Abstract

Children as God's creatures have basic human rights or rights sincebirth, that is guarantee to grow flower completely, whether physical, mental andsocial, and noble character. Therefore it is necessary to safeguard and realize itswelfare by guaranteeing the fulfillment of its rights, so that no human being or anyother party can deprive the child's rights. Trafficking of girls for sexual purposes,hereinafter abbreviated as ESKA (Commercial Sexual Exploitation of Children), is avery detrimental action to the individual victims, the family, the community, and is aform of human rights violation, especially on the dignity of the child and thedevelopment of the next generation. Nevertheless, with the increasinglysophisticated and vast technological developments, children are faced with all theconveniences that impact positive and negative possibilities. DOI: 10.15408/sjsbs.v3i2.7858

Abstract

Issu Hak Asasi Manusia (HAM) sudah menjadi agenda yang makinpenting, artinya belakangan ini, terutama setelah berakhirrnya perang dinginnegara-negara Barat semakin bersemangat meng-advokasikan HAM keseluruh dunia, bahkan menjadikannya sebagai indikator dan faktor penentudalam menentukan kebijakan dan hubungan luar negeri mereka yangsampai sekarang masih menjadi ketegangan (curcials) adalah dalammemahami dan mengimplementasikan HAM itu antara negara-negara Baratdan negara sedang berkembang, khususnya negara Islam1. Hak AsasiManusia, sebagai nilai-nilai kemanusiaan yang dimiliki dan harus dijunjungtinggi oleh setiap individu dan kelompok manusia, terdapat kesulitan untukmelacak sejak kapan dan dimana dilahirkannya. Namun, sebagai suatusistem yang mengikat secara normatif dan formal, banyak yang menyatakanbahwa kelahiran HAM dimulai Magna Charta (1215), Bill of Rights (1689),The American Declaration (1776), The French Declaration (1789), kemudianThe Four Freedoms (1941), dan barulah Universal Declaration of HumanRights (1948). DOI: 10.15408/sjsbs.v3i3.7863

Abstract

In recent years, the news about Umrah is adorned with the phenomenon of howchaotic the Umrah system, fraud, pilgrims abandoned by the organizers in Indonesia,transit country or Saudi Arabia, lodging facilities, consumption, and tariff war betweentravel that are very unfair competition. In this situation, the pilgrims are the mostdisadvantaged people. The knowledge of the rights of Umrah pilgrims today is still lowconcern wich is very easy to be the object of exploitation of the organizers who onlyprioritize profit (profit oriented). Umrah is an important duty for Muslims because they arethe majority of the population in Indonesia. Dengan hadirnya lembaga-lembaga keuangan dan bisnis yangberbasis ajaran Islam, maka dibutuhkan berbagai ketentuan hukum Islamsebagai landasan operasional. Abstract

Masalah perdagangan orang atau Human Trafficking merupakan salah satu ancaman besar negara Indonesia. Setiap tahun hampir ribuan perempuan dan anak di Indonesia menjadi korban kejahatan trafficking. Tapi uniknya kejahatan ini, terkadang tidak menjadikan diri korban merasa dijadikan korban. Provinsi-provinsi di Indonesia menjadi sumber maupun tujuan perdagangan manusia terutama adalah Jawa diikuti kemudian oleh Kalimantan Barat, Lampung, Sumatra Utara, Banten Sulawesi Selatan, Nusa Tenggara Barat, Nusa Tenggara Timur, dan Sulawesi Utara. Bahkan modus perdagangan gadis remaja terutama dari wilayah Kalimantan Barat ke Taiwan yang berpura-pura sebagai pengantin wanita ternyata dipaksa menjadi pelacur. Pemasalahan ini bukanlah masalah baru dan tidak hanya terjadi di Indonesia saja melainkan juga di negara-negara lain, seperti Saudi Arabia, Jepang, Malaysia, Hongkong, Taiwan, Singapura dan beragai negara lain. Hal ini menunjukkan bahwa Perdagangan orang tidak lagi terbatas pada batas-batas wilayah negara, akan tetapi berlangsung melalui lintas batas. DOI: 10.15408/sjsbs.v3i2.3675

Abstract

Human Rights are natural rights that must be respected by everyone.Human rights are given from God. Nevertheless, fulfilling the human rights need statepolicy to commit and to implement human rights. Moreover, if the state declarerechstaat, the state must fullfill and respect the human rights as the requirement ofRechstaat. In Indonesia, the development and the history of fullfilling and respectingthe human rights happened in such important periode. Abstract

Abstract:The regulation of the education system in Indonesia is contained in the constitution of the Indonesian republic. Communities are given the right to education and teaching that is fair and equitable. In addition, the state is also obliged to educate the lives of the Indonesian people, as stated in the opening of the Constitution of the Unitary State of the Republic of Indonesia, even becoming the ideals of the Indonesian nation after its independence.Keywords: Education, Constitution, Rights of citizens Abstrak: Pengaturan tentang sistem pendidikan di Indonesia termaktub dalam konstitusi republik Indonesia. Masyarakat diberikan hak untuk mendapatkan pendidikan dan pengajaran yang adil dan merata. Selain itu, negara juga berkewajiban untuk mencerdaskan kehidupan masyarakat Indonesia, sebagaimana tertuang dalam pembukaaan Undang-Undang Dasar Negara Kesatuan Republik Indonesia, bahkan menjadi cita-cita bangsa Indonesia pasca kemerdekaannya. Abstract

In globalization era today we as world member can feel the spread of science andtechnology advance in which one country with another country will know each otherstrength and weakness through evaluation of its various technology and communicationwhich influence people in various countries. From year to year there are many people whoare increasingly go to jail. Whereas the failure and success of citizen education can be seenfrom daily attitude and behavior of community and their family environment. So, it is notsurprising that there are more and more prisoners from year to year. This indicate thatmany citizens who are involved in infringement which result in criminality. The solutionis that citizen education material should be prepared to suit with situation from influenceof science and technology advance, in addition the government should control communityand their family environment to be better (good citizenship). The material and the wayteacher teach (method, media and model) should be arranged. As suggested by William T.Callahan (1990: 338) that good citizenship was not born, but is in interpersonal, intellectualabilities which are needed and should be learned seriously, then applied to community andtheir family environment as citizen of people in various countries. DOI: 10.15408/sjsbs.v3i3.7865
