Abstract

The principle of legality is the oldest principle of criminal law and is almost found throughout the national criminal law in the world. The existence of this principle is simply to protect citizens from the arbitrariness of the authorities. The strengthening of the issue of human rights contributes to the development of the legality principle, both from national criminal law and international criminal law. Events relating to this issue affect the application of legality principles in law enforcement. The issues to be discussed in this paper are the theoretical principles of legality in criminal law in general and the development of legality principles in national criminal law and international criminal law. The research was conducted by normative juridical method with data collection method through literature study. The application of the principle of legality both in national criminal law and in international criminal law is not rigid, especially to combat crimes against human rights. But in national criminal law must be made in written rules, whereas in international criminal law can be referenced from customary international law.

Abstract

Permasalahan yang dibahas pada tulisan ini adalah Batasan dan Tahapan Pembuatan Perjanjian Internasional dan dampak Perjanjian Internasional Bagi Hukum Nasional. Penelitian ini didasari atas keinginan untuk memenuhi kebutuhan yang mendorong negara untuk terlibat dalam hubungan internasional, namun belum semua perjanjian international yang ada dapat mengatur hubungan dimaksud. Penelitian ini bersifat yuridis normatif dengan sumber hukum sekunder yang kemudian ditafsirkan. Metode pengumpulan data yang digunakan dalam penelitian ini adalah dengan studi dokumen. Analisis data tidak dapat dilepaskan dari berbagai penafsiran. Adapun penafsiran yang dipergunakan dalam penulisan ini adalah penafsiran sejarah yaitu dengan menelaah sejarah hukum atau menelaah perjanjian internasional dari segi batasan dan tahapan pembuatan serta dampaknya bagi perkembangan hukum nasional. Dari pembahasan dapat disimpulkan yang dikatakan perjanjian internasional adalah perjanjian yang dibuat oleh subjek hukum internasional, tunduk pada hukum nasional dan melahirkan hak dan kewajiban. Sementara tahapan pembuatan perjanjian internasional adalah adoption of text, authentivication text and concern to be bound. Dampak Pengesahan Perjanjian Internasional terhadap Hukum Nasional harus melihat kedudukan negara dan substansi dari perjanjian internasional. Kekuasaan yudikatif tetap dapat mendasarkan argumentasi hukum kepada perjanjian internasional tanpa negara harus menjadi negara pihak atau menunggu proses legislasi dari perjanjian internasional itu sendiri. Kata kunci: Batasan; Perjanjian Internasional; Tahapan Hukum Nasional The problems discussed in this paper are the Limits and the Stages of Making International Agreements and the Impact of International Agreements for National Law. This research is based on the desire to fulfill the needs that encourage the state to be involved in international relations, but not all existing international agreements can regulate the relationship. this research is normative juridical with secondary legal sources which are then interpreted. The data collection method used in this study is document study. Data analysis cannot be separated from various interpretations. The interpretation used in this writing is historical interpretation, namely by examining the history of law or examining international agreements in terms of limits and stages of manufacture and its impact on the development of national law. national law and give birth to rights and obligations. While the stages of making international agreements are adoption of text, authentication text and concern to be bound. The impact of ratification of the International Agreement on National Law must see the position of the state and the substance of the international agreement. Judicial power can still base legal arguments on international agreements without the state must be a state party or wait for the legislative process of the international agreement itself. Abstract

The presence of permanent the International Criminal Court is a realization of the efforts of the international community to provide protection against human rights from extraordinary crimes against humanity. The court established under the Rome Statute has been ratified by 123 countries. Indonesia is not a country which ratified the Rome Statute which came into force on 1 July 2002. The issues to be discussed in this paper are the jurisdiction of the International Criminal Court compared to the Indonesian Human Rights Court and the urgency of the roma statute in relation to sovereignty for Indonesia. The research method is done by normative juridical approach with data collection method through literature study which then analyzed as a legal issue to discuss urgency of ratification of roma statute for Indonesia. From the discussion it is concluded that the jurisdiction of the International Criminal Court is more complete than the Human Rights Court in Indonesia and the urgency of ratification of rome statute if associated with the sovereignty of the state should not be feared because the court only to complete as complementary principles in the statutes of Rome.

