Abstract

This study analyzes the practice of pledging rubber plantations in loan agreements in Menanti Village, Kelekar District, Muara Enim Regency, and its compliance with the principles of Sharia Economic Law. This study uses a qualitative approach with field research methods through interviews with four informants involved in the lending and borrowing practices. The results show that the transactions are conducted informally based on trust, without written agreements and without witnesses. The rubber plantation is used as marhun, is under the control of the murtahin, and the results are utilized by the lender during the agreement period. In addition, there is an additional loan repayment that has been agreed upon from the beginning of the contract. From the perspective of Sharia Economic Law, this practice has fulfilled the main elements of the rahn contract, namely rahin, murtahin, marhun, marhun bih, and sighat. However, its implementation is not fully in accordance with Sharia principles due to the use of marhun by the murtahin, additional loan repayment, and unclear division of responsibility and risk of plantation maintenance. This finding shows that the suitability of the rahn contract is not only determined by the fulfillment of the main elements of the contract, but also by fairness in the use of marhun, the distribution of benefits and risks, and the debt repayment mechanism that is in accordance with the principle of prohibition of usury.

Abstract

The increasing divorce rate in Indonesia, influenced by economic instability, limited understanding of marital rights and obligations, and the low readiness of prospective couples to build family life, forms the essential background of this study. The objective of this research is to analyze the implementation and effectiveness of the Premarital Guidance Program organized by the Office of Religious Affairs (KUA) in Kudus City in equipping prospective couples with knowledge and skills to establish a harmonious family (sakinah). This study employs empirical legal research (socio-legal research) combined with library research. The research not only examines the prevailing legal norms but also investigates the direct implementation of the Premarital Guidance Program in practice. The socio-legal approach enables integration between normative analysis of Islamic law and statutory regulations with empirical data obtained through observation and interviews. The findings reveal that the Premarital Guidance Program at KUA Kudus covers topics such as reproductive health, family harmony building, and marital rights and obligations. Empirically, most participants reported gaining new insights into household communication, family economic management, and the importance of role equality within marriage. The program has proven effective in enhancing the readiness of prospective couples to face family life, although challenges remain in terms of limited implementation time, participants’ busy schedules, and low participation rates among some couples. From the perspective of Islamic law, the program aligns with the objectives of maqāṣid al-sharī‘ah, particularly in safeguarding lineage (ḥifẓ al-nasl) and fostering the establishment of a sakinah family

Abstract

Digital commerce relies on standard clauses, but formal electronic consent does not by itself ensure contractual justice. This study evaluates the legal position and effectiveness of standard clauses under Indonesian consumer protection law through normative juridical research. The analysis identifies dual-layer validity: electronic consent can form a binding contract, while individual clauses remain subject to Article 18 of Law Number 8 of 1999, good faith, transparency, proportionality, and mandatory consumer rights. Article 18 is normatively strong but operationally limited because supervision remains reactive, authority fragmented, and remedies uneven. The study contributes an integrated effectiveness framework and a five-stage risk-based model: risk identification, clause screening, corrective amendment, graduated enforcement, and remedial feedback
