Abstract

This article examines the implementation of shari’ah bylaws as a response to the regional autonomy law passed in 1999 and their implications for religious minorities. Under this regional autonomy regulation, local governments at the district level have authority to issue their own regulations. There are three broad sets of issues in Indonesian shari’ah bylaws: public order and social problems, religious skills and obligations, and religious symbolism. The article argues that the introduction of such bylaws has many negative implications for religious minorities in Indonesia. This is, it further argues, because many of religious minority groups are forced to observe the same regulations as mainstream Muslims. Shari’ah bylaws, it goes on to say, have also caused discrimination against religious minorities. Attempts to keep wary eyes on the the negative implications of the enactment of shari’ah bylaws need, therefore, to be undertaken. This responsibility is not in the hands of the government, but also Muslim communities at large. The Indonesian government must treat all social and religious groups equally, guaranteeing no discrimination against each of them. Muslim communities are deeply in need of exploring and practicing the substance, and not the formal aspects, of shari’ah.

Abstract

This article aims at analysing the growing membership of Hizbut Tahrir Indonesia (HTI) by looking at its local development in Makassar, South Sulawesi. While many scholars have emphasized external factors in explaining the rise of Islamist movements, including HTI, this study emphasizes internal explanation from the movement itself. It discusses the strong relationship between HTI da’wah doctrines, recruitment strategy and the joining process. The various recruitment methods and strategies of HTI are in line with its doctrinal stages of da’wah, namely  the stage of culturing (tathqif), the stage of interaction with the ummah, and the stage of taking over the government. This article suggests that individual persuasion through pre-existing interpersonal networks is crucial in attracting young Muslims to participate in HTI. Borrowing theories of conversion by Lofland-Stark and Wiktorowicz, the article demonstrates three  processses of joining in HTI: cognitive opening, religious seeking, and socialization.

Abstract

Fatwa in the circle of Nahdlatul Ulama (NU) remains showing reminiscent of classical period of Islamic jurisprudence. It uses madhhab and taqlid with the employment of classical jurisprudence texts. Being identical in certain crucial features, the NU’s version of fatwa, however, is different from classic fatwa in various aspects. Fatwa is collegial, binding and modern. This last aspect remains debatable within the NU. While senior ulama‘ resist the reintroduction of ijtihad in the process of fatwa issuing as a tradition which should be preserved, certain younger ulama‘ in the organization urges the employment of ijtihad to keep up with the demand of modern context. Senior ulama‘ of the NU maintain that taqlid and madhhab is the very essence of their commitment to Islamic law, whereas the younger ulama‘ assert that such attachment will only result in the abandonment of Islamic law altogether by Muslims, especially the NU members. This article shows that dynamic with special reference to what is happening in East Java, the traditional stronghold of the NU.

Abstract

This paper deals with the idea of reforming an Islamic education in Indonesia through the educational system of pesantren by referring particularly to the thought of Imam Zarkasyi, the founder and leader of Pesantren Gontor. The paper argues that Gontor symbolizes not only the courage of people formerly regarded as educationally marginalized, offering what is best for their fellow country-men, but also the very quality of Islam itself as well as its ability to deal with ever-present social problems. Delving into the depth of Imam Zarkasyi’s thinking, the paper identifies that there are several areas in which he tried his utmost to renew the outlook of his pesantren: (1) the method of Arabic-teaching as a foreign language, (2) the development of pesantren curriculum which integrates both Islamic and non-Islamic sciences, (3) the integration of intra-curricular, extra-curricular, and co-curricular subject-matters, (4) the combination between moral, intellectual, spiritual-religious, and physical education and education in self-management, leadership, and life-skill, (5) managerial base for the endowment system so as to strengthen the institutional aspect of the pesantren. The paper argues that the success of the pesantren lies not only in its ability to produce men of excellence but also its systematic efforts to accumulate wealth.

Abstract

This article is aimed at understanding the theology of Ahl al-Sunnah wa al-Jama’ah better known in Indonesia as Aswaja in the construction of the scholars of the Nahdlatul Ulama in East Java. It particularly investigates the views of three leading figures, Kiai Luthfi Bashori from Malang, Kiai Muhyiddin Abdussomad from Jember, and Kiai Asrori from Surabaya.  The idea of the research comes into being as the result of somewhat lengthy debate among the NU elites concerning the problem of the application of Aswaja’s tenets in mainly three domains; theology, fiqh, and Sufism. Kiai Luthfi tends to look at the tenets of Aswaja in terms of theology, and tries to apply them practically through social movement that he works for. Kiai Muhyiddin  tends to understand those tenets as a set of jurisprudential principles, while Kiai Asrori understands them as a kind of Sufistic values. The article argues that different scientific orientation naturally brings about different approaches in looking at religious tenets and worldly issues. Different perspectives in concept and how this concept is to be applied just follow the difference in scientific orientation and approach.

Abstract

The development of pesantren from time to time illustrates its significant role within communities. Its dynamic development appears clearly as a result of its ability to adapt into the external condition. Its communities are well-known with their social skills in dealing with external culture that comes from all types of challenges coming from outside. Pesantren has an internal mechanism to adapt into a new trend, due to the development of its function and differentiation. The empirical experiences show the ability of four imperative functions of pesantren, namely: high ability to adapt into the external world, wide-ranging goal achievement, integrative ability of unifying the unique aspects of pesantren as sub-culture, and ability in preserving the pesantren’s tradition with the principle “maintaining the old good tradition and gaining a new better tradition”. Differentiation mechanism is a gradual transformation process of pesantren that causes the steady increase of new units within it to perform their functions more effectively. This response leads to various models of pesantren.
