Abstract

This study aims to explore the application of the principle of social justice in the development of the new capital city IKN towards the collective rights of indigenous peoples, as well as the legal challenges they face in defending their rights during the development process. The research amploys by the qualitative approach, with the data collected from litelature studies. The data include books, articles journal scientific, news, studies academic, official website governmen, and others reference relevant. In the process of writing and discussing in this academic is used descriptive analytical method. The findings of this research is development of the National Capital City (IKN) in North Penajam Paser can bother rights collective public customs in the environment. These impact include the loss of customary land, neglect of culture local, and social injustice consequence from the lack of involvement public custom in the planning and development process. Research results This can used as base for maker policy For to design regulation inclusive and equitable development social. The result of this study is about the push involvement active public custom in the planning process development, as well as strengthening protection law to right customs and culture threatened local. The novelty from this study lies in focus integrated analytical focus in the social justiceperspective to phenomenon of the dispossession of the public collective right in the Balik indigeneous community. This research fills in emptiness studies in previous that have not thoroughly examined the social justice in dimension of the context of IKN development and the impact on the existence of local indigeneous communities.

Abstract

This study aims to analyze the practice of inheritance distribution in Burneh Village, Bangkalan Regency, focusing on the interaction between Islamic inheritance law and local customary law. The main issue examined is how the people of Burneh implement faraidh provisions in daily life and to what extent local traditions influence inheritance practices. The research employed a qualitative approach using in-depth interviews with religious leaders, customary leaders, and several household heads. The findings reveal that inheritance distribution in Burneh generally does not strictly follow faraidh regulations but instead emphasizes family deliberation and mutual consent. Equal distribution between male and female heirs is often chosen to maintain harmony, while some testators also distribute assets through hibah (gifts) before death. The conclusion of this study indicates that inheritance practices in Burneh reflect a form of legal pluralism that prioritizes social harmony and communal welfare, while simultaneously demonstrating a creative adaptation between Islamic legal norms and local wisdom.

Abstract

This study examines consumer protection against online transaction crimes in accordance with Law The purpose of this study is to analyze and describe the execution of the control of fiduciary collateral objects for creditors according to Law Number 42 of 1999 concerning fiduciary collateral and to analyze and describe the obstacles and solutions to the execution of fiduciary collateral against defaulting debtors. This research method uses an empirical legal research method with a statutory and case approach. The legal materials used in this study are primary legal materials, namely the Civil Code and Law No. 42 of 1999 concerning Fiduciary Collateral and secondary legal materials. The results of this study are: The process of executing fiduciary collateral must follow the established legal procedures, namely through an agreement between the creditor and the debtor regarding breach of promise, or through a valid court decision. The process of executing fiduciary collateral consists of four stages, namely: 1) the initial monitoring stage, namely the classification of debtors based on the potential for bad debt; 2) the warning stage, namely at this stage the creditor delivers a warning of late payment and sanctions to the debtor; 3) warning letter issuance stage, namely the creditor verifies and issues a warning letter to the debtor who is experiencing bad credit; 4) execution stage, namely the execution carried out by the creditor after the debtor receives the third warning letter. Constitutional Court Decision Number 18/PUU-XVII/2019 has provided a legal interpretation that the executorial power of the Fiduciary Guarantee Certificate cannot be enforced immediately, but is dependent on certain circumstances, for example: a default agreement by the creditor and debtor or the debtor's willingness to hand over the fiduciary guarantee object. Obstacles and solutions in the execution of fiduciary guarantees include: 1) the collateral object is not in the hands of the debtor when the execution is carried out, the solution involves debtor education, digitization of records, firm legal action, and increased supervision; 2) the obstacle of intervention by mass organizations/NGOs, the solution is to increase legal understanding, mediation, law enforcement, transparency, and focus on appropriate roles; 3) the obstacle of the fiduciary object being in the TNI/POLRI/Lawyer/Judge environment, the solution is a legal approach through the courts, coordination, mediation, and compliance with legal procedures.

Abstract

Pengesahan Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Negara (UU IKN), yang kemudian diubah melalui Undang-Undang Nomor 21 Tahun 2023, menandai kebijakan strategis pemindahan pusat pemerintahan ke Kalimantan Timur. Namun, proses legislasi yang cepat, minimnya partisipasi publik, dan model legislasi delegatif menimbulkan persoalan politik hukum yang signifikan. Penelitian ini bertujuan menganalisis pembentukan UU IKN dengan pendekatan normatif-doctrinal melalui telaah sistematis terhadap enam dokumen hukum utama: UU IKN dan perubahannya, peraturan presiden terkait, naskah akademik, serta dokumen Mahkamah Konstitusi mengenai uji materiil. Hasil penelitian menunjukkan lima temuan utama: (1) kewenangan luas dan delegasi ekstensif kepada Otorita IKN yang berpotensi mengikis akuntabilitas legislasi; (2) inkonsistensi internal dan konflik antarnorma dengan UU sektoral, khususnya tata ruang dan lingkungan hidup; (3) kekosongan norma dalam perlindungan hak masyarakat adat dan mekanisme partisipasi publik; (4) proseduralisme minimalis dengan ruang deliberasi publik yang terbatas; dan (5) paradoks yudisial, di mana mekanisme judicial review tersedia secara formal tetapi efektivitasnya terbatas akibat sifat delegatif undang-undang. Temuan ini menegaskan adanya keterpasungan regulasi, di mana hukum berfungsi lebih sebagai instrumen politik pembangunan dibandingkan pelindung hak publik, serta paradoks yudisial yang melemahkan fungsi kontrol konstitusional. Kesimpulannya, UU IKN merupakan studi kasus tentang ketegangan antara kepentingan pembangunan elite dan prinsip negara hukum demokratis.

Abstract

Pernikahan di Desa Pilanggede, Kecamatan Balen, Kabupaten Bojonegoro yang dilaksanakan pada malam ke-29 bulan Ramadhan dikenal dengan sebutan pernikahan “malem songo.” Tradisi ini dianggap membawa berkah oleh masyarakat setempat dan menjadi alternatif bagi pasangan yang terhalang oleh hitungan weton Jawa. Pernikahan ini menarik untuk dikaji karena dilaksanakan di antara hari-hari Idul Fitri, dengan prosesi akad nikah yang mungkin tampak asing bagi sebagian orang. Penelitian ini bertujuan untuk memahami praktik nikah malem songo, pandangan masyarakat terhadapnya, dan implikasinya dalam perspektif hukum Islam. Metode yang digunakan adalah penelitian lapangan dengan pendekatan kualitatif, menggunakan data primer dari wawancara dan observasi, serta data sekunder dari literatur terkait. Hasil penelitian menunjukkan bahwa praktik ini sesuai dengan hukum Islam sebagai ‘Urf Shahih dan juga mendukung pemeliharaan agama selama bulan Ramadhan, memberikan keberkahan dan keharmonisan bagi pasangan yang menikah.
