Abstract

ABSTRACT The polemic of discrimination against women seems to be endlessly debated. The strong conservatism of discriminatory policies against women has led to the practice of identity politics in regulations, including law No.1/1974 on marriage. Since the existence of the Constitutional Court in 2003 until now, there have been two decisions that annulled the provisions of the marriage law due to eliminate and discriminate against the right of women. This study examines the gender equality lawsuits of women in the Constitutional Court decisions in various legal narratives in Indonesia. Based on the content analysis approach, the result of this study conclude that two decisions of the Constitutional Court No. 46./PUU-XIII/2010 and No. 22 / PUU-XV / 2017 has a significant impact on increasing the dignity and status of Indonesian women. An indication of this is the elimination of discrimination in the form of equal rights between men and women as an effort to reform family law in Indonesia with gender equity. Kuatnya konservatisme kebijakan yang diskriminatif terhadap perempuan menyuburkan praktik politik identitas dalam regulasi, termasuk dalam Undang-undang No. 1 tahun 1974 tentang perkawinan. Sejak keberadaan Mahkamah Konstitusi tahun 2003, sampai saat ini sudah dua putusan Lembaga Tinggi Negara tersebut yang menganulir ketetapan dalam pasal-pasal Undang-undang perkawinan karena terbukti bias gender dan menimbulkan diskriminasi bagi kaum perempuan. Artikel ini mengkaji gugatan kesetaraan gender dari kaum perempuan dalam putusan-putusan Mahkamah Konstitusi yang menggugat hak-hak diskriminatif dalam pelbagai narasi hukum di Indonesia. Dengan menggunakan analisis isi, studi ini menyimpulkan bahwa narasi yuridis Putusan Mahkamah Konstitutusi No. 46./PUU-XIII/2010 dan putusan No. 22/PUU-XV/2017 berdampak signifikan bagi peningkatan harkat dan martabat perempuan Indonesia. Indikasi dari hal tersebut adalah penghapusan bentuk diskriminasi berupa kesataraan hak antara laki-laki dan perempuan sebagai upaya pembaruan hukum keluarga di Indonesia yang berkeadilan gender. Abstract

Islamic fundamentalism is usually identified and associated with the Islamic radicalism movement. This Islamic fundamentalism doctrine and movement have prepared students to be their successors. Lampung University as the biggest university in Lampung cannot be separated as its target. This article attempts to investigate types of fundamentalism at Lampung University; the fundamentalism development at the university; and the responses of university and faculty members towards religious activities at the. This study was a result of qualitative research applying two data sources in the words of primary data source and secondary data source. The collecting data methods were documentation and interview. The interviews were intended to lecturer, staff, university activist, and student. The documentation was held by examining the literature correlated with religious practice. The collected data were analyzed by using content analysis. The analysis was conducted through plotting the study and practice of religion, and analyzing the pattern of the study, religion practice and the contextualization of within Islamic study of Indonesia. Based on the analysis, this study concluded that the right-leaning Islamic doctrine which usually called Islamic fundamentalism turning a finger to Lampung University was not oriented on radicalism movement. This movement developed seriously Islamic education. Fundamentalism at Lampung University, not only moved to the education sector (tarbiyah) but also came into political sectors (siyasah). Unfortunately, university lets them move, because of their active roles in Islamic education for students. Nevertheless, some groups responded to their movement by initiating to create a similar student unit, namely KMNU (the Family of Nahdatul Ulama Students). However, the existence of this organization has not given significant improvements towards religious practices and discourses at Lampung University.

