Al-Risalah: Jurnal Hukum Keluarga Islam (Ahwal Al-Syakhsiyah), published by Islamic Family law graduate Program, Institut Agama Islam Negeri Bone since 2014. The subject covers textual and fieldwork studies with various perspectives of Islamic Family Law, Islam and gender discourse, and legal drafting of Islamic Civil law. In the beginning the journal only served as a scholarly forum for the lecturers, professors, and students at the State Institute of Islamic Studies. However, due to the later development, the journal has successfully invited scholars and researchers outside the Institute to contribute.

Abstract

AbstractThe professional code of ethics is a norm set and accepted by a group of professions that direct or instruct their members how to do and at the same time ensure the quality of the profession ahead of the community. Violation of the professional code of ethics is a deviation from the norms established and accepted by a group of professions, which directs or instructs its members how to do and at the same time guarantees the quality of the profession in the front of the public. Man is the most perfect creature of God and even man is equipped with an attitude about which knowledge and behavior are good and which are evil from the laws of nature, which can be dug through reason, within the framework of the theory of nature law, wise people will live well. This attitude is the happiest that God the Creator wants.

Abstract

This study discusses the analysis of the position of joint property in Islamic law and the compilation of Islamic law articles 96 and 97. The purpose of this study is to determine the position of joint property based on the view of Islamic law and compilation of Islamic law articles 96 and 97 as well as the similarities and differences in the position of joint assets according to Islam law and compilation of Islamic law. The author uses a type of library research, which is to become library material as the main data source, by writing, clarifying, and reducing data, especially those related to joint property, both in the study of compilations of Islamic law and Islamic law.The results showed that 1). The position of joint property based on the view of Islamic law can be understood that joint property is syirkah in the sense that it is a form of cooperation or partnership between husband and wife. Syirkah in joint property is a form of cooperation between husband and wife to build a sakinah, mawaddah, warahmah family, including property in marriage. Regarding this joint property, the husband or wife can act to do something or not to do something on the joint property through the agreement of both parties. 2). The position of joint property based on the view of the compilation of Islamic law articles 96 and 97 can be understood that ownership of property in marriage determines the balance between husband and wife in married life. Because they are still married. They have the same rights to the joint property. 3). Equality in the position of joint property according to Islamic law and compilation of Islamic law lies in the distribution of property, in the event of a divorce, the distribution of joint property can be carried out in peace. The division of joint property according to Islamic law and compilation of Islamic law is not absolute because in principle the philosophy in the distribution of joint property is a value that can be achieved by deliberation based on the principles of faith, justice, balance, legal protection, deliberation and compassion. While the difference lies in the concept of joint property. Islamic law does not recognize the name of joint property, Islam views that the wife gets good protection regarding physical, spiritual, moral, material, housing, maintenance costs, and the education of children is the full responsibility of the husband as the head of the family. Meanwhile, according to the compilation of Islamic law, it is explained that joint property is property obtained during marriage as joint property.

Abstract

This study was conducted to find out more about capture marriages whether the marriage is legal or not, because marriage is not something that can be played with. We also have to look at the law, the validity of the marriage and the provisions that the couple will bring to their future. Do not let the marriage lead to divorce and divorce in a time that is still as old as corn.In this research, the researcher dissects books from several sources to see how the process until marriage occurs so that we can study together in the future. The author takes samples from several regions that still carry out this tradition until now. From several areas taken, there are still many marriages that are religiously illegal, but the couple is still carrying on the relationship.

Abstract

Penulisan ini mengarah pada kualitas hadis serta pemaknaan hadis. Dalam pengumpulan data digunakan metode library research (kepustakaan) dan dalam mengkaji data menggunakan metode takhrij hadis, kesahihan sanad dan matan serta teori pemaknaan hadis. Penelitian hadis tentang poligami ini menghasilkan bahwa hadis tersebut  berkualitas Shahih li dzatihi. Hadits bias dijadikan hujjah karena hadits ma’muluun wa maqbuluun, yang telah memenuhi kriterai kehujahan dan keshahihaan hadits. Kesahihan Matan hadis tidak bertentangan dengan Al-Qur’an, dengan Hadis dan akal. Hadits membahas tentang implikasi masing-masing poligami yang dilakukann  di antaranya poligami maksimal empat orang istri dan di dalam poligami ada hak dan kewajiban yang harus dipenuhi oleh suami kepada istri yaitu mengumpuli dan menggiliri istri-istrinya dengan adil secara kasih sayang dan nafkah. Poligami bukanlah hal yang baru muncul tetapi setelah Islam datang maka  poligami diarahkan serta diatur dengan aturan yang manusiawi dan mulia, maka dari itu praktik ini bukanlah suatu hal yang tercela atau negatif selama seseorang hendak melakukan poligami ditujukan dengan tujuan yang jelas dan memenuhi segala ketentuan yang telah diatur agama. Islam tidak serta merta memperbolehkan praktik poligami ini namun apabila poligami dilakukan dengan tujuan yang negatif dan tidak jelas, maka Islam menentang dan melarang praktik ini secara tegas dengan maksud untuk menjaga kedudukan derajat kaum wanita.Kata kunci : Poligami, empat isteri, persfektif hadits

