Abstract

Along with the development of the age, evil also develops in each era, as will the mode of crime, one of which is the crime of child trafficking. The new mode that emerged was marriage. In this crime, even though it is wrapped in a marriage, basically here the child will be a victim, because it will have physical, psychological, and spiritual effects that can last a lifetime which can then threaten the child's life. The form of protection that can be given to victims is by providing access to justice and fair treatment, providing restitution, compensation and assistance in terms of legal, material and non-material assistance, as well as assisting victims by giving strict and severe sanctions to child traffickers who commit child trafficking with marriage mode. Abstract

The policy in enforcing the tax collection system is the authority of the state to determine it. Not all taxes must be the same in the way they are collected. This paper discusses to examine the regulations governing BPHTB tax collection in realizing the Self-Assessment System and involving PPAT in the Self-Assessment System tax collection. The system or method of tax collection must be adjusted to the type of tax itself so that the objectives to be obtained are optimal. One type of tax is the Cost of Acquisition of Land and Building Rights or commonly called BPHTB. This type of tax already has its own regulations namely Law No. 20 of 2000. Where in this Law expressly, BPHTB tax collection arrangements are carried out by imposing a Self Assessment System collection. The use of this system is the realization of what is stated by basic legal norms. In essence the use of this system is in fulfilling the taxpayer's obligation to calculate, determine the value owed, pay BPHTB carried out by the taxpayer himself. Even so, the BPHTB tax regulation and collection system is still needed to synchronize with other regulations. PPAT is a public official given authority in this BPHTB tax collection. Abstract

The Indonesian archipelago has ratified the United Nations Convention on the Law of the Sea 1982 (UNCLOS 82) through Act No. 17 of 1985. As a result, Indonesia has established three archipelagic sea lanes, or ALKI (North - South), namely ALKI I, ALKI II and ALKI III, where ALKI II has a three-pronged Southern point III A, III B and III C. Indonesia should be able to control and secure the ALKIs by protecting the ALKI waters in the framework of sovereignty and law enforcement at sea.Because ofthe limited number and means to conduct sea patrols and air surveillance by Koarmabarin ALKI-I (Natuna Sea, Karimata Strait, the Java Sea and the Sunda Strait), there are strong indications of foreign vessels conducting intelligence operations, illegal surveying and other illegal activities. Given the variety of crimes that occurred in ALKI-I, there is therefore a need for an ideal security strategy in ALKI-I in order to ensure the sovereignty and laws of the sea there to the extent it is free from harassment and threats. This ideal security strategy ALKII is implemented through the “deployment” of naval forces permanently to exploit the potential of the central government and local governments, while “employment” is implemented by placing sea units at places where felony and misdemeanor are most likely to occur in order to enforce laws at sea. Abstract

The debate about the whereabouts of individuals as the subject of international law over time seems to get an answer. This is because after the first and second world wars, the international community's attention to human rights is increasing. The desire to bring the responsible perpetrators into account before the criminal court is increasing. Efforts to eliminate immunity against perpetrators for crimes committed encourage the establishment of international criminal tribunals ranging from the ad hoc nature to the permanent criminal court. Encouraging individuals as the holders of rights and obligations in international criminal law is getting stronger. It becomes more interesting because the individuals held accountable are citizens who actually have the sovereignty to enforce the law to their citizens. This paper will discuss the existence of individuals as subjects of international law and the effort to hold individuals accountable through international court mechanisms. Based on legal theory, legal principles, sources of international law and international treaties, the existence of individuals in international law can be seen from the granting of rights and obligations in international treaties. The Adhoc and Permanent International Criminal Court is established to demand the accountability of serious crimes against humanity. The existence of individuals as subjects of international law in the future will remain a polemic in its application. Keywords: Responsibility, Individual, International Criminal Law.

Abstract

Tujuan jangka panjang yang ingin dicapai dari penelitian ini adalah memberikan rekomendasi dalam pembentukan atau pembaharuan terhadap hukum kesehatan di Indonesia, khususnya dalam merevisi Undang-Undang Kesehatan dengan memperhatikan perlindungan hukum bagi pasien dan dokter dalam kaitannya dengan tindakan euthanasia. Sedangkan tujuan jangka pendek yang saat ini ingin dicapai adalah mengkontruksikan kebijakan hukum yang dibuat terkait dengan perbuatan euthanasia yang dilakukan oleh dokter atas persetujuan pasien atau keluarga pasien dalam upaya memberikan kepastian hukum dan perlindungan hukum. Perlindungan hukum bagi pasien antara lain terkait dengan kepastian pengobatan, kepastian hukum apabila terjadi tindakan euthanasia. Selain itu juga perlindungan hukum bagi dokter antara lain terkait dengan pemberian pelayanan medis, dalam kemampuan kompetensi yang dimiliki untuk memberikan pengobatan dan bagaimana tanggung jawab dokter terkait dengan tindakan euthanasia yang dilakukan terhadap pasien, sehingga diharapkan dengan mengkontruksikan kebijakan hukum akan memberikan rekomendasi terhadap pembaharuan peraturan Perundang-undangan di bidang kesehatan serta memberikan kepastian hukum dan perlindungan hukum bagi dokter dan pasien. Penelitian ini merupakan penelitian yang menggunakan metode yuridis normatif, dengan pendekatan multidisipliner, meliputi hukum kesehatan, hukum pidana dan hukum perikatan, kemudian dianalisis secara yuridis kualitatif, yaitu terkait dengan persoalan kepastian hukum dan perlindungan hukum bagi dokter dan pasien. Data yang diperoleh dari hasil penelitian baik data primer maupun data sekunder akan diolah dengan menggunakan metode yuridis kualitatif. Abstract

At present in Indonesia there are no specific rules regarding Go-jek as online transportation service. Motorcycle which is the main tool in the business of online and conventional motorcycle taxi services (base) according to Article 47 paragraph (3) of Law Number 22 Year 2009 concerning Traffic and Road Transportation is not included in the group of public motor vehicles because those belonging to the group of public motor vehicles are passenger cars, bus cars and freight cars meaning motorcycles may not be used as public transport vehicles. The use of motorbikes as a means of public transportation without a basis or a clear legal umbrella is feared tobecome a time bomb in the community related to the obligations and rights that should be implemented and obtained by drivers and service users. The focus of this paper is related to the need for legal assurance for consumers who use Go-jek service, specifically the responsibility of Go-jek drivers to consumers in the event of an accident or misuse of the consumer's personal identity. Therefore, in accordance with Law No. 8 of 1999 concerning Consumer Protection, there is a need for regulations that protect consumers as users of Go-jek transportation services, because drivers as Go-jek drivers certainly are not free from mistakes when carrying out their duties.
