Abstract

This study discusses the coaching function carried out in the Class III women’s correctional instistution  in keerom in order to integrate inmates after returning to society. The implementation of prisoner coaching is a government program regulated in the Correctional Law by stipulating two types of coaching, namely personality development and independence development. The implementation of this coaching each  has a different goal in fostering inmates. This research focuses on the implementation of the development  of assisted residents towards the granting of parole.The type of research used was qualitative descriptive where interviews were conducted in depth with related parties  through a sociological juridical approach. The technique of data collection and data management used observation, interview, and documentation methods for the results of inmate coaching in the Class III women’s correctional  institution in Keerom. The results of this study will sho that the more effective the development of inmates will create positive values that grow the quality of the inmates themselves so that changes occur in order to prevent criminal behavior when they are successfully relased. The change in the last Correctional law is a function to further maximize the correctional system, namely humanizing humans by applying the development  of independence and personality and supported by facilities and infrastructure in the process of implementing inmate coaching so that the coaching runs with is expected by the government and the community.

Abstract

This study examines the relevance of the Theory of Development Law and the Theory of Progressive Law within the Indonesian legal system, with particular attention to their role in the developmental process toward the formulation of Pancasila Legal Theory. Pancasila Legal Theory is regarded as a normative foundation that not only reflects the fundamental values of the Indonesian nation but also serves as a philosophical, ideological, and juridical guide in the administration of national law. The research employs a normative legal method with conceptual and historical approaches, conducted through an in-depth examination of relevant legal doctrines. A descriptive analysis is applied to explore the position, function, and role of legal theory in shaping a national legal system grounded in the values of Pancasila as the source of all sources of law. The findings indicate that Pancasila Legal Theory plays a highly significant and strategic role as a foundational framework in the processes of lawmaking, implementation, and enforcement, guiding national law toward substantive justice, social benefit, and the identity and character of the Indonesian nation. Furthermore, this theory ensures that national legal reform remains consistent with the ethical and philosophical principles of Pancasila, thereby enabling the law to function effectively in achieving the goals of the state and the welfare of society.

Abstract

The advancement of information technology has significantly transformed contractual practices, including debt agreements, from conventional formats into digital forms. This study aims to analyze the evidentiary strength of electronic agreements in debt-related civil disputes under Indonesian private law. Using a normative juridical approach, this research examines relevant statutory regulations such as the Indonesian Civil Code (KUHPerdata), Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE Law) as amended by Law Number 19 of 2016, and Government Regulation Number 71 of 2019 on Electronic Systems and Transactions. Selected court decisions are also reviewed, including Decision No. 38/Pdt.G.S/2023/PN.Jkt.Sel, which accepted a WhatsApp agreement as valid evidence. The findings indicate that electronic contracts possess equal legal force to written agreements, provided they meet the essential validity requirements and adhere to the principle of non-repudiation. However, key challenges persist in proving the authenticity of the parties' identities and the integrity of the electronic systems employed. This research contributes to strengthening the normative discourse on the need for adaptive reform in evidentiary law to accommodate the growing digitalization of civil legal relations.

Abstract

Duplicate land certificates remain a significant issue as they frequently lead to land disputes that result in both material and immaterial losses for legitimate landowners. This study aims to examine the forms of legal protection available to owners affected by duplicate certificates. Using a normative legal research method, the study employs statutory and conceptual approaches supported by library research, and the findings are analyzed qualitatively. The results indicate that preventive legal protection involves several key measures, including Complete Systematic Land Registration (PTSL), land administration digitalization, strengthened internal supervision, capacity building for human resources, public education and socialization, and enhanced inter-agency coordination. In contrast, repressive legal protection focuses on dispute resolution through judicial processes, mediation, cancellation of duplicate certificates by the National Land Agency, compensation, and the enforcement of criminal sanctions when necessary. This research contributes theoretically to the discourse on legal protection within land administration, particularly in emphasizing the importance of the precautionary principle in certificate issuance. It also provides broader insights into how preventive and repressive legal mechanisms can effectively mitigate and resolve the ongoing challenges associated with duplicate land certificates.

Abstract

This article aims to analyze the political-legal dynamics in the process of the positivization of Islamic civil law in Indonesia from the colonial period, independence, the Old Order, the New Order, up to the reform era. The focus of the study is directed toward explaining how political configurations, socio-religious forces, and the state’s ideological orientation influence the level of acceptance, forms of regulation, and scope of application of Islamic law within the national legal system. This research employs a normative-juridical method with a historical approach, involving analysis of legislation, doctrinal sources, and the political-legal dynamics underlying the legislative process. The findings show that the positivization of Islamic civil law has taken place gradually through compromises between nationalist-secular and nationalist-Islamic political forces, with Pancasila serving as the philosophical foundation for harmonizing sharia norms with national law. The conclusion emphasizes that the success of the positivization of Islamic law is strongly influenced by political configurations, the consolidation of the Muslim community, and the ability to formulate sharia norms that are contextual, moderate, and aligned with the principles of the Pancasila-based rule of law

Abstract

The debate over shifting the mechanism for electing regional heads from direct popular election to election by the Regional People’s Representative Council (DPRD) has resurfaced in Indonesia’s constitutional discourse. This study aims to describe this shift in the mechanism for electing regional heads from the perspectives of constitutional law and regional democracy, with the principles of popular sovereignty and accountability of power serving as the primary foundations of the analysis. This study employs a normative legal research method with constitutional, conceptual, and theoretical approaches, utilizing primary and secondary legal materials such as legislation, court rulings, and relevant scholarly literature. The research findings indicate that the election of regional heads by the Regional People’s Representative Council (DPRD) is not merely a technical institutional change but carries structural implications for democratic legitimacy, patterns of local government accountability, and the quality of citizens’ political participation. This study contributes to the assertion that the various shortcomings of direct regional head elections should be addressed through reform and the strengthening of democratic institutions, not by reducing the people’s role in determining local leadership.

