Abstract

In law enforcement in the field of taxation, especially in registration as a taxable entrepreneur in Indonesia, especially in the Sidoarjo area, it is felt that it is not optimal and it can still be found some entrepreneurs who have not registered themselves as entrepreneurs, why do taxes come from a lack of understanding of taxation on the part of the entrepreneur or abuse or disobedience by the entrepreneur? the entrepreneur, here the author conducts research at a kpp madya Sidoarjo to collect data and examine data from entrepreneurs who are registered but do not have the status of a taxable entrepreneur to the imposition of sanctions on business actors who violate. from the results of research conducted by the author found several kinds of cases in the registration of taxable entrepreneurs. From the conclusion, the author's findings are still considered less than optimal in law enforcement to entrepreneurs who violate so that there are still many entrepreneurs who commit violations.

Abstract

Everyone needs land, not only in life, at the time of death humans also need land. Along with the increasing number of people, the need for land is increasing for housing as well as for growth and development, socio-culture, and technology. The purpose of this paper is to determine the legitimacy of buying and selling land without attaching a BPJS Health Card: Post Presidential Instruction 1 Year 2022. This type of research is normative legal research, namely by using statutory regulations. The emphasis of normative juridical research in accordance with the distinctive character of legal scholarship lies in the study of law or legal studies of positive law. The conclusion is that buying and selling without attaching a BPJS Health card according to Government Regulation Number 24 of 1997 is carried out before the PPAT with a Sale and Purchase Deed, and is proven by a certificate. With the Presidential Instruction number 1 of 2022 which instructs that the process of transferring land rights or buying and selling must attach a BPJS Health card and be an active participant in the National Health Insurance program, while referring to the hierarchy of legislation Government Regulations have a higher position than presidential instructions by Therefore, the process of transferring land rights or buying and selling is considered valid without attaching a BPJS Health card. This proves that the Presidential Instruction has not yet been carried out optimally.

Abstract

The formulation of this research is the regulation of criminal law for fraud in online buying and selling and forms of criminal liability for fraudulent acts of online buying and selling in Indonesia. This type of research is normative juridical. The approach of this research is the statute approach, and the conceptual approach. Research legal materials include primary, secondary, and non-legal materials. The analysis of legal materials uses a qualitative and comprehensive analysis. The results of the study state that 1) the regulation of criminal law in Indonesia, the crime of buying and selling fraud committed online is contained in Article 28 Paragraph (1) of the ITE Law, but this article is specifically used for online fraud crimes which have characteristics only in buying and selling activities. online, while Article 378 of the Criminal Code can only be used to take action against perpetrators of conventional fraud crimes, 2) a form of criminal responsibility for perpetrators of online buying and selling fraud, namely criminal sanctions based on Article 45 paragraph 2 of the ITE Law.

Abstract

This study raises the issue of whether the principle of proportionality in the business agreement between the VHO and Residential Provider has been fulfilled, using normative research and conceptual approach. Based on that, it was found that the agreement made was found to have not fully implemented the principle of proportionality, such as the minimal role of the residential provider in the process of determining the terms and conditions applicable in the agreement and the use of agreement made unilaterally and the use of some clause also contain things that either harm the residential provider. The conclusion obtained is that the application of the principle of proportionality so that it allows for an imbalance in the exchange of right and obligations that have the potential for parties to feel disadvantaged.

Abstract

Drug trafficking is increasing in Indonesia even to an alarming level, causing increasingly complex problems. Illegal drug trafficking is an activity or series of activities carried out against the law or without the rights stipulated as a criminal act. This study aims to determine whether the judge's decision Number 13/Pid.Sus-Anak/2019/PN.Sda is in accordance with the Law or not. Number 35 of 2014 concerning Child Protection and Law no. 11 of 2012 concerning the Juvenile Justice System in terms of fulfilling children's rights in the judicial process. The research method that the author uses is a normative juridical approach using a case approach or commonly known as a case approach. The results of this study explain that the judge's consideration of the actions of child perpetrators is regulated and is subject to criminal sanctions in Article 114 paragraph (1) of the Republic of Indonesia Law Number 35 of 2009 concerning Narcotics. However, there is a discrepancy with Law No. 35 of 2014 and Law no. 11 of 2012. The analysis of legal materials used is deductive reasoning analysis, namely the preparation using hypotheses or temporary answers. This study applies a pattern in the form of a general phenomenon drawn to a specific conclusion.
