Abstract

The work culture in a business entity that is currently happening is certainly inseparable from the existece of a work agreement. Where the work agreement will bind both parties to carry out their respective obligations. One of which is related to the existence of Outsourced Workers Rights in a company that operates in the field of Security Service, to uphold the rights of every worker, this paper aims to find out the Implementation of the rights of outsources worker, as well as what the efforts are made by workers to fight for their rights. This studyuses an empirical juridical method that examines normative application with in action on every legal phenomenon that occurs in the society, so this study shows that the implementation of the welfare of outsources workers which includes wages, guarantees, working time, ets. Can not be carried out optimally, this because of some social security of workers in some compaines are not fully provided.

Abstract

This study aims to apply the TNI Commander Regulation No. 49 of 2015 concerning the Utilization of State Property in the form of Land and/or Buildings within the TNI at the Home of the Military Command V Brawijaya Waru. The research method used is Socio Legal using a juridical approach and a sociological approach. The results of the study were seen from the practice at the Kodam V Brawijaya Waru official house, which is one of the buildings under the auspices of the competent agency within the TNI. Building a building is one of the activities to construct, update and expand houses or buildings converted into a place that allows it to be used for everything. From this research, it can be concluded that changing the function of this official house building must be adjusted to the permit of the TNI Commander Regulation No. 49 of 2015 and its law enforcement based on the competent authority in warning letters and fines that will be carried out, the existence of this TNI Commander Regulation is very important because it uses the Lex Specialis Derogate Generalis Principle.

Abstract

This research raises the issue of the cooperation agreement between PT. Kreen Entertainment Indonesia with CV. Generation of Superior AR. The agreement only consists of 5 articles. The purpose of this study was to analyze the cooperation agreement between PT Kreen Entertainment Indonesia and CV. Generation of Superior AR. So, this research needs to be analyzed with the elements of the agreement between PT. Kreen Entertainment with CV. Generation of Superior AR. The research method used is the normative legal method. The results of this study indicate that the placement of the MoU in the title is not appropriate. This is because the MoU is a preliminary agreement. While this agreement consists of several articles, one of which regulates the rights and obligations of the parties. However, judging from the elements of the agreement, the accidental element has not been seen in the agreement. The benefits of this research are additional knowledge related to the analysis of the elements of the Cooperation agreement between PT. Kreen Entertainment Indonesia with CV. Superior Generation AR.

Abstract

Lately, immoral acts involving children often occur, One of them is the number of case reports regarding rape, harassment, and so on. The immoral act of rape is one of the forms of violence against children. The purpose of this study was to determine the analysis of decisions on immoral crimes against children in Sidoarjo Regency. The research method used is normative juridical with a statutory approach. The results of this study show that there is a disparity between the decisions of one another in the 2019-2021 timeframe, both from the judge's considerations, decisions and other things. The benefit of this research is that the author hopes that this writing can be useful by providing knowledge and information to the public as a reference to find out how to analyze the decision on immoral actions against children in Sidoarjo Regency (Case Study at the Sidoarjo District Court). The analysis of the legal material used is deductive reasoning, what is meant by deductive reasoning analysis here is reasoning based on a mindset that has a general nature to draw conclusions on a specific nature.

Abstract

This study aims to determine whether the court’s decision number 251/Pid.Sus/2015/PN.Sda is a traffic accident that occurs due to negligence of the vehicle driver. Factors that cause traffic accidents come from drivers who are sleepy and less careful. Driver negligence which results in the death of people in traffic accidents is regulated in article 359 of the criminal code and can also be given sanctions or fines as regulated in Article 310 of Law No 22 of 2009. Therefore, the author uses the method Normative juridical as a from of implementation. The formulation of the promblem studied is to analyze the juridical court decision Number 251/Pid.Sus/2015/PN.Sda regarding negligence which resulted in the death of a person, finally legally resulted in the defendant being sentenced to 1 year in prison.
