Al-Risalah: Jurnal Hukum Keluarga Islam (Ahwal Al-Syakhsiyah), published by Islamic Family law graduate Program, Institut Agama Islam Negeri Bone since 2014. The subject covers textual and fieldwork studies with various perspectives of Islamic Family Law, Islam and gender discourse, and legal drafting of Islamic Civil law. In the beginning the journal only served as a scholarly forum for the lecturers, professors, and students at the State Institute of Islamic Studies. However, due to the later development, the journal has successfully invited scholars and researchers outside the Institute to contribute.

Abstract

Abstract This study aims to determine the construction of the implementation of the grant and will among people in Bone regency, to know how the form of grants and wills, strategies communities in the implementation of the grant and the will and the reason people districts Bone is using grants and wills in the division of inheritance compared with the Islamic inheritance system in Bone regency. The results showed that Form grants and testament in the District public Bone is rather the form of grants that are written but there is also using oral, that will, bone people tend to use the oral form of the posts. Community strategies at the time of grant and will bring the grantee or recipient of his testament and presented witnesses who truly believed at the time when the Islamic marriage contract and grant deed or a will. The grant can be directly given by penghibah and will also be directly awarded regardless wait until pewasiat died.

Abstract

AbstractThis research discusses the optimizing of wakaf management system implementation at the Wakaf Foundation of Indonesian Muslim University (UMI) Makassar with a research focus on how the activity of wakaf fundraising and endowments, the development of wakaf assets, as well as the interpretation of compliance with the Law No. 41 of 2004 on the management of wakaf at Wakaf Foundation of UMI Makassar. The results show that the fundraising and endowments that occurred in the Wakaf Foundation of UMI Makassar are similar to the cash wakaf fundraisingsystem, which in its implementation is still within the foundation's internal domain and has not touched the external one yet. The management of wakaf atthe Wakaf Foundation of UMI Makassar is also not fully in accordance with the Law of the Republic of Indonesia Number 41 of 2004 on wakaf since it lacks of cooperation with the Islamic Financial Institutions (LKS) in terms of the collection and management of wakaf, also lacks of cooperation with theRegistrarOfficials of Wakaf Statement (PPAIW) in the creation of wakaf statement certificate. Nevertheless, the researcher appreciates the Wakaf Foundation of UMI Makassar which has optimized its wakaf fund/asset although it is still within the internal scope of the foundation.

Abstract

Abstract The number of application on marriage legalization in the last two years in the Religious Watampone Class I.B has been quite high. This is due to the high demands of people to legalize their marriage for certain reasons, such as divorce proceedings for an undocumented marriage, administrative requirements to get children’s birth certificate, TASPEN (retirement funds) administration, passport registration, getting veteran widow's pension, and publication ofmarriage certificate due to underhand marriage. Judge in deciding a case will look and pay attention on posita (case, the actual fact) and should be in accordance with existing procedures, among others, present witnesses at the hearing and show that there is evidence for consideration. The judge, of course, will put forward maqasid syari’ah (the objectives of sharia),so that the impact will be on the benefit of generations, to keep and maintain the honor that will be seen in the decision or verdict of the judge who accepted and granted other. Therefore, marriage legalization in principle is one of the legal protection and legal certainty, as referred to in Article 7 KHI, toward a marriage that cannot be proven with a marriage certificate as an authentic document in accordance with the mandate of Marriage Act, which requires that every marriage shall be recorded by state institutions.

Abstract

AbstractHousekeeping is a form of coexistence between a husband and wife along with their children and those who live with him as his dependents. Al-Qur'an and hadith has outlined that a family lives in harmony, whether between husband / father with a wife / mother or with their children. Delineation of the Qur'an and hadith is sometimes not working as it should. Therefore, Allah has given the legal provisions of disobedience that occurs between a husband and wife are called to nusyuz. The climax is syiqaq. The Qur'an has hinted that if nusyuz and syiqaq can not be neutralized again, then divorce can be done as an emergency exit. However, at this time, nusyuz and syiqaq translated as domestic violence and expressed as a criminal act. This is certainly different from the conception of Islam that never gave explicit stipulation that the husband or wife can report to law enforcement if their partner violence. This paper intends to explain about contemporary Islamic legal view of domestic violence according to law number 23 of 2004 on the elimination of domestic violence.

Abstract

Abstract                                                              This research is the perception of the Islamic law Of Inheritance Based on the Culture of the community of Bugis Bone. Principal problem is social cultural society description of Bugis Bone, forms of inheritance system at Bugis society Bone and perceptions of Islamic law of inheritance based on the culture of the community of Bugis Bone. The results showed that the Social Cultural Community of Bugis Bone in daily life are bound by a system of norms and customary rules that are sacred and sacred in its entirety is called Pangadereng. For the community of Bugis in the Division of their heritage trust mallempa orowane, mancujung makunraie (male bear, while women carry). The specialty Division of inheritance system this is the home of heritage parents belong to the youngest, because he was with his parents until his parents died. This is because society has a culture of Bugis sibaliperri' (that) within the brotherhood, even for the people of Bugis male got a balanced heritage portion because he got home or the gold value is not less than that obtained by the male. Division of property in indigenous heritage considered to be mistaken in respect of the law of inheritance in Islamic jurisprudence. However, essentially Islamic law also received other legal norms that have grown and flourished as the norms and customs of indigenous communities, and distinctively custom it brings the benefit of the order, as well as harmony in the life of society, as long as it does not conflict with the norms of Islamic law itself.

Abstract

AbstractProblems were oxplained through juridical normative juridical empiric, and syar’i approaches; and discussed through qualitative methods. Based on UU Nomor 41 Tahun 2004 about wakaf, wakaf management consists of organizer’s recruitment, competence and job realization. In the UU, organizer’s appointment is based on someone’s recruitmenr to be organizer through individual, organization and corporation; which are: Indonesia citizen, Moeslem, adult, trusted, healthy mind and body, not hampered to do law deed. Organizer’s competence must be considered to reach optimum management an the benefit. The tasks of organizers in UU are: to administer wakaf, t manage an develop wakaf based on function, to surprise and protect wakaf; and to report job implementation. Wakaf  management in Watampone has been effective based on wakaf allocation which is traditional and consumptive because with or without organizer, consumptive  wakaf like mosque still can operate; but it is not effective if it is related to wakaf regulation which hope that wakaf should be developed to be productive although the allocation is for mosque because modern and profesional mosque from wakaf can produce personal fee; so it needs trusted organizer, have competence and professional to manage it.

Abstract

AbstractKnowledge society in the village of Wollangi sub-district of Barebbo about Islamic inheritance law is generally fixed on big gains the beneficiary children of men and women, namely in relation to one. The heirs of the boys gain a larger part than girls. Their knowledge such as this have been embedded in the community with the phrase majjujung makkunraie mallempa oroane. However, knowledge about things that should not be done in the Division of inheritance such as a ban on taking other people's rights, the prohibition of piling up treasures (estate only possessed by one of the heirs), not yet fully understood by the community. The attitude of the people in the village of Wollangi sub-district of Barebbo against the Islamic inheritance laws have mostly positive reaction especially from among the older generation. As for the youth generation less paying attention towards the Islamic inheritance laws which are considered complicated because they rarely get the Islamic inheritance laws about socialization. Awareness of Community law in the village of Wollangi sub-district of Barebbo to actualize the Islamic inheritance laws are quite adequate. But because of their knowledge and their understanding of Islamic inheritance law is still minimal cause them hampered in Islamic inheritance law is actualized.
