Abstract

This study investigates the role of Islamic religious counselors in eradicating Qur’anic illiteracy in Somba Opu Subdistrict, Gowa Regency. Qur’anic illiteracy remains a significant issue in Indonesia, affecting individuals’ ability to access and practice core Islamic teachings. Utilizing a qualitative descriptive method with a case study approach, the research involved interviews, observation, and documentation to understand the strategies implemented by religious counselors. The findings reveal that counselors play a central role in facilitating Qur’anic literacy programs by providing instruction using structured methods such as Iqra and Al-Barqi, conducting outreach activities, evaluating learner progress, and engaging with community leaders. Supporting factors include strong religious motivation, collaboration with local stakeholders, and institutional backing from the Office of Religious Affairs (KUA). However, challenges such as digital distractions, limited human resources, and low learner motivation continue to hinder program effectiveness. This study highlights the importance of strengthening the role of religious counselors and promoting community-based religious education as a key strategy for addressing Qur’anic illiteracy in Indonesia.

Abstract

This study explores the critical role of negotiation in international business transactions amid a rapidly evolving and complex global environment. Using a qualitative methodology grounded in literature analysis, it investigates how cultural differences and geopolitical factors affect strategies and outcomes in cross-border business negotiations. The findings reveal that dimensions such as cultural values, communication styles, time orientation, and conflict resolution methods significantly influence negotiation dynamics. Moreover, global economic instability and geopolitical pressures introduce additional complexities that require negotiators to integrate political, regulatory, and economic considerations into their strategies. The study concludes that international negotiation has evolved into a multidimensional mechanism that requires intercultural competence, strategic flexibility, and comprehensive risk analysis. Practical recommendations are presented to aid business actors in managing the challenges of global uncertainty.

Abstract

The development of digital technology has triggered a significant transformation in the economic and asset ownership system, particularly with the emergence of cryptocurrency. In Indonesia, digital assets such as Bitcoin and Ethereum are gaining popularity as tools for investment and wealth storage. As public adoption increases, the legal need to regulate cryptocurrency’s status as inheritable property becomes more urgent. However, Indonesia's civil inheritance law does not explicitly recognize cryptocurrency as part of an estate, leading to a legal vacuum that causes uncertainty in ownership rights and legal protection for heirs. This study uses a normative juridical approach and literature analysis to explore the legal status of cryptocurrency as an inheritance object and propose forms of legal protection for cryptocurrency holders. The findings indicate that although cryptocurrency fulfills the criteria of intangible, transferable, and economically valuable assets, formal mechanisms for inheritance transfer are lacking. Key issues include loss of private keys, inheritance disputes, and absence of adaptive legal instruments. Regulatory reforms are needed through digital wills, electronic authentication systems, and the role of digital notaries to ensure asset security and legal certainty.

Abstract

This study analyzes the implementation of democratic values in the 2019 Village Head Election (Pilkades) in Ciheulang Village, Bandung Regency. Despite achieving a high voter turnout (74.6%), the election process was characterized by social fragmentation, money politics, and a lack of post-election reconciliation mechanisms. Using a qualitative case study approach, data were collected through interviews with key stakeholders and documentation analysis. The results indicate that while participation was high, voter behavior was often influenced by personal ties rather than rational consideration of candidates’ programs. This highlights a gap between procedural and substantive democracy. To enhance democratic quality at the village level, the study recommends improving political literacy and formalizing post-election conflict resolution processes.

Abstract

Village deliberation (musyawarah desa) serves as the highest forum in the village to discuss, formulate, and decide policies related to development, planning, and strategic village issues. This forum plays a vital role in actualizing participatory democracy at the local level. This study aims to analyze the implementation of democratic values in the village deliberation of Ciheulang Village, Bandung Regency. Using a qualitative case study method, data were collected through interviews and documentation. The results show that the participation rate in Ciheulang’s village deliberations is relatively high, reflecting a strong democratic tradition rooted in communal culture. However, the process still faces challenges, such as uneven representation and tendencies toward one-way communication. This study concludes that democratic implementation at the village level requires continuous enhancement of transparency, inclusiveness, and critical participation from all societal elements.

Abstract

This study explores the implementation of the curfew policy for students in Bandung City as a response to rising juvenile delinquency. Using a qualitative approach, the study employs interviews and document analysis, grounded in George C. Edwards III's policy implementation model and the ecological approach to governance. The findings reveal that from a public policy perspective, the implementation encounters challenges in communication, due to the absence of technical guidelines, limited resources, poor bureaucratic coordination, and incomplete disposition among implementers and communities. From the perspective of government ecology, the policy is shaped by external factors such as geographical conditions, youth human resource quality, and socio-cultural values, while internal factors such as leadership vision, bureaucratic culture, institutional synergy, and parental and teacher involvement significantly affect policy effectiveness. The policy also risks negative labeling if implemented in a repressive manner.

Abstract

This research analyzes the legal aspects of trademark cancellation due to bad faith and substantial similarity to a well-known mark. The case study reviewed is Supreme Court Decision Number 836 K/Pdt.Sus-HKI/2022 between Starbucks Corporation and PT Sumatra Tobacco Trading Company. The objective of this study is to identify the criteria for determining a well-known trademark and examine how the court assessed elements of bad faith in trademark registration. Using normative-empirical legal research methods and a case approach, this study finds that the Supreme Court affirms the importance of protecting well-known trademarks by applying the principles set out in Law No. 20 of 2016 and international conventions. This case sets a legal precedent that strengthens legal certainty and fairness in trademark protection.

Abstract

Disputes in construction service agreements often stem from defaults or failures to perform contractual obligations. This study examines the mechanism for resolving such disputes under Law Number 2 of 2017 concerning Construction Services, with reference to case Decision Number 7/Pdt.G/2022/PN Tli. The normative juridical method is applied through a case study approach. The research found that the default was due to the contractor's failure to fulfill construction obligations as agreed. The dispute resolution followed a litigation process after alternative dispute resolution attempts failed. The court ruled in favor of the plaintiff and imposed compensation on the defendant. The study highlights the importance of detailed contractual drafting, strengthening non-litigation dispute mechanisms, and increasing legal literacy among construction stakeholders..

Abstract

This study examines the tradition of visiting graves after marriage from the perspective of Islamic jurisprudence, prompted by differing public opinions regarding its legal status and permissibility. The research focuses on two main issues: (1) the practice of post-marriage grave visiting in Kou Village, Curio District, Enrekang Regency; and (2) the Islamic jurisprudential view on this tradition. A qualitative research method was applied, utilizing both primary and secondary data sources. Data collection techniques included interviews, documentation, and literature review from books, journals, and articles. Data were analyzed through reduction, presentation, and verification processes. The findings reveal that: (1) The tradition is considered permissible by the local community, though its practice is optional; some couples observe it while others do not. (2) From an Islamic jurisprudence perspective, grave visiting is generally recommended in Islam as a reminder of death and as a means to pray for the deceased, which extends to the post-marriage grave visiting practice.
