AL-MANAHIJ is a scholarly journal of Islamic law studies. It is a forum for debate for scholars and professionals concerned with Islamic Laws and legal cultures of Muslim Worlds. It aims for recognition as a leading medium for a scholarly and professional discourse of Islamic laws. Al-Manahij covers textual and fieldwork studies of Islamic laws with various perspectives. The journal is published twice a year (every June and December), and each publication contains ten articles in the field of Islamic law, therefore in a year, the journal publishes twenty articles. The journal presents qualified scholarly articles, which always place Islamic law in the central focus of academic inquiry. This journal is a forum for debate for scholars and professionals concerned with Islamic law and Islamic legal cultures within local and challenging global contexts. The journal invites any comprehensive observation of Islamic law as a system of norms in Muslim society. The journal has become a medium of diffusion and exchange of ideas and research findings, so much so that researchers, writers, and readers have interacted in a scholarly manner.

Abstract

The important point in Islamic law is justice and punishment. This principal is the reference in deciding an Islamic law. The execution of d{aru>rah in Islamic law is natural because its priorities the ease and avoiding difficulties. D{aru>rah has some meanings. Al-Jas}s}a>s stated as the fear of the damage of soul and body. D{aru>rah is something which is related to the big problems which need ease (mashaqqah).

Abstract

Abdullahi Ahmed An-Na'im tried to confront the secularism and fundamentalism. He used naskh to pay more attention on humanism, equity and freedom. Eventhough there are some weakness, he has made a great achievement in Islamic modernism to answer humans problems.

Abstract

This text compares among three methods in Usul al-Fiqh: Hanafiyah, Shafi'iyah, and tariqah al-jami'. Hanafiyah has some strengths such as rich of examples in furu', close with the reality and concise in discussion. The weakness of this method is it causes a kind of fantastic and rich of argumentation. Shafi'iyah method is too narrow in philosophical point of view and lack for examples. Tariqah al-jami' generally could overcome the weakness of those two methods above.

Abstract

The social fiqh by KH. Sahal Mahfudh discuss mainly in family problems. He develops a critical thinking in understanding the classical kitab. It is stated that it would be better for understanding the classical kitab with the proportional methods in order to get the contextualization and the appropriateness with the reality, especially in family cases.

UU no. 23 th. 2004 about domestic violence demolishing is intended to prevent the violence in domestic area. Based on Islamic syariah, the forbidding about violence to woman is already in line to the Islamic law.

Abstract

Reward and punishment are also discussed in Islamic law. If people don’t obey the God’s rules, they will not get what they want. On the other hand, human right is such as a formula which contains some freedom such as freedom of speech, express, to have religion, and freedom of fear of war. Islam itself already contains such human right.

Abstract

The application of derivative instruments have been broadly expanded. As a hedging instrument, it is now becomes so far as an investment instrument that traded in the market in massive volume. Major of Islamic scholars have found them to be objectionable based on the juridical nature of contractual arrangements. This paper explains the expanding function of contemporary derivatives and reviews the scholars legal point of view. This paper also defines the basic norms of Islamic financial ethics as the guidance for developing Islamic financial instrument. In the last section of this paper examines alternative for Islamic hedging based on salam and al-khiyar principles, which completed by syariah insurance.