Abstract

This article discusses Islamic legal thought of Abdurrahman Wahid. According to this article, Wahid’s fiqh used the contemporary knowledge system as a core paradigm. Wahid used a concept called Pribumisasi Islam to try to unify the cultures where Islam arrived and lived. He attempted to contextualize nash and issue in Indonesia using the pribumisasi Islam idea. Wahid’s fiqh did not modify the nash; rather, it refined and expanded its application, contextualized Islam, and harmonized it within the times to meet the needs of society. Wahid refused to formalize Islamic law in Indonesia in its application. Aside from historical reasons, he claimed that Islam has a universal component that has contributed to the development of human values. Formalizing Islamic law in a multicultural and pluralistic country goes against the universality of Islamic teaching. Furthermore, the formulation of Islamic law based on conventional sources is partially irrelevant in this day. Wahid tended to apply Islamic values to everyday life rather than displaying Islam through numerous symbols. Abstrak Artikel ini membahas pemikiran hukum Islam Abdurrahman Wahid. Penggalian terhadap pemikiran hukum Islam Wahid menemukan bahwa fikih Wahid menggunakan sistem pengetahuan modern sebagai basis paradigma. Wahid mengharmonisasikan antara Islam dan adat di mana Islam datang dan tinggal, konsep yang kemudian dinamakan dengan Pribumisasi Islam. Di dalam Pribumisasi Islam, Wahid menjadikan pemahaman terhadap nash dikontekstualisasikan dengan masalah yang ada di Indonesia. Fikih Wahid tidak mengubah nash, melainkan mengubah dan mengembangkan pengaplikasiannya saja, menginterpretasikan Islam secara kontekstual dan menyelaraskan dengan perkembangan zaman sesuai dengan kebutuhan masyarakat. Dalam penerapannya, Wahid menolak formalisasi hukum Islam di Indonesia. Wahid mendasarkan pada pertimbangan historis di mana para pendiri bangsa saat itu menyepakati untuk tidak menjadikan Indonesia sebagai negara teokratis, dan karena Islam memiliki dimensi universalisme yang telah memberi sumbangsih dalam membangun nilai-nilai kemanusiaan. Memformalisasikan hukum Islam di dalam negara yang multikultur dan plural tidak sejalan dengan sifat universalitas ajaran Islam. Alasan yang lain, formulasi hukum Islam dalam kitab-kitab klasik sebagian tidak relevan untuk diterapkan pada saat ini, bila coba untuk diaplikasikan tidak menutup kemungkinan justru akan melahirkan masalah-masalah baru. Wahid lebih condong untuk menerapkan Islam secara substantif ketimbang memamerkan Islam melalui beragam simbol.

Abstract

Perkembangan zaman yang berimplikasi pada lahirnya berbagai fenomena dan persoalan hukum membutuhkan jawaban. Banyak persoalan yang tidak terpenuhi/teratasi oleh aturan hukum Islam dan hukum keluarga di Indonesia. Oleh karena itu, perlu ijtihad kontemporer dalam rangka menjawab berbagai persoalan aktual tersebut. Artikel ini memaparkan tentang urgensi ijtihad kontemporer dalam rangka pembaruan hukum keluarga di Indonesia. Ijtihad kontemporer dilakukan dengan mensinergikan metode usul fikih klasik dengan metode ilmiah modern. Banyak persoalan yang harus diakomodir dalam rangka menghasilkan hukum keluarga yang compitable dengan kehidupan masyarakat modern saat ini, seperti kesetaraan jender, HAM, perkembangan sains dan teknologi modern serta perkembangan sosio-kultural masyarakat. Ada beberapa model ijtihad yang biasa digunakan ulama dalam menjawab permasalahan dalam kehidupan masyarakat. Ijtihad yang paling mungkin dan cocok dilakukan dalam rangka melakukan pembaruan hukum keluarga di Indonesia adalah dengan menggunakan metode mu’tadil mutawazin atau metode istislahi, karena metode ini mempertemukan maslahat menurut nass dan maslahat manusia dalam kehidupan bermasyarakat.

Abstract

Putusan Mahkamah Konstitusi Jumat 17 Februari 2012 terkait dengan anak luar nikah yang disebutakan dalam pasal 43 ayat (1) UU No 1 Tahun 1974 tentang perkawinan menyebutkan bahwa "anak yang dilahirkan di luar perkawinan mempunyai hubungan perdata dengan ibunya dan keluarga ibunya serta dengan laki-laki sebagai ayahnya yang dapat dibuktikan berdasarkan ilmu pengetahuan dan teknologi dan/atau alat bukti lain menurut hukum mempunyai hubungan darah, termasuk hubungan perdata dengan keluarga ayahnya". Perubahan pasal ini harus difahami secara obyektif dan bijak agar membawa maslahat bagi umat dan bukan sebaliknya. Melalui perubahan ini MK berupaya untuk menuangkan hasil ijtihadnya agar anak-anak yang lahir di luar nikah tetap memiliki hak dan kedudukan yang sama dengan anak-anak lain dan agar tidak terjadi perlakuan diskriminatif terhadap anak-anak tak berdosa ini.

