Abstract

This study aims to analyze the criminal liability of notaries involved in criminal acts of corruption, the legal implications for the deeds issued, and the structure and format of the Sale and Purchase Deed (AJB) that meets the requirements for validity, has binding force, and minimizes the risk of legal violations. This research method uses normative legal research with a statutory, case, and conceptual approach that is analyzed prescriptively. The results of the study indicate that (1) The criminal liability of Notaries in Decision Number 42-K/PMT.II/AD/XII/2023 is personal (individual liability) and is based on proof of intent (dolus) and involvement in criminal acts of corruption that are carried out jointly and continuously. Abstract

This study aims to analyze the legal provisions regarding the obligation to electronically register CVs and the civil consequences for entities that fail to comply. This study is a normative legal study with a descriptive analytical nature. The approaches used include a statute approach and a conceptual approach, which are based on primary, secondary, and tertiary legal materials, and are analyzed qualitatively normatively using a deductive conclusion method. The results of the study conclude that failure to register a CV triggers three fatal legal consequences: (1) degradation of civil status that undermines the principle of limited liability, so that debts burden the personal assets of limited partners; (2) loss of exclusive rights to the company nomenclature; and (3) the CV loses its legal capacity to issue or renew its Business Identification Number (NIB) due to automatic blocking in the OSS-RBA licensing system. Abstract

The term "unclear marriage," also known as "nikah sirri," emerged after the enactment of Law Number 1 of 1974 concerning marriage. "Unclear marriage" describes a marriage that is kept secret and conducted according to religion alone, fulfilling the pillars and requirements for a valid marriage without registration in the state. As a result, the lack of a marriage certificate, which harms the rights of the wife and children, is detrimental. This study uses a sociological juridical approach based on primary and secondary data to describe the relevant topic through direct interviews with the local community. Abstract

The application of absolute court competence in lawsuits for the annulment of Notarial deeds related to wills is a legal issue that lies at the intersection of notarial law, civil procedural law, and Islamic will law. This problem is evident in the Decision of the Blora Religious Court Number 86/Pdt.G/2025/PA.Bla which states that the Blora Religious Court does not have absolute authority to examine lawsuits for the annulment of Notarial deeds regarding wills and declares the lawsuit inadmissible. Abstract

The rapid development of the housing sector in Indonesia has encouraged developers to implement a pre-project selling system, namely the sale of units before physical construction is completed, even though they often do not meet all licensing requirements, thus potentially causing losses for consumers in the form of construction delays, non-conformity of specifications, and unclear legal status of the land. This study aims to analyze legal protection for consumers through the role of Notaries and PPAT in the preparation of Sales and Purchase Agreements (PPJB) and Sales and Purchase Deeds (AJB) in order to realize legal certainty, justice, and protection of consumer rights in property transactions in Klaten Regency.
