Journal of Indonesian Islam (JIIS) publishes articles on Indonesian Islam from various perspectives, covering both literary and fieldwork studies. The journal puts emphasis on aspects related to Islamic studies in an Indonesian context, with special reference to culture, politics, law, society, eco­no­mics, history, and doctrines. Journal of Indonesian Islam always places Indonesian Islam in the central focus of academic inquiry, and invites any comprehensive observation of Islamic expressions with various dimensions in the country. The journal, serving as a forum for the study of Indonesian Islam, supports focused studies of particular themes and interdisciplinary studies in relation to the subject. It has become a medium of exchange of ideas and research findings from various traditions of learning that have interacted in the scholarly manner.

Abstract

This article analyzes the violence and Joint Ministerial Decree against Jamaah Ahmadiyah Indonesia (JAI), especially relating to freedom of religion. It argues that Indonesia has ratified the International Covenant of Civil and Political Rights (ICCPR) which guarantees the freedom of religion. In addition, Indonesia has also passed laws regarding the freedom of religion such as those in the 1945 constitution. However, these legal foundations have failed to guarantee freedom of religion in Indonesia. The violence against JAI is the proof of this Not only did the government let the incidents occur, but it also issued a Joint Ministerial Decree condemning the activities of JAI. The situation was exacerbated by the fatwa> of the Council of Indonesian `Ulama’ (MUI) which led to more attacks against JAI throughout the country. The article finds that the issuance of the decree was not based on need or legal basis but was an attempt to please radical groups in society.

Abstract

Since the enactment of Law No. 7 in 1989, religious courts have gained an equal position, in terms of jurisdiction, to other courts in Indonesia, a status that took a considerable time to realize. This article discusses the historical development of religious courts in Indonesia from the early period of Islam in the country to the post-independence period. It particularly highlights internal and external factors which underpin the development of religious courts. Further, this paper examines the develop­ment of religious courts under the auspices of the Supreme Court. In the early period of Islam in Indonesia, there was no explicit dichotomy between Islamic and public courts. Religious courts had sole power in the judiciary. During the colonial period, however, the Dutch and Japanese limited the authority of religious courts. After Indonesian independence, the status and authority of religious courts did not change much until the implementation of the Law in 1989.

Abstract

This paper is aimed at explicating the Sufistic idea of Sheikh Nur al-Din al-Raniri, a scholar from Aceh through a critical investigation of his Hujjat al-Siddiq li Daf` al-Zindiq (the Argument of the Truthful against the Apostate) and, to a lesser extent, his Himmat al-`Ulama’ `ala Ri`ayah (the Commitment of the Religious Scholars over their Subject). The latter serves as the intellectual and theoretical ground for the former. The paper argues that his many works are all aimed at not only disseminating mystical knowledge, but also at constructing sufi-based culture and tradition in Aceh. For al-Raniri, the paper further argues, faith is the basis of a society. Hence, al-Raniri’s conception of faith and how this central concept is related in his understanding to the process of society-building deserve a careful analysis.

Abstract

A great Indonesian scholar, Hamka was a politician, novelist, cultural activist and above all religious scholar.  His scholarly works cover so many different areas, but he was most well-known as a Qur’anic interpreter.  His al-Azhar, a book of Qur’anic interpretation has won him both fame and respect up to this time in Indonesia and abroad. This paper is particularly interested in exploring the content of this book and in discussing the basic ideas underlining it. It is also interested in discussing the method of Hamka in tafsir, fiqh, the general characteristics of the book as well as the epistemological relationship between al-Azhar and especially al-Manar by a great Egyptian scholar, Muhammad `Abduh. The paper particularly argues that Hamka and his thought have exerted a great influence on social, cultural, and intellectual aspect in Indonesia.
