AL-MANAHIJ is a scholarly journal of Islamic law studies. It is a forum for debate for scholars and professionals concerned with Islamic Laws and legal cultures of Muslim Worlds. It aims for recognition as a leading medium for a scholarly and professional discourse of Islamic laws. Al-Manahij covers textual and fieldwork studies of Islamic laws with various perspectives. The journal is published twice a year (every June and December), and each publication contains ten articles in the field of Islamic law, therefore in a year, the journal publishes twenty articles. The journal presents qualified scholarly articles, which always place Islamic law in the central focus of academic inquiry. This journal is a forum for debate for scholars and professionals concerned with Islamic law and Islamic legal cultures within local and challenging global contexts. The journal invites any comprehensive observation of Islamic law as a system of norms in Muslim society. The journal has become a medium of diffusion and exchange of ideas and research findings, so much so that researchers, writers, and readers have interacted in a scholarly manner.

Abstract

Universal Declaration of Human Rights (UDHR) 1984 is a moral document that realizes the principles of United Nation charter as a measurement standard which is admitted for identifying rights and many kinds of freedom. In Islam's point in view, human rights have been explained since 14 centuries ago in Madinah charter and in Al Qur’an as well. Human rights in both western and Islam perspective admit individual rights which are legally guaranteed by the nation. However, there are differences and those are explained in the Cairo Declaration of Human Rights in Islam (CDHRI).

Abstract

Islam and democration are twoconcepts from the different culture entity. So when they are together they made a kind of trouble. It posibbly leads to a confict since they are confronted diametrically. Although it can be compromised substantially since there is a shura concept.

Abstract

Islamic ideology is the interpretation of Moslems to the Holy Qur’an. One of the interpretation potentially causes some endless controversy. Polygamy discourse arouse because of the different frame and it implies to the different understanding. Hermeunetic frame as an alternative solution, emphasize to the language grammatical and historical dialect about the polygamy law understanding.

Abstract

The rule on dividing joint property and wealth between a husband and a wife is based on the customary law (‘urf) which divides half of those wealth for each. This rule is also determined in UU No 1/1974 (Code of Mariage). Actually, ‘urf is only a kind of consideration in defining the law and that should not be opposed to any rules.

Abstract

Mallpractice is a medical treatment that includes doing something forbidden in caring patients or did not doing the thing that bad to be done or neglecting the duty by did not diagnose property and gave a standardized medicine. Islamic law gives diyat as a sanction for those who did a malpractice.

Abstract

In Indonesia, Islamic (Shariah) banking discourse came up in 80's decade, followedby other Islamic finance institutions in 90's and 2000's. Most of them are still oriented to the finance sector and only a few of them which pay attention to the real sector. In fact those two factors could be tied together to face the future.

Abstract

BMT as a micro finance institution faces some obstacles, not only internal but also external in condusive condition. Those obstacles are ranged in some institution aspects and they causes a variety of LKM , restricted law framing, lack of rules, lack of guidance and supervision, different status since this institution is not integrated yet to the formal finance institution, and there is not any ‘buffer’ or a guarantee of saving. Those show a weak protection for BMT customers.
