Abstract

The implementation of the mudharabah contract among micro-enterprises in Lakapera Village, Buton Tengah Regency, demonstrates significant potential in improving the community's economic well-being. This study aims to analyze the community’s understanding of the mudharabah contract, its practical application, and the challenges faced. Using a qualitative approach, data were collected through in-depth interviews and observation. The results indicate that despite existing challenges, the positive impact of mudharabah implementation is significant for the growth of micro-enterprises.

Abstract

This journal is entitled Problems of Differences in Land Area Size Between Land Certificates and Facts in the Field. Regulations regarding land ownership are regulated in such a way by the government, but the regulations issued at this time still cannot protect the rights of land owners because until now there are still many problems regarding differences in land area size between land certificates and facts in the field. The purpose of this study is to determine and analyze the causes of changes in land area size in land certificates and efforts to resolve if there is a difference in land area size between land certificates and facts in the field. The method used in this study is empirical legal research, which is a study that will later use empirical facts taken from human behavior through direct observation. The results of the study state that changes in land area size in land certificates are caused by two (2) factors, namely human factors and natural factors. Meanwhile, the resolution if there is a change in land area size in land certificates can be resolved through litigation and non-litigation.

Abstract

This study aims to compare the implementation of liquidation law for Limited Liability Companies (PT) by the General Meeting of Shareholders (GMS) in Indonesia and Malaysia. In Indonesia, the regulation is governed by Law Number 40 of 2007 in conjunction with Law Number 11 of 2020, while in Malaysia, it is governed under the Companies Act 2016. Although both legal systems share the fundamental principle of protecting creditors and shareholders, their approaches differ significantly. Indonesia’s civil law system emphasizes procedural formalism, while Malaysia’s common law system focuses more on solvency and active creditor involvement. This comparative study finds that Malaysia's practices offer greater administrative efficiency and accountability, which could serve as a model for corporate law reform in Indonesia. The findings aim to support the development of more adaptive, transparent regulations aligned with good corporate governance principles.

Abstract

The rapid development of information and communication technology not only brings a positive impact on various aspects of life, but also gives rise to new forms of cybercrime. One of the criminal acts that is increasingly prevalent is the transmission of electronic information that violates morality and contains elements of extortion. The lack of optimal psychological support and legal assistance also worsens the impact experienced by victims. Therefore, strategic steps are needed both preventive and repressive in handling cybercrime. This study aims to thoroughly examine the forms of legal protection available to victims, both in terms of normative legal frameworks, implementation by law enforcement officials, and mechanisms for restoring victims' rights through normative and empirical juridical research methods, as well as interviews with related parties.

Abstract

Indonesia and Malaysia, as two Southeast Asian nations with shared historical and cultural ties, possess distinct legal sistem shaped by their colonial legacies. Indonesia adheres to a civil law sistem (derived from Dutch jurisprudence), while Malaysia follows a common law framework (inherited from British rule). Nevertheless, both jurisdictions incorporate Islamic law and customary legal traditions into their national legal sistem. This study conducts a comparative analysis of the legal sistem of both countries, with a particular focus on criminal law, civil law, and judicial structures, while also examining the challenges and opportunities for legal harmonization in the context of ASEAN integration. The research employs a normative juridical methodology, utilizing statutory and doctrinal legal analysis. Findings indicate that the primary distinctions lie in their legal sources (codification versus precedent) and the role of judicial institutions, while similarities emerge in their recognition of legal pluralism. Harmonization efforts face structural, substantive, and cultural challenges, yet potential exists in areas such as digital law, environmental law, and Islamic inheritance law.

Abstract

This research analyzes the legalization of abortion for rape victims in Indonesia from a human rights perspective, based on Law Number 36 of 2009 concerning Health and Government Regulation Number 61 of 2014 concerning Reproductive Health. The study aims to identify the forms of legal protection for rape victims who undergo abortion and to evaluate the extent to which its implementation aligns with human rights principles, particularly the rights to health, security, and dignity. Using a normative legal research method with a literature review, this study found that existing regulations have provided a legal basis for abortion in rape cases as a form of protection. However, its implementation still faces significant obstacles such as social stigma and limited access, which potentially hinder the fulfillment of victims' human rights.

