Abstract

The author examines the concept of Maqasid al-Shari’ah that was used or revitalized as arguments for 53 legal opinions (fatwas) of Dewan Syariah Nasional (DSN) of the Indonesian Ulama Councils (MUI) issued during 2000-2006. Because the purpose of the Maqasid al-Shari’ah is for public interests (maslaha), the examination of the Maqasid al-Shari’ah was conducted by observing the application of fiqh principles in DSN-MUI fatwas, particularly those that related to maslaha. The study found that 50 of 53 fatwas of DSN-MUI included the fiqh principles in all judgments, despite of being equipped by basic Islamic reasoning principles such as Al-Quran, Hadis, Ijma’ and Qiyas. There are 11 possible fiqh principles for use in all fatwas, the minimum is one principle and the maximum is five principles. Overall, the fiqh principles were used 134 times. This means that the average use of the fiqh principles is 2.5 in every fatwa. The most used fiqh principle was the axiom stating that the basic legal principle for muamala is permissible as long as no proposition/law forbids it. The general principle is often used without other specific supporting principles. It should be noted that the DSN-MUI legal opinions tend to be permissive or liberal and less accurate (wijhat al-nazar), despite their validity.

Abstract

The paper analyzes the role of Islamic banking for economic growth in Indonesia. The rapid development of Islamic banking in the country followed the economic growth was the research basis of the paper. The analysis in this paper uses Ordinary Least Square method to determine how much Islamic banking influenced the growth represented by Gross Domestic Product (GDP). The result of regression model testing found that the total assets of Islamic banking had no significant effect (negative) on GDP, while the Islamic banking financing process had significant process had significant effect (positive) on GDP. Variable total assets and total financing of Islamic banking are able to explain the effect 33.8% of GDP variable. This means that Islamic banking has a very small role related to economic growth in Indonesia. The research indicates that the solution for increasing for the influence of Islamic banking could include increasing market share and increasing the share of muḍârabah financing schemes, strengthening regulation, improving the quality and quantity of human resources, and adapting technological advances.

Abstract

Islam and the Javanese culture is a major theme which has become the discussion throughout of the archipelago. Centuries ago when Islam came to the archipelago, it was discussed with other great ideas such as Hinduism, Buddhism and the local religions. In contrast, the culture has been the legacy of the Javanese for thousands of years and continues to be enriched by world cultures. The relationship between Islam and the Javanese, therefore, attracted the interest of researchers and produced many academic works. Throughout its history, the relationship between Islam and the Javanese culture was not always harmonious. At times there were tensions and then at other moments there was consensus, the phenomenon was open and hidden. Such a paradox is referred to as the indigenization of Islam in Java. Indigenization of Islam is the transformation process of mutual borrowing between the outside elements and the locality. Indigenization of Islam is the articulation of socio-cultural interaction of Islam within the Javanese culture in the context of the nation-state: Islam must rise to higher levels as a means of achieving national unity. The paper discusses the indigenization of Islam in the context of the nation state.

Abstract

Jamaah Tabligh is a transnational preaching movement that originated in India. The movement was introduced to Indonesia in 1970s and established Masjid Jami’ in Kebon Jeruk Jakarta as its headquarters. The members of Jamaah Tabligh referred to kitab Fadailul ‘A’mal which teaches innovations in Islamic propagations. Some of their preaching traditions included outdoor preaching (khuruj dan khillah) and the method to invite people to do good deeds (Jaulah). They have Amir as their leader and use the mosque as their center of da’wa activities. Using Diffusion of Information and Influence Theory, the article discusses the existence of the Jamaah Tabligh community and the public’s responses toward the community.

Abstract

The author examines the religious specifics of Banten during the early Islamizing of the region. The main characteristics of the process resided in a link between commerce and Muslim networks, a strong cosmopolitism, a variety of the Islam practices, the large number of brotherhood followers and the popularity of esoteric practices. These specificities indicated that the Islamizing of the region was very progressive within 16th century and the processes of conversion also generated inter-influence with local religious practices and cosmologies. As a consequence, the widespread assertion that Banten is a bastion of religious orthodoxy and the image the region suffers today as hosting bases of rigorist movements may be nuanced by the variety of the forms that Islam took throughout history. The dominant media-centered perspective also eludes the fact that tide connection between religion and ritual initiation still composes the authority structure. This article aims to contribute to the knowledge of the religious aspects in the Bantenese society.

Abstract

This article proves that the modernization of inheritance law is a form of reformation in Islamic law by taking into account the sociological condition of the society to achieve maslahah (maqasid al-shariah). Islamic inheritance law is influenced by the Arabic inheritance law in the pre-Islam era that followed patrilineal system, which influenced the mainstream thoughts of Islamic scholars in understanding inheritance law. This, in turn, resulted in patriarchal Islamic inheritance law. For that reason, it is necessary to re-interpret the law in order to construct a comprehensive fiqh (Islamic law). Hazairin’s thoughts are a revolutionary of inheritance law in Indonesia, such as bilateral inheritance, ahli waris pengganti and kala>lah. Some inheritance law reform contained in KHI are not addressed in conventional fiqh, because there are several aspects to be taken by Indonesian scholars whose ideas are not in conflict with the principles of Sharia (maslahah).
