Abstract

Indonesia has executed approximately 84 inmates in the death row since 1998. Indonesia actively performed death execution until 2016. After 2016, although no execution has been done, there was a death penalty dropped in 2018. In relation to that, death penalty is stipulated in Indonesia Criminal Code (KUHP and other penal codes outside KUHP) and this makes Indonesia as a retentionist country. Death penalty delivers a death row. Death row is a prolonged death execution, which usualy measured in years. This situation caused a double-punishment, where the convicted must serve in an isolation room in prison, while waiting to be executed. This waiting period seems unavoidable due to some factors. Using normative-empirical research method, this research aims to bring the fact that in Indonesia, there are several factors that have been causing a death row. In this research, this situation is tested using state responsibility principle and some international conventions Indonesia has ratified. The absence of provision related to maximum death execution time after verdict is binding without further objections, together with the hierarchical system of court trial in Indonesia is the cause factor for the prolonged death execution. To encounter this situation The Government of Indonesia is proposed to (1) for short term goal, regulate strictly about the implementation of death execution; (2) for long term goal, to abolish capital punishment from the justice system.

Abstract

The enactment of Law Number 1 of 2011 concerning Housing and Settlement Areas (the Housing Act) since 2011 raises several counter-productive potentials for the housing sector in Indonesia. There are new problems related to the application of the Indonesian National Standard and it has implications for housing developers both in terms of technical and juridical aspects, which are interesting to examine in depth. What are the possibilities faced by a housing developer if the requirements for fulfilling the requirements of the Indonesian National Standard must be met by a housing developer? How is the application of Article 32 paragraph (2) and (3) of the Housing Law when faced with realities on the ground? The normative research method is used and is intended to criticize several articles in the Housing Law regarding their implications for housing provision by housing developers with the obligation to use domestic products that must meet the Indonesian National Standard (SNI).

Abstract

The Economic Cooperation Framework Agreement (ECFA) is an important milestone between the People's Republic of China and Taiwan; it is also the most critical achievement in improving the close cross-strait relations since President Ma Ying-Jeou took office in 2008. This article intends to use Guzman's rational choice theory of international law to analyze Taiwan's motivation for signing ECFA under East Asian regionalism, and to speculate whether Taiwan will abide by the relevant ECFA regulations. Signing the ECFA with China is mainly to break through the predicament of Taiwan's isolation under East Asian regionalism. As the first step in cooperation with East Asia, ECFA has a significant impact on Taiwan's credibility in East Asia. Regardless of whether there is a chance to cooperate with other East Asian countries in the future, if Taiwan gets off ECFA's relevant regulations, it will cause damage to Taiwan's credibility and may even obliterate the possibility of future cooperation with East Asian countries. Therefore, from the perspective of rational choice, in order to maintain Taiwan's good reputation and look forward to more cooperation possibilities in the future, complying with the relevant ECFA regulations is an obligation that Taiwan must fulfil.

Abstract

In order to protect the fundamental rights of a human being from any violations during the process of investigation or trial proceedings, an institution called praperadilan was established through Indonesia Criminal Procedural Law. However, throughout 38 years of this institution implementation in Indonesia, the flaw and weakness of this institution has been identified. The example of weakness themselves posed as a great danger to the human rights of the suspect of accused, as on conducting coercive measures, the law enforcement may conduct the measures not in accordance with the law. This weakness has soon lead the society to thought of an alternative towards this institution, another institution that is better and may solve the weakness posed by praperadilan. The society then turn back to the history, realizing that prior to the implementation of Herziene Indische Reglement (HIR) in 1941 has erase a similar institution with the same purpose as in praperadilan, this institution was commonly known as “Rechter Commisaris”. In order to understand whether this reestablished institution may solve the weakness of praperadilan, the author decides to conducting a research on this topic through implementing normative legal method to procure the necessary materials. This writing will analyze the present status quo of praperadilan through understanding the changes made by Constitutional Court to this institution and identifying the weakness of praperadilan that still relevant in 2019. Then, this writing will further analyze the reasons behind the disappearance of this institution in HIR and Law Number 8 Year 1981 regarding Criminal Procedural Law. Finally, this writing will provide a comprehensive comparison and analysis on whether the present reestablished Rechter Commisaris that was contained within 2011 Draft of Criminal Procedural Law may lead to better protection of fundamental rights of a human being.

Abstract

UU No. 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang dalam proses revisi. Beberapa poin pada rancangan undang-undang menambahkan sejumlah poin pengaturan yang tidak ada sebelumnya. Satu dari sejumlah poin tambahan tersebut menarik untuk dikaji, yakni mengenai pasal tentang tes insolvensi. Membaca Naskah Akademik RUU akan ditemukan argumentasi bahwa tes insolvensi diatur demi mengukur keadaan perusahaan, dari aspek likuiditas, nilai aset, dan kemampuan perusahaan dalam membayar utang (termasuk utang yang kontingen dan prospektif). Dalam peristiwa hilangnya kemampuan perusahaan (debitor) memenuhi prestasinya terhadap para kreditor, aktivitas-aktivitas kejahatan seperti penggelapan atau penyelewengan pembukuan perusahaan –dalam genus ‘fraud’ dan ‘concealment’- tidak jarang menjadi faktor penyebab. Sementara itu, hasil tes insolvensi ini –sebagaimana jika nantinya ditransplantasikan ke dalam RUU Kepailitan- akan menjadi pertimbangan hakim dalam menjatuhkan putusan pailit. Maka, tidakkah tes insolvensi perlu beroperasi ekstensif agar mampu turut mendeteksi apakah inabilitas perusahaan terhadap tanggungjawab utangnya ini murni karena resiko bisnis semata atau karena ada kejahatan sebagai faktor predominan? Atau jika tes insolvensi begitu limitatif berfokus untuk mengukur solvensi debitor, maka tidakkah tes insolvensi jadi kehilangan urgensinya.
