Abstract

Personal data protection in the digital age is not merely a technical issue, but a constitutional right rooted in the guarantee of security in the 1945 Constitution, particularly Articles 28G, 28D, and 28I. This study uses a normative juridical approach to examine the position of the right to personal data within the constitutional framework. The results of the study confirm that data misuse or leakage is not only technically detrimental, but also violates human rights and neglects the obligations of the state. From a humanistic perspective, this protection determines the level of public trust when engaging in activities in the digital space. Therefore, the existence of the 2022 Personal Data Protection Law must be followed by consistent law enforcement, the establishment of an independent authority, and increased digital literacy. Thus, the constitutionality of personal data protection strengthens the state's role in maintaining the dignity of citizens while creating a sense of security in everyday life.

Abstract

This article examines the boundaries that distinguish second-hand goods traders as participants in the criminal act of fencing, as well as the legal protections available to them. The study employs a normative legal research method with a descriptive approach, drawing on primary and secondary legal materials. The findings indicate that not all second-hand goods traders can be classified as fences, but only when both objective and subjective elements under Article 480 of the Indonesian Criminal Code are fulfilled. To obtain legal protection, traders must adopt preventive measures, particularly by exercising caution in transactions, thereby avoiding potential criminal liability.

Abstract

Customs plays a vital role in supervising the flow of goods entering and leaving customs areas, as well as in the collection of import and export duties, as regulated in Article 2 paragraph (1) of the Indonesian Customs Law. This study employs an empirical method through observations and interviews at the Customs Office of Eastern Sumatra to examine the effectiveness of monitoring specific goods and preventing smuggling. The findings reveal that measures such as sea patrols, land patrols, and market operations have had a tangible impact in reducing the entry of illegal goods, particularly in South Sumatra, thereby supporting the optimization of customs law enforcement.

Abstract

Extortion is an act committed to gain benefits for oneself or others by exerting pressure and causing harm to another party. This phenomenon often involves individuals from non-governmental organizations (NGOs) and has repeatedly been brought to trial, although similar cases continue to emerge. This study applies both normative and empirical juridical approaches to examine the criminal law aspects of extortion committed by NGOs. The findings indicate that criminal sanctions for perpetrators are regulated in the Indonesian Criminal Code (KUHP), particularly in Chapter XXIII Articles 368 and 369, which provide the legal basis for enforcing sanctions against such practices.

Abstract

The high number of drug convicts in Indonesia, especially in Palembang Class I Prison, shows that the dominant repressive sentencing model has not been effective in reducing drug abuse. This condition has led to overcrowding, which has implications for rehabilitation, health, and potential violations of prisoners' human rights. This study aims to examine the implementation of rehabilitation policies for drug convicts at the Palembang Class I Prison and to offer policy reformulations that are more fair and effective. The method used is normative legal research with a legislative, conceptual, and comparative approach. The findings reveal obstacles in the form of limited infrastructure, a shortage of professionals, social stigma, and regulatory disharmony. Therefore, policy reformulation is necessary through strengthening the legal basis that places rehabilitation as the ultimum remedium, improving rehabilitation facilities and personnel, and community participation in social reintegration. These efforts are expected to create a more humane, effective, and restorative justice-oriented correctional system.