Abstract

Giving “vacant room money” to women is a hereditary tradition followed by the people of Gurun Tuo village, Jambi Province. Even though it has become a custom for quite a long time, the tradition of empty room fees still raises pros and cons in the local community and surrounding areas. This is reviewed with the theory of maṣlahah mursalah, because maṣlahah mursalah is considered an effective legal scale to answer the problems of Muslims in the contemporary era. This study uses a sociological normative qualitative approach, using primary and secondary data sources. This study describes a series of marriages in the village of Gurun Tuo, including: pioneering (ta'aruf and applications), a collection (thanksgiving) in this series the women determine the nominal amount of the vacant room money, then the gernak-gerning (alms) stage, and the last series is wedding reception. If we look at it from the perspective of maṣlahah mursalah, the current implementation of the vacant room customary money is not in line. Because it does not meet one of the conditions for determining maṣlahah mursalah, namely the benefit must be general, not specific to individuals.

Abstract

This research is about the Position Position of Marriage Guardian according to Shamsi Ali (A Comparative Study between the Ḥanafi and Syāfi‘i school) This research is a literature study using (a) munakahat fiqh approach (b )historical approach (c) anthropological approach (d) normative theological approach (e)philosophical approach. The results of this study indicate that the position of the guardian of marriage according to the Ḥanafi school is not a pillar of marriage, Ḥanafi school allows the bride to pronounce her own consent, on condition that the bride must be mature, intelligent and in agreement with her future husband. The existence of a guardian in marriage according to the Ḥanafi school is not obligatory, but only perfect. The Syafi'i school considers the batil marriage contract whose ijab statement is pronounced by a woman, either a girl or a widow, sekufu or not, directly for herself or as a representative for others. Shamsi Ali considers marriage legal if the bride pronounces her own consent, the guardian only needs to give permission, Shamsi Ali reasons that, it will be much better and deeper in meaning if the bride directly recites her own consent because of the direct involvement of the bride and groom. Shamsi Ali also emphasized that, indeed, there is no verse that explicitly indicates that a guardian must pronounce consent for marriage.

Abstract

This thesis discusses the consideration of judges in deciding guardian judges for women who are not approved by their lineage guardian (a case study of guardian adhal in the Watampone Religious Court Class 1A). The main problem is what is the procedure for submitting a guardian judge at the Watampone Religious Court Class 1A for women who are not approved by their lineage guardian and how the consideration of the judge at the Watampone Religious Court Class 1A decides for a woman guardian who is not approved by her lineage guardian. This research is a qualitative research that uses methods with two approaches, namely; normative approach, sociological approach. The data in this study were obtained through direct observation and interviews with judges and the public as applicants, namely: Judges at the Watampone Religious Court Class 1A and the community as applicants in Bone Regency. This study aims to determine the procedure for submitting guardian judges for women who are not approved by their lineage guardians and the judge's considerations in deciding guardian judges for women who are not approved by their lineage guardians at the Watampone Religious Court Class 1A. The usefulness of this research is expected to be able to contribute and contribute to the development of legal science, and religion in particular. The results showed that; The procedure for submitting a guardian judge at the Watampone Class 1A Religious Court for women who are not approved by their lineage guardians that; when the bride comes to register her marriage and her lineage guardian is reluctant to marry and does not succeed in making peace, a marriage refusal letter is issued from the Office of Religious Affairs for administrative completeness of the submission of the guardian judge at the Religious Court. The considerations of the judges of the Watampone Class 1A Religious Court in deciding the guardian judge for women who are not approved by their lineage guardians are that; if a woman has agreed to marry a man of the same level (sekufu), the terms and conditions, and there are no barriers for the bride and groom to marry or are not mahram, ask her guardian for marriage and her guardian refuses or does not approve without reason, or reasons that are not in accordance with Islamic law (syara') then the guardian of the lineage is determined to be adhal.
