Jurnal Hukum & Pembangunan (JHP) is one of the oldest published law journals in Indonesia. Published in 1971 by the Faculty of Law, Universitas Indonesia originally titled "Hukum & Pembangunan". JHP adopts a double-blind peer review policy, and focused on various subdisciplines of the legal science, among others: Basic principle of jurisprudence Private law Criminal law Procedural law Economic and business law Constiutional law Administrative law International law Law and society In addition to these fields, JHP also accepts texts covering topics between law and other scientific fields such as legal sociology, legal anthropology, law and economics, and others. Published 4 (four) times a year in March, June, September and December. Each issue contains 15 articles, both conceptual articles and research articles. JHP is published in Indonesian, but an English text is also accepted.

Abstract

This research examines the legal issue concerning the administration of regional government in Nusantara Capital City (IKN) which has been consider by some scholars as demonstrating deviations from the principle of decentralization. This research takes a position contrary to the mainstream legal discourse that argues there is a conceptual deviation in the model of regional governance in IKN. This research is normative legal research employing a conceptual approach and statutory approach with data collected through library research. This research argues that the administration of regional government in IKN does not indicate any deviation from the principle of decentralization. IKN is a special region established based on asymmetric decentralization, whose governance arrangement is not subject to the general decentralization model as regulated in Law No. 23 of 2014 on Regional Government. Therefore, differences in the model of regional governance in IKN should be understood as a consequence of its status, rather than as a form of deviation in the decentralized system of regional government.

Abstract

Era digital membawa transformasi dalam segala aspek kehidupan. Perkembangan teknologi menghadirkan perkembangan zaman pada sisi positif dan negatif dimana penggunaan ruang digital yang dapat diakses tanpa batasan wilayah. Kebebasan diartikan melalui teknologi dengan adanya akses ruang digital memberikan kemudahan akses kepada siapa pun. Melalui algoritma digital, segala hal baik dari aspek budaya, politik, maupun ekonomi dapat diketahui sehingga hal ini juga dapat menimbulkan keresahan apabila tidak diatur batasan akan keberadaannya. Penelitian ini menggunakan penelitian normatif yang fokus pada analisis terhadap norma, asas, doktrin, dan teori hukum yang berkaitan dengan perlindungan hak asasi manusia di ruang digital. Hasil penulisan ini menunjukkan pengenalan dan pentingnya prinsip konstitusionalisme digital yang berkaitan erat dengan HAM yang pada perkembangan di zaman ini mengalami pergeseran makna akan kebebasan yang dikemukakan yang kemudian disandingkan dengan peluang penerapan di wilayah Indonesia. Adanya hambatan akan penerapan prinsip tersebut akan diminimalisir dengan upaya perbaikan pendidikan dan peningkatan minat literasi di Indonesia.

Abstract

Child protection, particularly in preventing and addressing cases of international child abduction, is an obligation of all states. This phenomenon frequently occurs in Indonesia when a foreign-national parent, following divorce, unilaterally takes their biological child abroad in violation of court-granted custody, guardianship, and/or access rights of the other parent. Currently, Indonesia lacks adequate legal provisions to prevent and resolve cases of international child abduction. Moreover, Indonesia has not yet acceded to the Hague Convention on the Civil Aspects of International Child Abduction 1980 (“the 1980 Hague Convention”). This convention establishes a legal mechanism to ensure the prompt return of children to their country of habitual residence while protecting the lawful rights of parents. This paper analyzes legal protections for victims of international child abduction under the 1980 Hague Convention and urges the Indonesian government to promptly accede to the convention to address legal gaps and safeguard the best interests of the child.

Abstract

This research discusses choice of forum clauses in standard contracts on the five largest e-commerce platforms in Indonesia, namely Shopee, Tokopedia, Lazada, Bukalapak, and Blibli. The clause stipulates the mechanism and location of dispute resolution that automatically binds consumers when using the platform. In practice, these clauses tend to burden consumers, especially regarding access to fair dispute resolution. This research focuses on the compatibility of the choice of forum clause with the principles of consumer protection regulated in the Consumer Protection Law (UUPK). The results reveal that most e-commerce platforms use exclusive forms of choice of forum clauses, such as Shopee, Lazada, and Bukalapak, while Tokopedia and Blibli adopt non-exclusive forms. Although GCPL does not explicitly prohibit exclusive clauses, their application is considered to violate consumer rights because it complicates access to dispute resolution, which in this case contradicts the principles or principles in consumer protection, including the principles of justice, balance, and legal certainty. These conditions require serious attention, particularly through more stringent regulation of choice of forum clauses in standard contracts. The government is expected to formulate regulations that ensure clauses in standard contracts do not burden consumers, while business actors need to formulate fairer contracts.