Abstract

Kehadiran Pengadilan Internasional permanen merupakan realisasi dari upaya masyarakat internasional untuk memberikan perlindungan terhadap hak asasi manusia dari kejahatan-kejahatan luar biasa terhadap kemanusiaan. Pengadilan yang didirikan berdasarkan Statuta Roma tersebut telah diratifikasi oleh 123 negara. Indonesia tidak termasuk negara yang meratifikasi statuta roma tersebut yang telah mulai berlaku sejak 1 Juli 2002. Permasalahan yang akan dibahas pada tulisan ini adalah yurisdiksi Yurisdiksi Mahkamah Pidana Internasional dibandingkan dengan Pengadilan Ham di Indonesia dan urgensi statuta roma dalam kaitan dengan kedaulatan bagi indonesia. Metode Penelitian dilakukan dengan pendekatan yuridis normatif dengan metode pengumpulan data melalui studi kepustakaan yang kemudian dianalisa sebagai suatu isu hukum untuk membahas urgensi ratifikasi statuta roma bagi indonesia. Dari pembahasan disimpulkan bahwa Yurisdiksi Mahkamah Pidana Internasional lebih lengkap dari Pengadilan HAM di Indonesia dan urgensi ratifikasi statuta roma jika dikaitkan dengan kedaulatan negara tidak perlu dikhawatirkan karena mahkamah hanya untuk melengkapi sebagaimana prinsip komplementaris dalam statuta roma.

Abstract

The debate about the whereabouts of individuals as the subject of international law over time seems to get an answer. This is because after the first and second world wars, the international community's attention to human rights is increasing. The desire to bring the responsible perpetrators into account before the criminal court is increasing. Efforts to eliminate immunity against perpetrators for crimes committed encourage the establishment of international criminal tribunals ranging from the ad hoc nature to the permanent criminal court. Encouraging individuals as the holders of rights and obligations in international criminal law is getting stronger. It becomes more interesting because the individuals held accountable are citizens who actually have the sovereignty to enforce the law to their citizens. This paper will discuss the existence of individuals as subjects of international law and the effort to hold individuals accountable through international court mechanisms. Based on legal theory, legal principles, sources of international law and international treaties, the existence of individuals in international law can be seen from the granting of rights and obligations in international treaties. The Adhoc and Permanent International Criminal Court is established to demand the accountability of serious crimes against humanity. The existence of individuals as subjects of international law in the future will remain a polemic in its application. Keywords: Responsibility, Individual, International Criminal Law.

Abstract

This paper discusses the issue of the binding of the state in international agreements. The more complex the relations between international legal subjects making international customs can no longer be used to resolve the various problems that arise. In modern international relations, the existence of international treaties is mandatory. The issues discussed in this paper are the role of the state in international treaties and how the state is bound in international treaties. Both of these issues are examined with normative juridical approaches based on legal theory, legal principles, international law sources and international agreements. From the discussion it was concluded that the role of the state in international agreements will influence the actions of the state against international agreements. The binding of the state in international agreements is caused by the actions of the state and the contents of international agreements. a third country may be bound by the contents of an international treaty if the norm set forth therein is part of the jus cogens.

Abstract

Penelitian ini bertujuan untuk menganalisis yurisdiksi Pengadilan Pidana Internasional dengan Pengadilan HAM Indonesia. Masalah penelitian Bagaimana yurisdiksi dibandingkan dengan pengadilan kriminal internasional dan pengadilan HAM di Indonesia? dan Apa Peluang untuk Pengenaan Yurisdiksi Pengadilan Pidana Internasional di Indonesia? Metode penelitian menggunakan penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa perbandingan yurisdiksi Pengadilan Pidana Internasional dan Pengadilan Hak Asasi Manusia dapat dilihat dari yurisdiksi pidana, pribadi, temporal dan teritorial. Indonesia bukan negara pihak dan bukan negara yang menerima yurisdiksi Mahkamah Pidana Internasional. Meski begitu, Yurisdiksi Mahkamah Pidana Internasional dapat diterapkan di Indonesia mengingat perbedaan yurisdiksi pidana kedua pengadilan tersebut, karena ada 2 (dua) kejahatan yaitu kejahatan perang dan kejahatan agresi yang tidak diatur dalam Pengadilan HAM Indonesia. , jika ada situasi di Indonesia yang dirujuk oleh Dewan PBB dan keamanan Indonesia dianggap tidak mau dan tidak dapat membawa para pelaku kejahatan untuk diadili di pengadilan. This study aims to analyze the protection of labor rights in this case Indonesian migrant workers abroad within the framework of the ASEAN Economic Community and Law no. 18 of 2017 concerning Protection of Indonesian Migrant Workers' labor rights within the framework of the ASEAN Economic Community. Research problems, First, What is the Form of Protection for Indonesian Migrant Workers, Second, What is the Form of Legal Efforts for Indonesian Migrant Workers who are disadvantaged? The research method uses socio-legal research by observing the ASEAN Declaration of Human Rights and Law No. 18 of 2017, as well as other Indonesian Laws and Regulations. The results showed that the Protection of Indonesian Migrant Workers (PMI) is all efforts to protect the interests of prospective PMI and their families in realizing guaranteed fulfillment of rights in all their activities. The author will analyze the issue of the extent to which the state protects labor rights in this case Indonesian migrant workers abroad within the framework of the ASEAN Economic Community and Law No. 18 of 2017 concerning Protection of Indonesian Migrant Workers.

