Abstract

Indonesia's foreign policy remains consistent, adhering to free and active diplomacy principles grounded in Pancasila and the 1945 Constitution. The Indonesian foreign policy is characterized by its autonomy and proactivity, maintaining a neutral stance while consistently adapting to the ever-changing dynamics of world politics. Independently shape perspectives on global issues without being bound by military might or alliances, and actively promote peace, justice, camaraderie, and mutually advantageous collaboration among states. Indonesia continues to regard ASEAN as the primary foundation of its foreign strategy. Hence, this article seeks to elucidate Indonesia's foreign policy towards ASEAN, the collaborative relations between Indonesia and ASEAN member states, and the outcomes of their cooperation in fostering political stability in Southeast Asia. The conclusion asserts that Indonesia's foreign policy remains committed to the principle of free and active engagement with ASEAN and endeavours to uphold the stability of multilateral relations among ASEAN member nations.

Abstract

The Quran places great importance on justice, which significantly influences the development of constitutional Law. The Quran offers a thorough and inclusive explanation of justice language, encompassing individual and social dimensions. This essay seeks to examine the terminology of justice found in the Quran and its potential application within constitutional Law. Amidst the growing trend of globalization, it is crucial to comprehensively comprehend how the principles of justice outlined in the Quran can be effectively incorporated into constitutional legislation. This essay emphasizes the significance of incorporating Islamic principles into constitutional Law to establish a fair and enduring society.

Abstract

The path to democratic breakdown is often deceptive. It is important to remain vigilant against these threats and to work to protect the integrity of democratic institutions. Rather than relying on overt methods such as coups or violent attacks on government officials, those seeking to undermine democracy may use more subtle tactics. These can include questioning the validity of the constitution or spreading misinformation about the government. Even the Constitution and other institutions with a constitutional label will continue to exist, and people can still vote. Democracy can be undermined by leaders who maintain the appearance of democracy while eliminating its substance. Therefore, the people, as the highest authority in a democratic system, must make efforts to preserve democracy. The progress and setbacks of democracy hinge on the ballot box, where voters critically evaluate the ideas of prospective leaders who will govern the country for the next five years. Abstract

Essay ini mengulas konsep kedaulatan dalam perspektif filsafat, yang melibatkan perjalanan panjang pemikiran dari otoritas absolut penguasa hingga supremasi hukum dan kehendak rakyat. Dimulai dengan Jean Bodin yang memperkenalkan konsep kedaulatan absolut, diikuti oleh perkembangan pemikiran filsuf seperti Thomas Hobbes, John Locke, dan Jean-Jacques Rousseau melalui teori kontrak sosial yang menekankan pada legitimasi rakyat. Hans Kelsen kemudian menggeser fokus kedaulatan menuju sistem hukum, menyarankan bahwa negara seharusnya berlandaskan pada supremasi hukum dan bukan kekuasaan individu. Namun, dengan tantangan globalisasi, konsep kedaulatan tradisional menghadapi perubahan signifikan, di mana negara semakin tergantung pada kerjasama internasional. Kedaulatan kini lebih bersifat dinamis dan kontekstual, harus menyeimbangkan kewajiban internasional tanpa mengabaikan prinsip-prinsip dasar seperti legitimasi kekuasaan, ketertiban sosial, dan perlindungan hak-hak rakyat. Meskipun demikian, kedaulatan tetap berperan penting dalam menjaga stabilitas, keadilan, dan kesejahteraan dalam masyarakat modern yang semakin terhubung.

Abstract

This essay discusses the inherent relationship between sovereignty and the state and the state's role in realising and implementing sovereignty. Sovereignty, which refers to the highest power in a territory, cannot exist without the state as a legitimate political entity. The state is the foundation of sovereignty, acting as an institution that enforces the law, protects the rights of citizens, and maintains order and security. Through the social contract theory, the state emerges from social agreement to ensure security and justice. The state has the power to make laws, enforce rules, and resolve disputes, which reflects the operationalisation of sovereignty in the life of society. In the international context, sovereignty is recognised as the main attribute of a legitimate state, but it is not absolute because the state must comply with international norms. International recognition of the state is essential for the legitimacy of sovereignty, allowing states to interact at the global level. In conclusion, sovereignty can only exist effectively if a state exercises it, so the state acts as a pillar supporting sovereignty in the legal structure and international system.
