Abstract

A witness, in general, is someone who provides an oral or written testimony describing what he himself sees (waarnemen) someone’s action or deed or a situation or an event. In every legal event, including the making of a certificate by a notary, the witnesses must be presented. They are themselves the ones who witness and see the legal event. Two kinds of witness are recognized in the notary, instrumental witness and known witness. An instrumental witness is an absolute witness obliged to be present at the making of a certificate by a notary and a known witness is a witness introduced to the notary by the person appearing. Article 40 of Law No.2/2014 on position of notary regulates about this witness where terms of a witness are stipulated. One of the terms is that a witness in not allowed to have a marital relationship or blood relationship in a straight line above or below without degree limitation and side line to the third degree to the notary or the parties. Abstract

Legitimate marriage gives legal consequence on joint property. The provisions regulate joint property in the Marriage Law No. 1/1974. This thesis analyzes the transfer of Land and Building Rights after a divorce and the Ruling No. 30/Pdt.G/2013/2013/PN.MTR.  The research problems are as follows: how about legal protection for a married couple on joint property sold by one of them   after the divorce, how about the legal domicile on land building rights of joint property which does not exist in the Marriage Certificate, and how about the judge’s legal consideration in the Ruling No. 30/Pdt.G/2013/2013/PN.MTR on the transfer of land rights after a divorce. The research used juridical normative and descriptive analytic method. Primary data were obtained from Law No. 1/1974 on Marriage, the Civil Code, and PP. Abstract

A brand is a sign or a group of signs which can distinguish goods and services of one company from the other companies. For the recognition of a certain brand, the owner of the brand has to register it to the Directorate General of HAKI. In the verdict in the Commerce Court No 68/Pdt.Sus.Merek/2014/PN/Jkt.Pst, there a case of dispute in brand registration in which KOI and KONI compete over the Logo of Olympics Five Rings. The research problems include the existence of Logo of Olympics Five Ring in Indonesia, the evidence of the dispute in brand registration between KOI and KONI in the Commercial Court No. 68/Pdt.Sus.Merek/2014/PN/Jkt.Pst, and judge’s legal consideration in the Verdict No 68/Pdt.Sus.Merek/2014/PN/Jkt.Pst.

Abstract

Property separation agreement is dine to separate joint property. Its consequence is that joint property in a marriage there are only a husband’s personal property and a wife’s personal property. Property separation agreement will influence the distribution of inheritance to heir(s) when one of the married couple dies. The Supreme Court’s Ruling No. 804/Pk/Pdt/2009, there is a case when the husband loses his right to be the heir of his wife because they have made property separation agreement. The research problems are how about the legal consequence of property separation agreement in a marriage, how about the legal protection for an heir on the inheritance of one of them as the result of property separation agreement, and the judge’s legal consideration in the Supreme Court’s Ruling No. 804/Pk/Pdt/2009. Abstract

Every married couple longs for a child as an offspring and an heir. However, it is sometimes not realized; therefore they usually adopt a child to be raised and treated as their own biological child. Adoption in the Batak Toba community uses local adat law which does not have any strong evidence. As time goes by, the  child becomes an adult, raised by his adoptive parents. Then, his biological parents intend to take him from his adoptive parents. The research problems are as follows: how about the mechanism of adopting a child in the Batak Toba community, how about the position of an adopted child, adoptive parents, and biological parents in adopting a child underhandedly in Batak Toba community, how about the legal remedy of the adoptive parents when the adopted child is taken again by his biological parents underhandedly in Batak Toba community in Simanindo Subdistrict, Samosir Regency.

Abstract

Land is God’s blessing. Based on the right of control of the State, it is the Government’s obligation to carry out land registration throughout the Indonesian territory. UUPA (the Land Act) is intended to protect land and to organize land rights by giving land certificates as the evidence of the land ownership. UUPA attempted to minimize them by regulating the their limitation under Article 7, Article 10, and Article 17 which are the core of Land-reform. The principle of Land-reform is explained in Law No. 56 Prp/1950 on the specification of agricultural land area, and Article 3, paragraph (1) of PP No. 24/1961 in conjunction with PP No. 41/1964 on the Implementation of Land Distribution and Compensation.The research used juridical normative and descriptive analytic method in which the problems were solved by gathering and analyzing the data systematically. Primary data were obtained from the Subdistrict Heads of Silangkitang and Kota Pinang and from the staffs of the Land Office of Labuhanbatu Regency. Secondary data were obtained from primary, secondary, and tertiary legal materials, library research, field research, and interviews. The gathered data were analyzed qualitatively.The conclusion of the research was that the implementation of the prohibition to own land outside subdistrict (absentee) in Labuhanbatu Selatan Regency was the tenure of agricultural land outside subdistrict so that the extension did not have any effect on anything since the extension was concerned with Labuhanbatu Regency, while absentee land tenure was only in subdistrict.Keywords: Prohibition to Own, Absentee Land, Extension Area

Abstract

The case in the Ruling of the Supreme Court No. 967K/PDT/2016 started with an underhanded loan agreement made among Jenda Terkelin with Anthony Sofan and Nurbetty Lingga.The research is done by employing the normative juridical approach with descriptive analysis.The results show that the legal force binding an underhanded deed is stipulated in Article 1875 of the Civil Code, if and underhanded deed is acknowledged by a person to whom it will be used, it binds, and the agreement which is underhandeadly made has binding legal force to the parties who have made it, as regulated in Article 1338 of the Civil Code.Keywords : Agreement, Loan, Underhanded

Abstract

People knoe thw credit in everyday language as debit. Steps that are not less impotant in obtaining the certainty of debt repayment, a guarantee is required as a condition of credit application. The bonds of collateral in the term of immovable objects may only be done on the land with the status of certificate of property. To collateral which is a certificate of Camat can’t be bound by the deposit rights and the problem is when the sub-district head’s certificate fails to be upgraded to a certificate and can’t be executed through the auction. Then BRI branch Lubuk PAkam will conduct a civil suit to be able to execute the collateral.Keyword : Collateral which status is indicated by SK (the letter of notification) fromthe head of district
