Abstract

This research explains and analyzes the role of the AICHR as an ASEAN Human Rights Institution in its engagement in the Rohingya case in Myanmar for the period 2012-2016. The purpose of this research is to explain the causes of human rights violations against Rohingya ethnicities, the involvement of the AICHR in that case and the obstacles faced by AICHR in their involvement. This research uses qualitative research methods to provide answers by describing the facts related to Rohingya case and the AICHR’s efforts to get involved in the case. The frame of mind used in this study is the paradigm of Institutional Liberalism, concept of International Organization, and concept of International Regime.   Researcher found that the involvement of AICHR in the Rohingya case was limited to being used as a forum or meeting place for its member countries to discuss and gather information regarding the case. This is due to the presence of internal AICHR factors including limited authority or mandate, lack of independence of members and an inefficient and effective consensus system. Meanwhile, external factors originated from the application of the ideology of socialism by Myanmar which caused this country to become closed so that AICHR had difficulty in obtaining and collecting information related to the Rohingya case.

Abstract

When ISIS seized control of the Iraqi territory in August 2014, the extremist group had carried out various forms of crimes against humanity towards multiple ethnic groups to launch their aim of forming a Islamic State. They have commited murder, torture, ill-treatment, religious coercion, imprisonment, and kidnappings accompanied by acts of sexual slavery, forced rape and pregnancy as happened in the Yezidi ethnic case in Iraq. ISIS has captured, sold, and raped them as slaves and caused victims to receive various types of physical and mental abuse. The aim of this study is to provide an overview of the reasons underlying ISIS for sexual slavery against Yezidi women in Iraq by using the concept of Crimes against Humanity to explain the facts in case studies. The results of this study indicate that ISIS background made Yezidi women in Iraq as prisoners of slaves due to their own justification of the Qur'an interpretation which discredited and subordinated women, so that women were freely sold and treated arbitrarily. In addition, ISIS's actions were driven by very promising business motives of the "slave market" and have contributed a huge income to the activities and the continuity of ISIS.

Abstract

The case of human trafficking in the fishing industry has not been comprehensively identified, and there are no adequate legal instruments, so that the workers on fishing vessels are vulnerable to slavery. The case of human trafficking and slavery in Benjina is the largest case in the fishing industry in the 21st century. The Government of Indonesia seeks to cooperate with IOM to tackle the case so that it can be expected that there will be no more human trafficking and slavery practices in the Indonesian fishing industry. This research aims to analyze the cooperation between the Government of Indonesia and IOM in dealing with human trafficking and slavery in Benjina, by first describing the situation and conditions of human trafficking and slavery that occur in Benjina, the factors that had influenced the victims in the recruitment process, IOM's role in helping the victims, up to the obstacles of the cooperation between the Government of Indonesia and IOM in handling the case. This thesis uses qualitative research methods with explanatory research types and analyzed by collecting data from books, annual reports of government agencies and IOM, and mass media. An explanation of the cooperation between the Government of Indonesia and IOM uses the theory of liberalism. This research concludes that despite there are some obstacle factors, there are also some factors that faciltate the cooperation between the Government of Indonesia and IOM in handling human trafficking and slavery in PT. Abstract

Counterfeit goods is a global problem that does not only occur in one country but many, including Tiongkok. Along with developments in technology, Counterfeit goods does not only occur offline but also online. Various efforts have been made to deal with the problem in Tiongkok. Although a lot has been sought, it still persists. Clearly other efforts are needed to deal with the problems. This study aims to explain the efforts that can be made by Alibaba as one of the transnational companies in handling counterfeit goods from Tiongkok in years 2013-2018. The theory used in this study is theory of securitization by Barry Buzan. The method used in this study is a qualitative method, with the type of analysis description research through data collection techniques and literature studies. The results of this study are the efforts made by Alibaba as a transnational company in handling counterfeit goods in Tiongkok, through securitization. Securitization carried out by Alibaba with various ways, such as cooperating with the International Anti Counterfeiting Coalition (IACC) and by establishing Alibaba Anti counterfeiting Alliance (AACA). Alibaba has an important role in helping Tiongkok government to deal with counterfeit goods, mainly online. Still, securitization efforts carried out by Alibaba required support from Tiongkok government as actors who could make legal and binding policies.

Abstract

The development of globalization has made the environmental issue must be notice by the world. Exploration and exploitation in Alberta tar sands oil mining has proven to cause environmental damage which includes the effects of greenhouse gases, air pollution, and water pollution. The impact of environmental damage and pollution due the mining processes has fueled cynical response from international environmental organizations, society, and international regimes to the Government of Canada. In addition, being involved under environmental regime also requires Government of Canada to realize the conditions which has been approved upon the regime. This research aims to explain how the Canadian Government's policies secure environmental pollution in Alberta, Canada tar sands oil mining which had previously been a non-political issue and eventually led to public condemnation. By using a securitization approach, this research describe the efforts and policies of the Canadian Government to secure the threat of environmental damages due to exploration and exploitation of Alberta tar sands oil mining. Canadian Government has made some efforts to securing the case of environmental damage in Alberta tar sands oil mining, but has not reached maximum results.

