Abstract

This study examines the legal and ethical position in the use of human cadavers in Indonesia after anatomical cadaver surgery an organ transplantation, with a focus on the legal, ethical and regulatory aspects governing the use of cadavers for the purposes of medical education and research. In the context of health law, it is important to understand how regulations in Indonesia ensure the use of cadavers in accordance with applicable legal and ethical norms. This research is a normative-empirical study and uses a qualitative approach with document analysis methods, including laws, government regulations, comparation regulation and related literature. The results of this study obtained a conclusion on the need for regulation regarding the maximum limit on the use of human cadavers so that human rights, ethics and values that live in society and also religious values do not conflict with the objectives in the development of science in the field of health, as well as the need for renewal of data collection and government participation in this case the Ministry of Health to record every ownership of human cadavers with the aim of minimizing the illegal trade and transplantation human organs.

Abstract

This research analyzes the administrative legal issues related to the issuance of the Ministerial Decree on the establishment of the National Committee for Health Student Competency Tests in Indonesia, as examined in the Jakarta Administrative Court Decision Number 185/G/2022/PTUN.JKT. This research was conducted a normative legal method, using statute  approach, conceptual approach, and case approach to assess the legal basis for the decree, the minister's authority, and its implications for the principle of academic autonomy in higher education. The findings indicate that the ministerial decree contradicts applicable laws and regulations because it transfers responsibility for implementing competency tests from higher education institutions to a centralized administrative body. The court's decision confirms that this intervention violates the principles of academic autonomy and the principle of legality in state administrative law. Furthermore, this decision highlights the importance of implementing participatory governance, ensuring legal certainty, and protecting citizens' constitutional rights in education policy. This case sets an important precedent in restructuring the relationship between state intervention and academic independence and strengthening the role of the rule of law in higher education governance.

Abstract

This study emphasizes the relationship between legal aspects and health policy implementation, particularly the Antimicrobial Resistance Control and Prevention Program (PPRA) based on Ministry of Health Regulation No. 8 of 2015 and No. 28 of 2021. The program represents the hospital’s legal responsibility to ensure the right to safe, high-quality, and rational healthcare. Antimicrobial resistance, which increases patient morbidity and mortality, has become a global and national problem. This research employs a juridical-empirical method with a sociological approach, combining primary data from interviews with PPRA administrators and secondary data from legal documents and hospital policies. The results indicate that antibiotic use at Ulin Regional Hospital, Banjarmasin, has been regulated according to the PPRA guidelines established by the hospital director. However, implementation remains suboptimal, particularly in planning, supervision, and healthcare workers’ understanding of rational antibiotic use. The lack of management support and coordination serves as a major obstacle. Strengthening hospital information systems, managerial support, and active involvement of all health professionals are essential to ensure the sustainability of PPRA. From a health law perspective, PPRA implementation at Ulin Hospital has not fully met the principles of legal governance in healthcare. Strengthening internal regulations, enhancing managerial oversight, and conducting periodic evaluations based on the patient safety principle are required to improve compliance and service quality.

Abstract

Primary healthcare clinics are among the healthcare facilities that generate medical waste. This medical waste is classified as hazardous and toxic waste (B3), which poses significant risks to human health and the environment if not properly managed. Therefore, primary healthcare clinics are legally required to manage their medical waste in compliance with the applicable laws and regulations. This study aims to analyze the legal framework and forms of legal responsibility of primary healthcare clinics in managing medical waste. A normative juridical method is employed, utilizing statutory and conceptual approaches. The findings reveal that medical waste management in primary healthcare clinics still relies on general provisions regarding B3 waste management and on regulations applicable to healthcare facilities in general. To date, there are no specific legal provisions governing detailed procedures for medical waste management in primary healthcare clinics, creating a legal gap that may contribute to non-compliance in waste management practices. Such non-compliance may lead to legal consequences in the form of administrative, civil, and criminal sanctions. Legal responsibility may be imposed on individuals or legal entities, depending on the organizational form of the primary healthcare clinic.

Abstract

Medical practitioners face the challenges of operational pressure and opportunities to develop according to professional ideals. Medical practitioners experience feelings of fear of guilt that erode pride, responsibility, and sense of security. The question to be answered in this study is what is the history of the development of the principles and ethics of professional responsibility of medical practitioners? The study aims to understand the principles and ethics of responsibility with the historical guidance of the burden of ethical regulation and professional responsibility of medical practitioners. The study uses a narrative literature study design with a chronological-systematic approach. The results of the study show that the ethics and responsibilities of the medical profession risk damaging trust, creativity, and opportunities for professional development. The ethical principles of the medical profession have historically encouraged efforts to help all patients in a good and correct manner, while paying attention to patients’ rights to self-determination. The results of the study are discussed and recommended in the context of the professional responsibility of medical practitioners with a more diverse view, and; a knowledge-based perspective on inappropriate paradigms that medical practitioners may face.

Abstract

The principle of autonomy is one of the main pillars of medical bioethics, realized through the process of obtaining informed consent for medical procedures. In Indonesia, the implementation of informed consent has not yet fully reflected respect for patients’ autonomous rights. The process of obtaining medical consent is often perceived merely as an administrative formality rather than a meaningful two-way communication between doctor and patient. This article aims to examine the principle of autonomy in Indonesian medical practice from both ethical and legal perspectives. The study employs a normative legal research method using a statute approach and conceptual approach, supported by primary, secondary, and tertiary legal materials relevant to the period between 2015 and 2025. The findings indicate that the main obstacles in implementing informed consent include the persistence of a paternalistic culture, low patient health literacy, limited consultation time, and the use of overly technical consent forms that hinder understanding. Although relevant regulations already exist, their practical application remains suboptimal. A comprehensive strategy involving clinical communication training, patient empowerment, and periodic ethical audits is needed to ensure full protection of patient rights.

Abstract

Human organ transplantation has become a prominent topic alongside the advancement of law and technology. Through the transplantation process, an individual may obtain an organ from another person. This study aims to examine the debate between humanitarian principles and economic considerations in the practice of organ transplantation, as well as the legal framework governing organ transplantation in Indonesia. This study is a doctrinal legal study employing conceptual and statutory approaches, and using secondary legal materials analysed qualitatively to address the central issues concerning the discourse on organ transplantation in Indonesia. The findings indicate that human organ transplantation remains ethically complex, as economic pressures and poverty often influence consent, leading to exploitation and commercialisation. Despite existing legal prohibitions, the tension between humanitarian objectives and economic necessity persists, revealing gaps in ensuring voluntary donation, fairness, and the protection of human dignity. The Government of Indonesia, through Law Number 17 of 2023 on Health (Articles 124 to 134) and Government Regulation Number 28 of 2024 (Articles 325 to 381), stipulates the procedures, medical requirements, and ethical and legal aspects of organ transplantation for humanitarian and health recovery purposes, while explicitly prohibiting any form of commercialisation.
