Abstract

Coal mining on the one hand bring benefits in terms of economics, but on the other hand can cause a variety of environmental problems, one of which caused the rise of mining without a permit in scattered districts in South Borneo, one of them in the Land of Spices, especially Sub District Satui. This research is a normative juridical research. Function of law in the field of environmental conservation is a social enginering. In this field are expected to create a behavior that is oriented to the preservation of the environment, natural resources and ecosystems for the benefit of present and future. Based on Law Number 4 Year 2009 on mineral and coal mining, reclamation place, as one of the obligations of the companys Mining Permit holders.

Abstract

Syariah Bank, which has been existence in Indonesia for two decades, is undergoing a fast development. According to Islamic Finance Report’s survey that Syariah Banking in Indonesia is in the fourth rank under Malaysia,Iran, dan Arab Saudi. The Banking system offers, both conventional banking, and non-bank finance company services. The establishment of Syariah Bank is much influenced by Islamic law system. The aim of this article is to give an overview of how banking concept in Islam and aspects in national banking law influenced by Syariah Banking. It is concluded from this research that Banking in Islam is an economic activity based on the Syariah Economic Principles, namely the Principles of  Tauhid, Khilafah, and  Adalah. The influence of  Syariah Banking on national banking law  can be seen in the use of   contract based on Syariah Principles.

Abstract

Abstrak Under the organization structure of Syariah Financial Institute, the function of Syariah Supervisory Board is to ensure that practice of Syariah Financial Institute is in line with Syariah Principles. However, the role and function of the Syariah Supervisory Council are not optimum in conducting Syariah Financial Institute’s function. There are clear indications that these are happening in the operation of Syariah Financial Institute. Actually, there is regulation on Syariah Supervisory Board, governing role, task, function and authority of Syariah Financial Institute. The purpose of the regulation is to develop the Syariah Financial Institute on the basis of syari’ah much more faster than it is today.  This can be achieved due to the supervisory function of the Syariah Supervisory Board and its role as being a catalyst  for a syariah economic development.  This article is to examine and analyze the optimum use of  the Syariah Supervisory Board’s role in the form of socialization on its existence and role to community, especially depositor. This is important to enable member of society to be an element, who can control   the Syariah Supervisory Board’s role in Syariah Financial Institutes.

Abstract

The environmental management policies are not rarely accused by various parties, related to the objective fact that when the most susceptible to suffer are the lower circles of society, let’s say the farmers, the rural community, or the inhabitants of the land which has potential value of natural resources. Those circles of society often have no idea about the threats that are coming upon them related to the development impacts and the environmental management, and when they suffer loss, they can do nothing about it. Many countries, especially the Common Law countries have accommodated some environmental law policies that are massive interest oriented, such as class action, legal standing, citizen lawsuit or also called as citizen standing, because by such system it will give so much ease to the victims or the plaintiffs to do lawsuits based on the loss they suffer caused by other parties. But unfortunately, about citizen lawsuit, until now it hasn’t been a part of the national legislation because it is not regulated in the constitution. Whereas, in the era before Acts Number 32 Year 1999 was put into effect, in the practice there had been several times that a citizen lawsuit had been submitted to the courts in Indonesia, some of which had been approved and had become permanent jurisdictions.

Abstract

Blood transfusion has played a very important role for cure and recovery of patient health. However, blood transfusion treatment in hospital is generally unsafe, and even it also threatens the life of patient caused by several factors. The first factor is due to negligence on the part of the medical personnel either prior to or during the blood transfusion. The second one is lack of both medical and non-medical equipement to   keep and  distribute blood, so that blood is unsafe to be transfused. Actually, under Law No.14 of 2009 Concering Hospital, hospital is obliged to provide the blood transfusion.

Abstract

Indonesia and Turkey is a country that has a different ideological and the different legal systems. Adultery in Indonesia is a criminal law, there is a basis legal on Article 284 Criminal Code, the Article occur if one of the subject has been married, so that if both of the subject have not married then would not be a criminal. In Turkey, adultery is not a criminal because of the secular ideologies. They see that sexual intercourse is private, it could be reason for obtained divorces but for the subject who single the adultery has no risk or impact.