Abstract

Indonesia establish a cooperation on terrorism with Spain in 2015. This cooperation is one of Indonesia's support for the terrorism campaign led by the US after the of September 11, 2001 events. Indonesia is one of the international actors who are also incorporated in the international system. Meaning that, Indonesian political behavior is also influenced by systems and international politics. It also conveys that in responding to the issue of terrorism globally, Indonesia should cooperate with another country, one being with Spain. However, the events of terrorism in Indonesia and Spain have no connection. This study aims to explain why Indonesia cooperates with Spain regarding terrorism. Qualitative research methods, with explanative types, are used in this study to discuss the factors that encourage Indonesia to collaborate with Spain. Meanwhile, the framework used in this research is Foreign Policy Analysis delivered by David Singer with the unit of analysis (dependent variable) of the country and explanation unit international system / global system.

Abstract

Global War on Terror Policy by the United States became the first step in the emergence of negative view of the United States and matters relating to it by the Muslim community, especially Indonesia. The rise of negative views on the United States, or what is commonly referred to as Anti-Americanism, is because they are considered to involve to the rise of terrorism movements in the name of religion so that many muslim receive discriminatory treatment. To improve relations with the Islamic world, the United States Government decided to create the KL-YES program with the aim of creating mutual understanding with the Islamic world. The purpose of this study itself is to describe the efforts made by the KL-YES program in order to create mutual understanding between Muslim communities and the American community. By using Soft Power Currencies concept from Alexander Vuving,this study is try to see how the KL-YES program is able to create interest in the targets to represent the goals to be achieved, which in this case improve the image of the United States in Indonesia. By using descriptive research type, using primary and secondary data, and using qualitative data analysis, this study shows that the KL-YES program is able to create a positive image of the participants through three variables, namely Benignty, Brilliance, and Beauty.

Abstract

Gender Based Violence (GBV) means violence within a heterosexual relationship, in which the male partner attacks their partner, the victims of this violence are mostly women and this term is integrated with the idea of ‘male superiority over women’. After Congo War II, mining sites in Kivu Province of the Democratic Republic of Congo (DRC) are mainly controlled by ex-combatants and armed groups. The mining sites become unregulated and dangerous where violations of human rights including GBV are rampant. GBV in Kivu Province have huge impacts on Human Security, especially on Health Security, Economic Security, and Personal Security. Therefore World Bank as world financial institution which promote and embody Human Security cooperate with DRC government to eradicate GBV in Kivu Province. World Bank then conduct program to tackle GBV cases in Kivu Province that will be the focus of this research. The Program that will be the focus of this research is DRC: Prevention and Mitigation of SGBV in North and South Kivu. This research analyze the effectiveness of World Bank’s programs using three main indicators of effectiveness: output, outcome, and impact.

Abstract

This research was motivated by economic pressures, domestic political upheaval, and military coups which ignited the emergence of the First Civil War that occurred in 2002-2008. The civil war indirectly forced the residents of Côté d’Ivoire to take part in it and get the effects of the civil war, one of which was the abandonment of the protection of children's rights from the Côté d’Ivoire Government due to the civil war. The United Nations Children's Fund (UNICEF), as an international organization that focuses on upholding and protecting the rights of children and women, provided the Country Programme 2009-2013 to help protect the rights of children and women in Côté d’Ivoire. The purpose of this study is to determine the level of effectiveness in achieving the aid program. With the help of the concept of effectiveness and international organizations, the authors analyzed the effectiveness of the UNICEF Country Programme 2009-2013, which produced research findings, that UNICEF Country Programme 2009-2013 has been effective in assisting the Côté d'Ivoire Government to fulfill, enforce and protect children's rights in Côté d'Ivoire.

Abstract

Euskadi Ta Askatasuna (ETA) was originally only a discussion group for students at Deusto University. However, as a result of dictatorial leadership and discriminatory attitudes adopted by General Fransisco Franco, the ETA group was created as a group that carried out all kinds of acts of violence, aimed at liberating the Basque Country. The act of separatism carried out by ETA separatist groups has become a threat to the Spanish state. Various negotiations have been carried out by the Spanish Government in order to build peace in their relations, but have not been able to end internal conflicts that occurred in the country which is a member state of the European Union. One of the strengths of the ETA separatism group comes from the relationship that exists between the ETA separatism group and terrorist groups from other countries that entered the international network. In this study, the author use the theories: Protracted Social Conflict, Conflict Internationalization, and Sources of Contemporary Conflict to explain that internal conflicts that have occurred for more than 50 years are due to the desire of the Basque Country to separate from the Spanish state. The research method used is qualitative which is carried out by collecting and analyzing data, to find out the reasons for internal conflicts between ETA separatism groups and the Government has not been able to find a way of peace.
