AL-MANAHIJ is a scholarly journal of Islamic law studies. It is a forum for debate for scholars and professionals concerned with Islamic Laws and legal cultures of Muslim Worlds. It aims for recognition as a leading medium for a scholarly and professional discourse of Islamic laws. Al-Manahij covers textual and fieldwork studies of Islamic laws with various perspectives. The journal is published twice a year (every June and December), and each publication contains ten articles in the field of Islamic law, therefore in a year, the journal publishes twenty articles. The journal presents qualified scholarly articles, which always place Islamic law in the central focus of academic inquiry. This journal is a forum for debate for scholars and professionals concerned with Islamic law and Islamic legal cultures within local and challenging global contexts. The journal invites any comprehensive observation of Islamic law as a system of norms in Muslim society. The journal has become a medium of diffusion and exchange of ideas and research findings, so much so that researchers, writers, and readers have interacted in a scholarly manner.

As one of the rights owned by the president, clemency is controlled by the Indonesian Constitution, UUD 1945. In Islamic law there is also a possibility to forgive one’s mistake in the name of justice and truthful.

Abstract

The study of violation toward intellectual property from the Islamic law perspective is not much. Meanwhile, it really needs protection from the laws itself. This paper begins its discussion with the protection of property in Islam, the importance of fiqh for intellectual property, defining the violation law toward intellectual property and the last point is about the violation from a fiqh perspective.

Abstract

Ciggarette industry in Indonesia has given much benefit to the country. Even our tobacco is classified as one the best tobacco in the world. However, from Islamic point of view it still becomes controverse. The benefit and the disadvantage of smoking, banning of smoking and analysis from MUI about smoking are discussed n this paper.

Abstract

Law enforcement in Indonesia which still based on the legal positivism model is suitable for the type of Indonesia law. The model emphasized legal rules based on legal justice, but it failed to make substantial justice. Therefore law enforcement in Indonesia must be switched to a new model of law enforcement to actualize substantial and responsive justice because the principal function of law attends to man not otherwise.
