Abstract

The recognition of indigenous peoples’ land rights remains one of the most significant sociolegal challenges in Indonesia, particularly in the eastern regions where customary land tenure systems continue to play a central role in community life. This study examines the relationship between legal pluralism and indigenous land rights conflicts in Eastern Indonesia by analyzing the interaction between state law, customary law, and local governance practices. Using a sociolegal research approach, the study explores how overlapping legal systems influence the emergence, escalation, and resolution of land disputes involving indigenous communities, government institutions, and private investors. The findings indicate that legal pluralism provides opportunities for recognizing local norms and cultural identities but simultaneously creates legal uncertainty when formal regulations fail to accommodate customary claims adequately. Conflicts frequently arise due to inconsistencies in land registration systems, competing interpretations of ownership rights, and unequal power relations between stakeholders. The study further reveals that indigenous communities often face barriers in asserting their land rights within formal legal institutions despite constitutional recognition of customary communities. Effective conflict resolution requires greater harmonization between state legal frameworks and customary governance mechanisms. The research argues that strengthening participatory decision-making processes, improving legal recognition of customary territories, and enhancing institutional coordination can reduce land-related conflicts and promote social justice. The study concludes that a balanced approach to legal pluralism is essential for ensuring legal certainty, protecting indigenous rights, and fostering sustainable development in Eastern Indonesia. These findings contribute to sociolegal scholarship by highlighting the importance of integrating cultural diversity into legal governance and land administration policies.

Abstract

Coastal reclamation projects have become an important component of Indonesia’s infrastructure and urban development agenda. However, these projects frequently generate social, environmental, and legal challenges for coastal communities whose livelihoods depend on marine and coastal resources. This study analyzes access to justice for coastal communities affected by reclamation projects in Indonesia through a sociolegal perspective. Employing qualitative sociolegal methods, the research examines the extent to which affected communities can participate in decision-making processes and seek remedies for perceived harms. The findings reveal that access to justice is often constrained by limited legal knowledge, unequal bargaining power, procedural complexities, and restricted access to legal representation. Environmental impact assessments and public consultation mechanisms frequently fail to provide meaningful participation opportunities for local residents. As a result, communities encounter difficulties in protecting their economic interests, cultural identity, and environmental rights. The study further demonstrates that legal frameworks governing reclamation projects contain important procedural safeguards, yet their implementation remains inconsistent across different regions. Strengthening community participation, legal aid services, and transparency in development planning can significantly improve access to justice outcomes. The research argues that sociolegal approaches are necessary to understand the broader social impacts of reclamation policies beyond formal legal compliance. The study concludes that ensuring equitable access to justice requires integrating human rights principles, environmental governance, and community empowerment into coastal development policies. Such measures are essential for achieving sustainable development while safeguarding the rights and welfare of affected coastal populations.

Abstract

Child marriage continues to pose significant social, legal, and developmental challenges in Indonesia, particularly in rural areas where cultural traditions, economic pressures, and limited educational opportunities influence marriage practices. This study examines the effectiveness of child marriage prevention policies in rural Indonesia through a sociolegal analysis that explores the interaction between legal norms and social realities. Using a qualitative sociolegal methodology, the research analyzes legislative reforms, government programs, and community responses aimed at reducing child marriage prevalence. The findings indicate that legal reforms raising the minimum age of marriage have strengthened the normative framework for child protection. However, implementation challenges persist due to deeply rooted cultural values, religious interpretations, poverty, and limited institutional capacity. The study reveals that legal regulation alone is insufficient to prevent child marriage when social and economic factors continue to encourage early marriage practices. Community engagement, educational initiatives, and economic empowerment programs play a crucial role in supporting policy effectiveness. Furthermore, collaboration among government agencies, religious leaders, educational institutions, and civil society organizations enhances the legitimacy and acceptance of prevention measures. The research argues that sociolegal approaches provide a more comprehensive understanding of child marriage by recognizing the dynamic relationship between law and social behavior. The study concludes that sustainable reductions in child marriage require integrated strategies that combine legal enforcement with social transformation and community-based interventions. These findings contribute to policy discussions concerning child protection, gender equality, and legal development in rural Indonesia.

Abstract

The expansion of digital technology has significantly transformed social interactions, communication patterns, and dispute resolution processes within Indonesian society. Traditional community-based dispute resolution mechanisms, which have long served as accessible and culturally legitimate means of conflict management, are increasingly influenced by digital platforms and online communication networks. This study investigates the transformation of community-based dispute resolution in Indonesia within the context of an emerging digital society. Using a sociolegal research framework, the study explores how digital technologies affect the legitimacy, effectiveness, and accessibility of local dispute resolution practices. The findings demonstrate that digital communication tools facilitate faster information exchange, broader public participation, and increased transparency in dispute management processes. At the same time, the digitalization of social relations introduces new challenges, including misinformation, online harassment, privacy concerns, and the emergence of digitally mediated conflicts. The study further reveals that community leaders and local institutions increasingly utilize digital platforms to support mediation and consensus-building efforts while maintaining traditional values and social norms. Effective adaptation requires balancing technological innovation with cultural legitimacy and procedural fairness. The research argues that the evolution of community-based dispute resolution reflects broader changes in legal consciousness and social governance within Indonesia’s digital transformation. The study concludes that sociolegal frameworks must adapt to the realities of digital society while preserving the inclusive and participatory character of local dispute resolution mechanisms. These findings contribute to contemporary debates on law, technology, and community governance in developing societies.

Abstract

Village governance plays a strategic role in promoting legal awareness and strengthening the rule of law within local communities in Indonesia. As the closest level of government to citizens, village institutions possess significant potential to facilitate legal education, encourage civic participation, and support access to public services. This study examines the role of village governance in enhancing legal awareness among Indonesian local communities through a sociolegal perspective. Using qualitative sociolegal methods, the research analyzes the interaction between local governance structures, community participation, and legal literacy initiatives. The findings indicate that village governments contribute substantially to disseminating legal information, mediating local disputes, and fostering compliance with legal norms. However, variations in institutional capacity, educational resources, and community engagement affect the effectiveness of legal awareness programs across different regions. The study reveals that legal awareness is influenced not only by formal legal knowledge but also by social trust, cultural values, and perceptions of institutional legitimacy. Community-based legal education programs, participatory governance mechanisms, and collaboration with civil society organizations can significantly strengthen public understanding of legal rights and responsibilities. Furthermore, the integration of digital communication technologies creates new opportunities for expanding legal outreach and civic engagement at the village level. The research argues that effective village governance serves as an important bridge between formal legal institutions and local communities. The study concludes that strengthening village governance capacity is essential for promoting legal empowerment, social inclusion, and sustainable legal development in Indonesia. These findings highlight the importance of local governance in advancing legal consciousness and community resilience.