Abstract

The development of Indonesian criminal law underwent a significant transformation through the enactment of the 2023 Criminal Code, which replaced the Dutch colonial legacy and adopted a humanist-restorative punishment paradigm. This study analyzes the comparison between the Indonesian Criminal Code 2023 and the German Strafgesetzbuch (StGB), particularly in the structure of the main punishment and the purpose of punishment, to evaluate the suitability of the concept with modern judicial practices. The normative research method with a statutory and conceptual approach reveals that the 2023 Criminal Code expands the types of basic punishment, such as imprisonment, closure, supervision, fines, and community service, to diversify punishment that reduces dependence on prisons and supports social reintegration. However, the nominal category-based fine system still has the potential to create economic inequality, in contrast to Germany, which uses a day-fine system that is adjusted to the economic capacity of the offender. While Germany relies on suspended sentences and structured rehabilitation programs, Indonesia still faces challenges in the implementation of alternative punishments such as closure, which lack parameters and practices. Both countries' sentencing objectives emphasize community protection and rehabilitation, but Germany is more mature in its integration of the principle of proportionality, assessment of subjective offender factors, and supporting infrastructure. This research recommends reforming Indonesia's fine system by adopting a day-fine mechanism, developing technical guidelines for alternative punishment, strengthening rehabilitation programs, and harmonizing policies to improve economic justice and the effectiveness of punishment. The findings are expected to be a reference in improving the Criminal Code 2023 before its full implementation in 2026, so that the Indonesian criminal justice system is more responsive, fair, and in line with the values of Pancasila and modern legal principles.

Abstract

Deepfake technology, a product of artificial intelligence, is widely discussed by the public because of its sophistication in replacing the face of the original subject with the face of another subject in the form of a video or photo. This has been misused to create non-consensual pornographic content that has claimed many victims. Over time, this abuse has been facilitated by the spread of the Telegram conversation application. The abused content is then disseminated by the perpetrators on social media and traded. The research method used in this research is normative juridical research which aims to analyse existing regulations, as well as regulations needed to fill the legal vacuum. Moreover, in the case of crimes using AI, there is no specific regulation, so the vacuum has an impact on the lack of security and comfort for victims of deepfake porn. However, the ITE Law describes AI as electronic agents and electronic systems. Criminal law considers that AI is not a legal subject, so the responsibility for AI crimes is imposed on the users of AI technology itself, especially in the crime of deepfake porn.

Abstract

The crime of forging a signature is one form of the crime of document forgery. The reasons why a person commits the crime of signature forgery and also the efforts that must be made to overcome the crime of signature forgery can be determined using criminology. Article 263 of the Criminal Code regulates forgery of documents which is punishable by a maximum prison sentence of six years. From the research conducted, to find out the causes of people committing crimes of signature forgery can be done through various approaches, namely strain theory, control theory, and differential association theory. In understanding efforts to overcome the crime of signature forgery, it can be seen from the process of law formation and the social reaction to the crime of signature forgery. The forms of social reaction to the crime of signature forgery determine what preventive measures must be taken. The social reaction of law enforcement to the crime of signature forgery can be achieved through penal or non-penal measures.

Abstract

This study discusses the role of Pancasila as the foundational and ideological basis of the Indonesian state in the context of international diplomacy, as well as its implications for the formation of national law and foreign policy. Pancasila functions not only as a normative foundation but also as a form of soft power that supports Indonesia's position in the global arena. This research uses a qualitative method with a literature study approach, drawing from journals, books, and relevant legal documents. The findings indicate that Pancasila influences Indonesia’s foreign diplomacy through core values such as social justice, deliberation, and humanity. However, challenges remain in its implementation, particularly in maintaining consistency between Pancasila’s values and global as well as national interests. In the context of international law, Pancasila as a legal ideal (rechtsidee) contributes to the development of a just, inclusive, and tolerant legal system. Therefore, revitalizing the understanding of Pancasila is crucial to ensure it remains a central guideline in every foreign policy decision and national legal development in Indonesia.
