Abstract

Law is a series of regulations and norms that govern society to create order and justice in national life. However, not all individuals are willing to comply with applicable legal regulations; therefore, effective law enforcement is necessary to ensure compliance with these regulations. In the context of shipping, law plays a crucial role in maintaining the security, safety, and protection of the maritime environment, as stipulated in Law Number 17 of 2008 concerning Shipping. Violations in the field of shipping, such as operating ships without meeting safety standards, compromising security, and failing to protect the maritime environment, can threaten human safety, environmental sustainability, and naval security stability.This study aims to analyse the application of law to perpetrators of shipping crimes based on Law Number 17 of 2008 concerning Shipping, and to identify factors that influence the occurrence of violations in ship operations. The research method used is a normative juridical approach, which focuses on the study of the application of positive legal norms in enforcing criminal law in the shipping sector.The results of the study indicate that law enforcement against maritime crimes has not been optimal due to several factors, including low legal awareness, weak supervision and enforcement, and economic interests that often prioritize financial gain over safety and environmental protection. Increased legal awareness, stricter supervision, and firm law enforcement are necessary to ensure that perpetrators of maritime crimes are subject to effective legal sanctions, thereby providing a deterrent effect.Keywords: Crime, Shipping, Perpetrators.

Abstract

Foundations as non-profit legal entities strategically support social, religious, and humanitarian activities in Indonesia. However, in practice, many foundations experience stagnation, deviations from their goals, or are misused, requiring dissolution. This study aims to analyse the legal provisions regarding the dissolution of foundations as stipulated in Law Number 28 of 2004 concerning Foundations, and to evaluate the practices and obstacles in their implementation in the field. The research method used is normative legal research with a statutory and conceptual approach. Data were reviewed through a literature study of relevant laws and regulations, jurisprudence, and previous research results related to the dissolution of foundations. The study results indicate that the dissolution of foundations is regulated normatively in Articles 62 to 71 of the Foundation Law, which include dissolution due to the expiration of the term, the objectives achieved, or based on a court decision. However, in practice, many foundations still do not carry out the dissolution process under legal provisions, including weak supervision, minimal understanding of the law by the management, and suboptimal reporting and liquidation mechanisms. In addition, there is no transparent and accountable system in managing the remaining assets of dissolved foundations.Keywords: Foundation; Dissolution; Foundation Law; Legal Entity; Liquidation

Abstract

A foundation is a non-profit legal entity with a strategic role in the social, educational, and humanitarian fields. The existence of foundation assets is the main backbone in ensuring the continuity of its activities. However, practices in the field show various problems such as misuse of assets, non-transparent management, and weak supervision and legal protection of these assets. This study aims to analyse the legal provisions in Law No. 28 of 2004 concerning Foundations, especially regarding asset protection and management, identify practices and challenges foundations face in managing their assets, and provide recommendations for improving relevant regulations and administration. This study uses a qualitative method with a normative and conceptual legal approach. Data sources were obtained from laws and regulations, legal literature, scientific journals, and case studies of foundation dissolution in Indonesia related to asset management. The analysis was carried out by reviewing the applicable legal provisions and reflecting them on factual practices in the field. The study results indicate that although Law No. 28 of 2004 has regulated the prohibition of profit sharing to foundation trustees, administrators, and supervisors, and stipulates provisions regarding the origin of assets and their use, there are still weaknesses in the implementation and supervision mechanisms. Several cases show irregularities by foundation administrators and weak legal protection for donors and beneficiaries. Therefore, there is a need for strengthening regulations, increasing transparency, and more effective supervision from the Ministry of Law and Human Rights and professional third parties. This study is expected to be an academic and practical contribution in improving the governance of foundation assets in Indonesia.Keywords: Foundation Assets; Protection; Management

Abstract

Proliferasi nuklir menjadi salah satu isu sentral dalam hubungan internasional, terutama dalam konteks persaingan kekuatan militer antara negara-negara yang bersengketa Penelitian ini bertujuan untuk menganalisis bentuk pertahanan militer Pakistan terhadap India melalui proliferasi nuklir. Latar belakang penelitian ini adalah isu proliferasi nuklir yang berkembang sebagai akibat dari kemajuan teknologi dan konflik antar negara, khususnya antara Pakistan dan India. Pakistan, dengan segala keterbatasannya, berupaya melindungi diri dari potensi ancaman militer India dengan mengembangkan kemampuan nuklirnya. Penelitian ini mengkaji bagaimana proliferasi nuklir menjadi bentuk pertahanan diri bagi Pakistan, mengingat kapabilitas militer India yang lebih maju. Penelitian ini menggunakan metode studi literatur dengan merujuk pada penelitian terdahulu dan perjanjian internasional seperti NPT dan peran IAEA serta kebijakan konstitusi Pakistan pada tahun 1973. Dengan menggunakan pendekatan teori realisme defensif dan konsep self-deterrence, penelitian ini menjelaskan bagaimana kebijakan nuklir Pakistan berkembang sebagai respons terhadap ancaman dari India, yang lebih dulu mengembangkan senjata nuklirnya. Penelitian ini berkontribusi dalam kajian keamanan internasional, khususnya dalam memahami bagaimana negara-negara yang berkonflik menggunakan strategi deterrence dalam menjaga stabilitas regional. Meskipun proliferasi nuklir dapat meningkatkan ketegangan geopolitik, temuan penelitian ini menunjukkan bahwa kepemilikan senjata nuklir juga berfungsi sebagai alat negosiasi dan pencegahan perang terbuka di kawasan yang rentan terhadap konflik berkepanjangan. Dalam penelitian menunjukkan bahwa keputusan Pakistan untuk memiliki dan mengembangkan teknologi nuklir bukan hanya sebagai bentuk peningkatan kekuatan militer, tetapi juga sebagai strategi untuk menciptakan balance of power di Asia Selatan. Dengan menjalin kerja sama dengan negara seperti China dan menerima bantuan teknologi militer, Pakistan memastikan bahwa pertahanannya tetap kongkrit terhadap India. Hasil penelitian diharapkan dapat memberikan wawasan mengenai dinamika proliferasi nuklir antara Pakistan dan India, serta implikasinya terhadap stabilitas regional. Penelitian ini juga diharapkan dapat menjadi referensi bagi kajian akademik selanjutnya mengenai studi proliferasi nuklir dan hubungan internasional.Kata kunci: Pakistan, India, Proliferasi Nuklir, Keamanan Nasional.