Abstract

This study analyzes inmate rehabilitation in the Class IIB Lombok Tengah Open Prison using the architecture of freedom concept. Employing a qualitative case study with Desistance and Human Capital theories, data were gathered through observation and interviews. Findings reveal that the minimum-security environment facilitates identity transformation from offenders to pro-social individuals by providing leadership roles in religious activities. Furthermore, agricultural programs significantly build human capital through technical skill mastery, despite structural barriers like limited infrastructure. The study concludes that synergy between psychological readiness and economic empowerment is vital for successful social reintegration and recidivism prevention. These results recommend modernizing vocational facilities and strengthening post-release support to optimize Indonesia's open prison model.

Abstract

The issue of duplicate certificates remains a serious issue in the Indonesian land system, often leading to land ownership disputes and causing both material and immaterial losses to legitimate land rights holders. This circumstance shows that the traditional land registration system still has a number of flaws, including administrative chaos, a lack of integration of land data, and the possibility of mistakes in the process of measuring and registering land. In order to enhance the land registration system and avoid duplicate certificates, the government is implementing electronic land certificates as part of a digital revolution in the land sector. The objectives of this study are to examine the laws governing digital land registration, evaluate how well electronic certificates work to stop duplicate certificates from being issued, and pinpoint institutional and normative barriers to their use in providing legal protection for landowners. Through the examination of several primary and secondary legal sources, this study employs normative legal research methodologies or library legal research with a statutory and conceptual approach. The findings demonstrate that the use of electronic certificates has the potential to improve the land registration system's efficacy through the integration of national land databases, enhancing the system's transparency, bolstering the security of land documents, avoiding duplicate land registration, and enhancing the accuracy and efficiency of land services. Its implementation is nevertheless hampered by a variety of issues, including insufficient technical infrastructure, uneven human resource capacity, and the need for more public participation and digital literacy. Therefore, to guarantee the best possible implementation of electronic certificates, offering legal certainty and protection for land rights holders, regulatory strengthening, institutional capacity building, fair distribution of technology capabilities and infrastructure, and public outreach are required.

Abstract

The failure of parties to appear in person before a notary in the execution of business agreements has generated growing legal uncertainty regarding the validity and enforceability of notarial deeds in Indonesian commercial practice. Despite its critical function as the highest form of written evidence under Indonesian civil law, the requirement of personal appearance  as mandated by Law Number 2 of 2014 on the Amendment to Law Number 30 of 2004 concerning Notary Position (UUJN) is frequently circumvented through power of attorney substitution, remote representation, or digital media, creating substantial legal and economic risks for commercial parties. This study aims to: (1) examine the legal standing of personal appearance as an absolute formal requirement in notarial deeds governing business agreements; (2) analyze the juridical implications for deed validity and evidentiary force when such requirement is unmet; and (3) construct a normative framework addressing the resulting legal vacuum to ensure certainty for parties engaged in commercial transactions. Employing a normative juridical method, this research conducts grammatical, systematic, and teleological interpretation of the UUJN, the Indonesian Civil Code (KUHPerdata), and relevant judicial decisions. The findings establish that non-compliance with the personal appearance requirement fundamentally degrades the deed’s legal status from an authentic instrument to a private document, extinguishing its executorial force and rendering commercial parties legally and economically vulnerable. This research recommends a normative reinterpretation of the UUJN that bridges notarial formality requirements with the protection of commercial contract validity.

Abstract

The rapid growth of digital technology has created broader opportunities for people in Indonesia to express their opinions and ideas freely. Nevertheless, this development has also generated various legal issues, particularly concerning several provisions in the Electronic Information and Transactions Law (ITE Law) that are often referred to as “rubber articles” due to their vague and multi-interpretable nature. The amendment of the ITE Law through Law Number 1 of 2024 is viewed as the government’s effort to clarify legal norms so that they are no longer easily used to suppress public criticism and expression within digital spaces.This study aims to analyze whether the revision truly represents the beginning of a new phase of freedom of expression in Indonesia. The research applies a normative legal method using both statutory and conceptual approaches. The data were obtained from legislation, legal literature, academic journals, and court decisions related to the implementation of the ITE Law.The findings reveal that the revision has introduced several important changes, particularly in clarifying the elements of criminal offenses and narrowing overly broad interpretations of certain provisions. However, the possibility of criminalizing digital expression still remains because the boundaries between criticism, defamation, and harmful online content have not been clearly defined. Therefore, legal reform should be accompanied by a more democratic law enforcement culture that prioritizes the protection of human rights.
