertujuan untuk menganalisa implementasi pembatasan penggunaan senjata pada perang laut dengan mengkomparasi hukum Humaniter Internasional dengan hukum Perang Islam. Perkembangan teknologi militer yang berkembang saat ini dan eskalasi konflik bersenjata yang meningkat di wilayah perairan saat ini telah melampaui hukum humaniter internasional saat ini. Maka perlu peninjauan kembali serta pembentukan hukum humaniter baru yang mana sanggup menghadapi konflik laut di masa yang akan datang.

Abstract

International refugees phenomena gives birth to new problems to solve for national and international law like Geneva Convention 1951 or New York Protocol 1967 about refugee status, the handling of of international refugees, and the fullfilment and violation of their basic human rights. Indonesia is one of many the countries that declined to sign the Jenewa Convension and lack the nececery law to deal with international refugees that decide to come to the country. This lack of laws open up a loop hole that may cause the basic human right of international refugees to be violated. One of that right that may be violated is the right for international refugee’s kids who’s born in Indonesia to get Indonesian citizenship. This research will mainly talk about the problems regarding the citizenship of international refugee’s kids who’s bron in Indonesia. In addition it will also talk about international and national law in the spirit of solving the citizenship problem. Last but not least, this paper will also explain the condition of the stateless person that does not have their basic right granted in political commuties or a country. The right to citizenship is very crucial to fulfill human’s basic right and other rights that comes with citizenship. This is what Hannah Arendt called as the right to have right.

Abstract

This research aims at two things. First, describes and analyzes the legal standing of Private Military and Security Company (PMSC) in International Humanitarian Law. Second, analyzes the responsibility mechanism for Private Military and Security Company (PMSC) personnel. This research is normative legal research viewed from applied prescriptive. The legal material used by this research include primary and secondary legal material. The legal material was collected by library research and analyzed by deductive methods. The results show that PMSC cannot be equated with mercenaries as regulated in Article 47 Additional Protocol I Geneva Convention 1977. According to Montreux Document, the legal standing of PMSC will depend on the signed contract. Montreux Document provisions explain that PMSCs status can be civilians, members accompanying armed forces, and illegal combatants. The coercive services responsibility conducted by PMSC personnel will also depend on the agreement made by the parties. PMSC personnel will be individually responsible when the conduct is not representing the contracting subject.

Abstract

This legal research examines the urgency of Indonesia to ratify the 1951 Convention Relating to the Status of the Refugees and the 1967 New York Protocol on international refugees. Because in Indonesia there is no regulation that can be submitted reference or reference to be able to handle the refugee problem properly and optimally. Given Indonesia’s strategic geographic location for refugees, Indonesia has not ratified the 1951 Protocol to the Status of the Refugees and the 1967 New York Protocol on international refugees, which are modern international refugee law instruments. Both Conventions are also a form of global human rights concern for international refugees. The research used is descriptive normative research through approach of legislation (statue approach). Techniques of collecting legal materials used are literature studies related through print media or internet media. The technique of legal material analysis uses a method of deduction which departs from a general proportion whose truth has been recognized and ends at a more specific conclusion. Based on research and discussion, it can be seen that Indonesia needs a legal instrument that can be used as a reference in overcoming the problem of international refugees optimally. The legal instrument in question is the 1951 Protocol to the Status of the Refugees and the 1967 New York Protocol on international refugees. By ratifying the two instruments of international law, Indonesia will have a legal instrument that can be used as a reference in optimizing the international refugee problem and play a role in international human rights concerns, especially for international refugees.

Abstract

This article analyzes the use of scorched earth policy, and an indication of crimes against humanity which are commited by Military Junta of Myanmar against Rohingya tribes based on International Humanitarian Law. This article uses normative research methods, namely research based on legal materials which its focus is conducted by studying primary and secondary legal materials. Based on the study, the author concludes that Military Junta of Myanmar brutally and sadistically commited scorched earth tactic in order to sweep away Rohingya ethnics from its territory. Though Military Junta did commit the scorch earth tactis, there is an indication that Military Junta of Myanmar also commited crime against humanity along with the scorched earth, such as deportation or forced eviction, rape and forced pregnancy, and systematic massive killing. These acts explicitly violate Additional Protocol I of the 1977 Geneva Convention and the Rome Statute of 1998.

Abstract

This research examined Covid-19 from the perspective of legal and health protection by regional governments. Generally, regional governments are at the front line in protecting communities in this autonomy era due to their constitutional obligations. Data also shows that the creative economy actors in the micro, small, and medium business sector constitute over 90% of the workforce, necessitating their protection. This research used empirical-juridical research with an interdisciplinary approach examined the legislation and the community's reality. A Focus Group Discussion (FGD) was conducted with relevant stakeholders and creative economy business actors in Surakarta, Bandung, and Madiun cities. Furthermore, concepts of legal, health, and economic theories were reviewed to formulate a regional government policy draft regarding these business actors during the Covid-19 emergency. The results showed an existing form of legal protection regulation related to health and the economy at the national level. However, three big cities (Bandung, Madiun, and Surakarta) representing three provinces  as research objects are yet to provide regional regulations concerning protection for creative economy actors, though the local government has encouraged an increase in their activities
