Abstract

Substantive rights in terms of civil law, substantive rights are absolute rights over an object, which gives direct control over an object, which can be defended against anyone, and which cannot be protected by the object against other people. For example, property/ownership rights, mortgages, mortgages, trustees, and other collateral rights and titles. In the current civil law system in Indonesia, substantive rights guaranteed by the distinction between property rights are divided into movable and immovable property. What is meant by separation of personal and immovable property is very important in relation to security devices. These differences in objects are used to determine the type of guarantor/loan guarantee that can be assigned to a given loan.Keywords: Property Rights, and Civil Law

Abstract

This study aims to determine Bawaslu's efforts in supervising and preventing violations in the 2024 election, through its duties, functions and authorities. and how the handling of election criminal acts can be resolved through the Sentra Gakkumdu. This research method uses normative juridical concepts with statutory, case and conceptual approaches. As for this study, researchers used sources of legal materials in the form of primary legal materials, secondary legal materials, and tertiary legal materials. In countries that have good and mature democracy, or developing countries that are moving towards democracy, they are still in the process of transition. In reality, elections are still marked by various frauds and violations (electoral malpractices). Elections are still filled with violations and fraud, which certainly threatens the legitimacy of elected power and undermines public trust in state institutions. Transition and consolidation are democratic processes that rely heavily on the quality of the implementation of the election administration. Presence and existence of Bawaslu based on Law no. 7 of 2017, to provide guarantees for the creation of quality and democratic elections, which are held in general, free, confidential, honest and fair (LUBER, JURDIL). The establishment of the Gakkumdu Center is an effort to strengthen Bawaslu with the authority to enforce election criminal law in the implementation of elections in Indonesia. Keywords: Strengthening, Bawaslu, Sentra Gakkumdu

Abstract

This article discusses the regulation of public participation in elections, and how urgent it is in realizing democratic elections. Community participation is very important in the implementation of general elections in the process of selecting members of the legislature and executive. Because after all, the community has a fairly large share in the general election process where the community as voters determines the winner in the general election process. Abstract

Artikel ini mengkaji tentang implementasi hubungan industrial Pancasila dalam mewujudkan kesejahteraan buruh, pegawai atau karyawan. Sebab, karyawan dalam sebuah perusahaan industri merupakan salah satu faktor penting yang dapat mewujudkan keberhasilan suatu perusahaan dalam mencapai tujuannya, karena berhasil tidaknya suatu perusahaan dalam mencapai tujuannya tergantung pada kemampuan karyawan atau rekan kerjanya. Dalam penelitian ini dikaji bagaimana perlindungan hukum bagi karyawan perusahaan yang tidak adil terhadap ekonomi sosial karyawan melalui hubungan indrustrial pancasila serta implementasi HIP yang berkaitan dengan kesejahteraan pekerja. Penelitian ini menggunakan paradigma yuridis normatif yang bertjuan untuk mengatasi masalah hukum secara teoritis. Pendekatan yang digunakan dalam artikel ini ialah deskriptif analitis serta dengan mengkaji secara mendalam terhadap literatur hukum termasuk peraturan dan konsep-konsep keadilan peraturan hukum. Fokus penelitian ini mencakup UUD  1945 dan Undang-undang ketenagakerjaan. Negara sebagai perantara penyedia infrastruktur mendapatkan keuntungan dari pajak yang dibayarkan pengusaha. Seiring bertambahnya ukuran perusahaan, karyawan dan pengusaha tidak lagi mengenal satu sama lain secara pribadi, sehingga permasalahan yang muncul antara karyawan dan pengusaha tidak lagi mudah untuk diselesaikan sehingga seringkali menghambat kinerja baik perusahaan. Oleh karena itu, untuk menjamin ketentraman antara karyawan dan perusahaan, diperlukan adanya aturan yang harus dipatuhi oleh kedua belah pihak.

Abstract

Artikel ini mengkaji dan menelaah tentang perlindungan hukum bagi pekerja perempuan di sektor Pariwisata Bali. Perlindungan hukum bagi pekerja perempuan di sektor pariwisata Bali merupakan topik yang penting dalam konteks pembangunan pariwisata di Indonesia, sehingga menharuskan perempuan untuk bekerja siang dan malam. Studi ini bertujuan untuk menganalisis perlindungan hukum dan pemebrdayaan pekerja perempuan di sektor pariwisata Bali, termasuk faktor-faktor yang mempengaruhi perlindungan hukum dan pemberdayaan pekerja perempuan, strategi yang digunakan untuk meningkatkan partisipasi pekerja perempuan dalam sektor pariwisata, dan dampak dari pemberdayaan pekerja perempuan terhadap pembangunan ekonomi dan sosial di Bali. Metode penelitian yang digunakan ialah normatif research, yaitu adalah studi literatur peraturan perundang-undangan dan bahan-bahan hukum yang lain. Hasil penelitian menunjukan bahwa perlindungan hukum bagi Perlindungan hukum bagi pekerja perempuan dalam sektor pariwisata Bali yang merupakan bagian integral dari upaya untuk mencapai pembangunan ekonomi yang inklusif dan berkelanjutan.