Abstract

Negara merupakan subjek paling penting dalam hukum internasional. Kedaulatan merupakan aspek terpenting dari negara. Secara sederhana kedaulatan diartikan sebagai kemampuan untuk menerapkan hukum nasional dalam wilayah teritorialnya. Namun dalam perkembangannya kedaulatan negara mengalami perubahan. Salah satu alasan perubahan terhadap kedaulatan negara adalah perhatian terhadap masalah hak asasi manusia dalam beberapa dekade terakhir. Sejarah kelam perang dunia pertama dan perang dunia kedua membawa konsep bahwa kejahatan terhadap kemanusiaan harus dihukum dan tidak dapat dibiarkan. Maka dari itu didirikanlah Mahkamah Pidana Internasional berdasarkan Statuta Roma yang memiliki kewenangan terhadap kejahatan luar biasa seperti genosida, kejahatan terhadap kemanusiaan, kejahatan perang dan kejahatan agresi. Pendirian Mahkamah Pidana Internasional merupakan bagian terpenting dalam perlindungan hak asasi manusia. Disisi lain perlindungan terhadap kedaulatan negara juga merupakan aspek terpenting dalam hubungan internasional. Maka dari itu Negara disarankan untuk menyelesaikan masalah domestik dan internasional secara damai dan melengkapi undang-undang nasional yang mengatur dengan peraturan kejahatan yang paling serius. Kata Kunci : Kedaulatan Negara, Hak Asasi Manusia, Mahkamah Pidana Internasional Abstract: State is one of the most important legal subject of international law. The most important element of a country is sovereignty. Sovereignty can be defined as the ability to apply the national law throughout the territory of the country. But the paradigm of this country’s sovereignty has changed over the development. One of the reason is the attention to human rights issues in recent decades. The dark history of the first and second world war deliver the ideas that crimes against humanity outstanding will be punished and should not be ignored. To overcome this problem International Criminal Court was established by the Rome Statute that has the authority to extraordinary crime that is the crime of genocide, crimes against humanity, war crimes, and crime of aggression. The establishment of The International Criminal Court is an important part of the protection of human rights. However, the protection of the sovereignty of the State is also an important aspect of the international relations. Thus thestate is advised to solve the domestic and international issues peacefully and complement national laws governing with regulation the most serious crimes. Abstract

The dark history of the first world war and the second world war had an impact increasingly increasing international attention to the protection of human rights. One of the efforts made was strengthening the provisions in international law. The state as the main actor in international relations plays an important role in the establishment of norms in international law. In its development, state relations are regulated in international agreements. The most common principle in international treaties is pacta sunt servanda. In general, the pacta sunt servanda defined by the state is only bound by the agreement pursuant approval from the state. This becomes very crucial for the protection of the sovereignty of the state. In reality, however, there are few international treaties that grant rights and obligations to countries that do not participate in international treaties. Related to international criminal law enforcement, the existence of this principle keep on debated, especially since those stipulated in international criminal law are international crimes and punishment of perpetrators of such crimes. The international dimension in a crime can be seen from various aspects. Therefore this paper will discuss the principle of pacta sunt servanda in law enforcement of international criminal law. This research was normative juridical as the main approach. The principle of pacta sunt servanda should not be based of state bondage in international criminal law enforcement, the state may be bound in that by customary international law.

Abstract

The establishment of the International Criminal Court is an answer to the view of natural law regarding past events where to try the perpetrators of serious crimes against human rights an ad hoc international criminal court was formed which violates the provisions that have been considered rigid as law by positivists. In view of natural law, the provisions referred to in the Rome Statute are formed which are the basis for the establishment of an international criminal tribunal that has the authority to try perpetrators of crimes of genocide, crimes against humanity, war crimes and crimes of aggression. According to adherents of natural law theory, natural law doctrines will always color and inspire positive law, so that positive law always goes on the right track, both when laws are made, implemented and when used by judges in deciding cases in court. Natural law offers options through its higher-trusted rules. In this case the law of nature will function as an opposition to a tyrannical government (repeated often in history). The laws of nature are also dual in nature. At one end its function is to protect the rights, freedoms and independence of individuals, at the other end in a country, natural law as the embodiment of the highest value functions as a cry for a nation's integrity, in which operational forms of social solidarity, the common good, the public interest or social consensus.
