Abstract

In the process of regulatory and law-making that become legislative authorities, no longer pays attention to the principles of law in the process so that it has implications for judicial review application at the Constitutional Court. This research is focused on; 1) The process of implementation and consideration of regulatory and law-making by the legislative. 2) the relativization of law’s principle has implications for the results of judicial review by the Constitutional Court. The research methods used are normative research with a statutes approach, and a conceptual approach, and are analyzed using historical, systematic, and hermenetic interpretations to draw results and conclusions. The results showed that in the process of formil and materiil in the process of regulatory and law-making tends to ignore the principle of law as a fundamental aspect. This has an impact on increasing judicial review application by the Constitutional Court, especially on the Fiduciary Guarantee law and the Job copyright Law which affirms the abandonment of law’s principles in substance and process so as to affect the enforceability of the law in the community.

Abstract

The idea of civil society was first put forward by the philosopher Cicero. Civil society is portrayed as a society that puts forward existing and morals. The discussion of civil society cannot be separated from the era of digital transformation characterized by the use of technology in daily life. The focus of this article is to analyze the strengthening of Islamic diversity and legal morality in building civil society in the era of digital transformation. The method used to find results and discussion is a conceptual approach, which provides a point of view of problem solving analysis seen from aspects of legal concepts behind it, or from the values contained in the discussion. The results showed that to build a civil society is necessary to strengthen the value of Islamic religious values, which also contains the moral values necessary to build a law that is advanced, realize the principles of democracy, and guide the behavior of society in the era of digital transformation to achieve civil society that is already in sight.

Abstract

Penyusunan Akses pupuk subsidi telah menjadi masalah serius bagi petani. Perjuangan untuk mendapatkan keadilan pupuk subsidi faktanya terbatas hanya bagi petani yang memiliki lahan. Hal ini justru menimbulkan diskriminasi dalam pemenuhan hak asasi manusia yang adil dan merata khususnya bagi petani penggarap. Tujuan dari penelitian ini adalah untuk menunjukkan ketidakadilan akses pupuk subsidi bagi petani telah menunjukkan bentuk diskriminasi kebijakan di Kementerian pertanian. Penelitian ini menggunakan metode sosio-legal. Dengan mempertajam analisis doktrinal dan mempertimbangkan prinsip-prinsip persamaan dalam melindungi petani dalam memperoleh akses pupuk subsidi di Indonesia. Hasil penelitian menunjukkan bahwa akses pupuk subsidi bagi petani dapat menyebabkan munculnya ancaman dalam pemenuhan hak asasi manusia dalam bentuk: Pertama, distribusi pupuk yang tidak tepat sasaran dan diimbangi dengan kurang pengawasan menyebabkan aliran pupuk bersubsidi menjadi berbelit dan tidak sesuai dengan perutukannya. Kedua, dampak dari akses pupuk bersubsidi yang berbelit menyebabkan terjadinya diskriminasi dalam proses distribusi tersebut hingga mengancam pada pemenuhan hak asasi manusia yang adil dan merata. Ketiga, Regulasi yang diterbitkan oleh kementerian pertanian dalam pendistribusian pupuk bersubsidi menunjukkan adanya celah ketimpangan hukum hingga berdampak pada sikap diskriminatif terhadap petani.

Abstract

Masalah waris telah menjadi sebuah adat yang ada di masyarakat Indonesia. Namun permasalahan yang muncul kepermukaan adalah mengenai kedudukan adat waris dalam sistem hukum di Indonesia. Hal ini yang kemudian mendasari penelitian ini dengan meninjau dari perspektif Hazairin. Pertanyaan dalam penelitian ini adalah tentang bagaimana hukum adat waris dalam hukum Islam di Indonesia dan bagaimana kedudukan adat waris dalam hukum Islam di Indonesia perspektif Hazairin. Tujuan penelitian ini adalah untuk mengetahui dan menganalisis kedudukan adat waris dalam hukum Islam di Indonesia perspektif Hazairin. Metode penelitian ini menggunakan jenis penelitian pustaka (library reseach) dengan pendekatan normatif. Sumber data diperoleh dari data primer pemikiran Hazairin tentang waris dan data sekunder diperoleh dari penelitian-penelitian terdahulu yang terdapat dalam jurnal. Hasil penelitian ini menunjukkan bahwa pemikiran Hazairin tentang waris dalam sistem Indonesia yang dikelompokkannya menjadi tiga yaitu: zawul furudl, dzawul qarobah, mawali (ahli waris pengganti). Namun dalam pemikirannya mengenai ahli waris pengganti terdapat pertentangan. Ahli waris pengganti (mawali) buah pemikirannya bertentangan dengan pandangan ahli hukum lainnya, sebab menurut Hukum Kewarisan Islam mereka baru berhak menerima kewarisan secara hukum dengan terpenuhinya persyaratan, yaitu: ahli waris masih hidup pada waktu meninggalnya pewaris, tidak ada hal yang menghalanginya secara hukum, dan tidak terhijab secara penuh oleh ahli waris secara dekat. Meskipun demikian, pemikiran Hazairin tentang waris menjadi spirit dalam menumbuhkan sikap kritis pemikiran hukum Islam di Indonesia.

Abstract

Global economic inequality has become a fundamental problem in an increasingly complex international trade order. This research aims to analyse the impact of free trade regulations on inter-national economic disparities, with a primary focus on the perspective of international law. Through a juridical-normative approach and comparative studies, the research investigates the mechanisms of international law that affect the distribution of economic benefits among developed and developing countries. The research methodology uses normative legal research methods with data collection techniques through literature study, international document analysis, and review of multilateral trade agreements. Primary data sources include international conventions, trade agreements, and official documents of global trade organisations, while secondary sources include legal literature, academic journals, and reports of international institutions. The results reveal that current free trade regulations tend to discriminate against developing countries, with mechanisms that do not fully take into account the principles of substantive justice. The international trade regime still provides a structural advantage to developed countries, creating a cycle of economic dependency to the detriment of developing countries. Critical analyses show that the current international legal framework has not been able to fully bridge the global economic divide. This research proposes the development of a trade regulation model that is more responsive to different levels of economic development, with fairer compensation and protection mechanisms. Key recommendations include: (1) adjustment of clauses in international trade agreements, (2) establishment of a dynamic system of preferences, and (3) institutional strengthening for more equitable monitoring and dispute settlement. The research conclusion confirms the urgency of transforming the paradigm of international trade law towards a more inclusive and equitable system, taking into account the balance of interests between countries and promoting sustainable economic development.