Abstract

Policy of western countries, especially the United States against some Muslim countries in the Middle East region led to a backlash and generate assistance in various ways. One way or form of resistance which is by suicide bombing. Even this kind of action does not only happened in the region or the state which is being colonized or war zone, but also often happened in a peaceful country like Indonesia. This paper attempt to uncover the law suicide bombing in perspective of Islamic law by classifying into two, the first suicide bombing as a jihad and second, suicide bombings as terror. This article tries to answer the questions when suicide bombing can be categorized as jihad? What are the conditions or requirements? And when its categorized as terror? The answer in this paper derived from qualitative research. This research is library research toward source texts of Islam, including the fatwas and opinions of ulama, especially contemporary ulama. Author using a theory of maÅŸlahah which is the purpose of shari'a (maqashid al-syariah) as basis for reviewing the legal and categorized of suicide bombing. When a suicide bombing itself include maÅŸlahah by meeting various condition or requirements, then it is categorized as jihad. However, when its performed in peaceful area causes damage that reduces maÅŸlahah, suicide bombing is categorized as terror.

Abstract

The study of violation toward intellectual property from the Islamic law perspective is not much. Meanwhile, it really needs protection from the laws itself. This paper begins its discussion with the protection of property in Islam, the importance of fiqh for intellectual property, defining the violation law toward intellectual property and the last point is about the violation from a fiqh perspective.

Abstract

This article discusses how the role of the scholars of the descendants of Hadrami or known as Habib performs the activities of popular Islamic Preaching (henceforth: da’wah) in the urban community. This paper specifically analyzes the activities of da’wah of Majelis Salawat Ahbabul Mustafa led by Habib Syech, a Habib, a descendant of the Prophet who lived in Solo, Central Java. Recently, a similar da’wah was made by young Habib to gain popularity among the youth in several major cities in Indonesia. By using the media of tambourine instrumental music in reading the Shalawat, the da’wah of Habib Syech successfully attracts the interest of many participants who mostly came from groups of young people. In the middle of the hard blasphemies of the Salafi Preacher (Dai) against the majority of the religious practices of Indonesian Muslims, the Majelis Salawat led by Habib Shaykh conducted the ‘counter attack’ by means of-ways and elegant manners. This group also performs the da’wah through a cultural approach as Walisongo did by using Javanese idioms to get closer to the objects of da'wah which are mostly located in Java. Abstract

Normatively zakat of asset that must be payed is 5 kinds, namely: cattle, agriculture, trade alms, gold and silver, and rikaz. Some contemporary scholars like Yusuf Qaradawi, Ali al-Salus, Muhyiddin al-Ashfar perform ijtihad of Islamic law related to the development of various assets must be payed a zakat. Yusuf Qaradawi, for example, based on the results of his ijtihad, considering the realities of modern economic activity, he recommended nine kinds of asset that must be payed zakat. He added 4 assets, namely: honey and animal production, minerals and marine products, investment in plant, buildings, zakat profession, stocks and bonds. Furthermore, contemporary scholars also discussed the obligation of zakat institution or legal entity. Based on the ijtihad, Islamic Financial Institutions is obligated to pay zakat because it is a subject of law and as well as a profitable business entity.

Abstract

This article discusses three main problems are related to the preparation of boarding schools (pesantren) to become the center of Muslim civilization in the global era. Firstly, it is releated to the existence of pesantren in Indonesia. Secondly, deals with opportunities and challenges of pesantren to become center of civilization in the global era. Thirdly, these things must be prepared by pesantren to be the center of Muslim civilization. Study in this article is the normative descriptive analysis which is result of in-depth review of the literature related with pesantren and civilization.  Historical facts show and proved that until now pesantren can still exist as a place of education for society and survived, even able to keep rhythm of turnaround of time. There is tremendous opportunity to make pesantren as a center of Muslim Civilization in Indonesia in the global era. However, there are many challenges too. Therefore, it is necessary preparations of the pesantren to capture these opportunities and overcome all challenges. These Preparations are, laid of core or foundation of civilizations, development paradigm of thinking civitas of pesantren, mastery and development of modern science and development of higher education institution of pesantren (ma'had Aly).
